A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING
ABANDONMENT OF AN 8 -FOOT AND A 16.5 -FOOT PUBLIC
UTILITY EASEMENTS LOCATED AT 1901 ACKERMAN DRIVE
WHEREAS, public utility easement vacations are requested by E. A. Bonelli Architects &
Engineers on behalf of the current parcel owner, Rich Products Corporation; and
WHEREAS, descriptions and locations of the existing easements are shown on Exhibits
A & B. Due to a lot line adjustment recorded in 2004, which changed the property line locations,
the easements are no longer adjacent to a property line; and
WHEREAS, both easements referenced above are not needed nor have they been used
in the last five years and the property owners have requested abandonment of the existing
easements to allow development of the parcel; and
WHEREAS, the City of Lodi Electric Utility, Water/Wastewater and Street Divisions,
AT&T, PG&E and Comcast have been contacted, and no utilities or other facilities were found to
exist within the easements and all agencies contacted have approved abandonment without
further comment or conditions; and
WHEREAS, under Section 8333 of the Streets and Highways Code, a local agency may
summarily vacate an easement if "the easement has not been used for the purpose for which it
was dedicated or acquired for five consecutive years immediately preceding the proposed
vacation;" and
WHEREAS, staff recommends the City Council abandon the 8 -foot and 16.5 -foot public
utility easements without referral to the Planning Commission or the normal posting, publishing,
and public hearing.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
abandon the 8 -foot and 16.5 -foot public utility easements located at 1901 Ackerman Drive
without referral to the Planning Commission or the normal posting, publishing, and public
hearing.
