RECOMMENDED ACTION: Adopt resolution approving side -letter agreement amending the
Memorandum of Understanding between the City of Lodi and the
Lodi Professional Firefighters, regarding incentive pay, retroactive
to December 22, 2014.
BACKGROUND INFORMATION: The Lodi Professional Firefighters (LPF) Memorandum of
Understanding (MOU) provides for an incentive pay of three
percent (3%) for participation on one of the specialty teams within
the Fire Department. Members possess specialized skills needed
to participate on the special team and typically attend additional
trainings or possess special certifications.
The City has treated this incentive as pensionable compensation and has reported it to CalPERS, with
contributions from both employer and employee. Recently, CalPERS reviewed compensation reported
for a LPF member preparing to retire and determined that the incentive did not meet their definition of
reportable compensation. The City, the LPF and representatives from CaIPERS met on several
occasions to discuss how to amend the current MOU to meet the CaIPERS requirements and provide the
LPF members with pensionable compensation as negotiated.
With approval from CalPERS, the City and LPF are interested in eliminating the separate incentive pay
for participation on a special team and incorporating the value of the incentive pay, three percent (3%),
into base pay. CalPERS allows us to make this correction as far back as we have payroll records, which
is December 22, 2014, when we implemented our current ERP/payroll system. All LPF members will be
required to participate on one team. The topic of rolling the incentive into base salary has been
discussed during past negotiations; however, it was not agreed upon at that time. The parties wish to
make this change retroactive to December 22, 2014.
The parties further agree that the incorporation of the three percent (3%) incentive into base salary will
not result in additional contributions to the LPF member's Deferred Compensation account (457 plan) for
those members participating in a 457 plan.
The salary ranges for the classifications of Fire Fighter I Qob code 6000 and 6001) will not be amended
retro -actively as newly hired Fire Fighters historically have not been assigned to a Special Team and
were not receiving the incentive pay. However, going forward, all Fire Fighter I's will be assigned to a

Special Team effective November 1, 2021, and the salary ranges will be increased by three percent (3%)
accordingly.
Staff recommend approval of the side -letter agreement to amend the LPF MOU to eliminate the three
percent (3%) incentive pay for participation on Special Teams and to incorporate the three percent (3%)
incentive into base pay, retroactive to December 22, 2014, and to approve the amended salary ranges
for LPF classifications.
FISCAL IMPACT: During the retroactive period, there were short durations in which new
firefighters were not receiving the team pay incentive. The retroactive
adjustment will require PERS contributions to be paid on this
compensation. The total cost across the bargaining group for this six year
retroactive adjustment is approximately $30,000 and can be absorbed
within existing salary and benefit expenditure authorizations for Fiscal Year
2021-22.
FUNDING AVAILABLE: Funding is available within the current Fire Department budget in Fiscal
Year 2021-22.

Side Letter Agreement Amending the Memorandum of Understanding
Between the City of Lodi and the Lodi Professional Firefighters
This Side Letter Agreement is entered into between the City of Lodi, a municipal corporation
("City"), and the Lodi Professional Firefighters ("LPF"), and is effective retroactively to
December 22, 2014.
RECITALS
WHEREAS, the Memorandum of Understanding between LPF and the City has a term of
January 1, 2020 through December 31, 2022 (MOU); and
WHEREAS, the City and the LPF have mutually agreed to amend Article II, sections 2.1
and 2.2 of the LPF MOU as follows:
ARTICLE II — DEPARTMENT SANCTIONED TEAMS

thatte address a variety of special hazards and provide specialized services to the
department or community. When a team is established, minimum standards for inclusion
and retention as a team member shall be developed and ratified by the Fire Chief. Any

Effective retroactive to December 22, 2014, the three percent (3%) incentive for
assignment to a specialized team has been eliminated. Effective December 22, 2014, the
salary ranges for all LPF classifications shall be increased by three percent (3%).
Both parties agree that the retroactive increase to the salary ranges will not result in
additional retroactive contributions to the LPF member's deferred compensation account.
Each LPF member shall be assigned to one specialized team at the discretion of the Fire
Chief or designee. e. By mutual agreement between an LPF member and the Fire Chief or
designee, employees may volunteer to be assigned to a secondarspecialized team based
on operational necessity, o�gence circumstances.
2.2 The development of new teams shall require the submittal of minimum entry level and
performance criteria for maintenance of membership to the Fire Chief prior to the
development of the team. The Fire Chief shall have the sole discretion as to the appropriate
number of members per specialized team. The department shall make every effort to
develop a cadre of specialized teams to adequately address the needs of its members.
All other provisions of the MOU shall remain unchanged and in full force and effect.

RESOLUTION NO. 2021-285
A RESOLUTION OF THE LODI CITY COUNCIL AMENDING THE
MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF LODI AND
THE LODI PROFESSIONAL FIREFIGHTERS THROUGH A SIDE -LETTER
AGREEMENT AND AMENDING THE SALARY TABLES FOR ALL
CLASSIFICATIONS WITHIN THE LODI PROFESSIONAL FIREFIGHTERS
BARGAINING UNIT RETROACTIVE TO DECEMBER 22, 2014
WHEREAS, the Lodi City Council approved a successor Memorandum of
Understanding with the Lodi Professional Firefighters (LPF) on March 4, 2020, that includes a
three percent (3%) incentive for participation on a Specialty Team; and
WHEREAS, LPF members in all classifications within LPF, except for Fire Fighter I,
were eligible to participate on a Special Team; and
WHEREAS, the City has reported the incentive to CaIPERS as pensionable
compensation; and
WHEREAS, CaIPERS has determined that the three percent (3%) Specialty Team
incentive is not considered pensionable compensation and has authorized the City to make
retroactive adjustments to the salary schedule for LPF members to eliminate the incentive pay
and inco-porate the incentive into base salary; and
WHEREAS, the City wishes to amend the language to eliminate the separate incentive
pay for participation on Special Teams and increase the base pay by the equivalent three
percent (3%) for classifications where employees were assigned to a Special Team, retroactive
to December 22, 2014; and
WHEREAS, the increase in base pay will not constitute additional contributions to the
LPF menber's Deferred Compensation account, if enrolled; and
WHEREAS, all members of LPF will be required to participate on one Special Team;
and
WHEREAS, it is recommend that Council approve the revisions to the Memorandum of
Understanding with LPF through a Side -Letter Agreement and to approve the amended salary
tables fo- LPF classifications, retroactive to December 22, 2014.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby approve
the attached Side -Letter Agreement (Exhibit A) between the City of Lodi and LPF; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby approve the
amended salary tables for LPF positions (Exhibit B), retroactive to December 22, 2014.
