AGENDA TITLE: Accepting Improvements Under Contract for Lodi Avenue and Mills Avenue
Resurfacing Project

RECOMMENDED ACTION: Accept improvements under contract for Lodi Avenue and Mills
Avenue Resurfacing Project.
BACKGROUND INFORMATION: This project included localized pavement repair, the application of
approximately 24,000 square yards of rubberized asphalt cape seal,
and 21,000 square yards of fiberized slurry seal. The project limits
included Lodi Avenue (from Ham Lane to Hutchins Street) and Mills Avenue (from Lodi Avenue to
Kettleman Lane), as shown on Exhibit A.
The contract was awarded to DSS Company dba Knife River Construction, of Stockton, in the amount of
$1,133,926 on October 21, 2020 and authorized the City Manager to execute change orders in an amount
not to exceed $170,000. All work was completed in substantial conformance with the plans and
specifications approved by City Council and prior to the adjusted contract completion date of October 22,
2021. The completion date was extended to accomodate for a bird survey required by Caltrans, weather
delays, scarcity of materials, and a City issued suspension of work on Lodi Avenue to allow the
completion of the Sunset Theater off-site work.
The final contract amount was $1,118,409.73. The difference between the contract amount and the final
amount was due to Change Order No. 1 which included the replacement of utility boxes that were
unavoidably damaged during construction ($4,451.54), and the remobilization of a saw -cutter to saw -cut
additional pavement repair at the request of City staff ($1,495.00). The remaining cost difference is due to
reductions in actual unit quantities resulting in a credit of $21,462.81, identified during construction.

Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors
that the project is complete and begins their 30 -day period to file a stop notice requiring the City to
withhold payments from the prime contractor in the event of a payment dispute.
FISCAL IMPACT: By investing in proper roadway maintenance, significant capital dollars will
be saved by extending the useful life of the pavement and minimizing costly
pavement reconstruction. This project does not impact the General Fund.
FUNDING AVAILABLE: The project was funded by Federal Transportation Improvement Program
and Senate Bill 1 Gas Tax funds.
