AGENDA TITLE: Accepting Improvements Under Contract for 2021 Pavement Fog Seal

RECOMMENDED ACTION: Accept improvements under contract for 2021 Pavement Fog Seal.
BACKGROUND INFORMATION: This project applied a fog seal over street pavement within the Rose
Gate and Reynolds Ranch subdivisions (Exhibits A and B). Fog
Seal is a petroleum emulsion which restores components in
asphalt lost during the initial aging process, and improves durability. This initial phase of the program
focuses on recently completed residential developments since it is intended to be used on newer
pavement.
The contract was awarded to Talley Oil, of Madera, in the amount of $95,515.12. All work was
completed in substantial conformance with the plans and specifications approved by City Council prior to
the contract completion date and with no difference between the contract amount and the final amount.
The original completion date was November 6, 2021.
The project included the application of fog seal treatment within the street frontage of over 450 residential
lots within the Rose Gate and Reynold's Ranch subdivisions. After the fog seal application, the
contractor spread sand to blot excess sealant and then swept, and removed excess sand from the
roadway. City staff did receive complaints from seven residents (less than 2% of affected residents)
regarding "tracking" of oil across their driveways. Since the contractor is responsible for maintaining
traffic as required to provide adequate cure time to minimize driveway tracking, Talley Oil has made
efforts to contact all residents who complained and power washed driveways of those residences most
affected.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors
that the project is complete and begins their 30 -day period to file a stop notice requiring the City to
withhold payments from the prime contractor in the event of a payment dispute.
FISCAL IMPACT: This proactive street maintenance effort is key toward minimizing more
costly road maintenance work in the future.
FUNDING AVAILABLE: Funding for this project came from a combination of street maintenance
funds from Fiscal Year 2021/22 Capital Budget and developer fees.
