HomeMy WebLinkAboutResolutions - No. 2021-331RESOLUTION NO. 2021-331 A RESOLUTION OF INTENTION OF THE LODI CITY COUNCIL TO VACATE A 10 -FOOT PUBLIC UTILITY EASEMENT LOCATED AT 800 THROUGH 830 TALAVERA CIRCLE, APNS: 027-310-29, 28, 27, 26, 25, AND 24 WHEREAS, in 1993, a 10 -foot public utility easement was dedicated over the property formerly known as 2040 Cochran Road, for the purpose of overhead electrical utility services; and WHEREAS, the easement is no longer needed as the current development was conditioned to dedicate new public utility easements for the undergrounding of the electric utility lines which will allow full use of the parcel by the new parcel owners; and WHEREAS, the City of Lodi Electric Utility Department, City of Lodi Water/Wastewater and Street Divisions, AT&T, Pacific Gas & Electric, and Comcast have approved the 10 -foot public utility easement vacation without further comment or conditions; and WHEREAS, staff recommends adopting a resolution of intention to vacate a 10 -foot Public Utility Easement located at 800 through 830 Talavera Circle, APNs: 027-310-29, 28, 27, 26, 25, and 24. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby adopt resolution of intention to vacate a 10 -foot public utility easement located at 800 through 830 Talavera Circle, APNs: 027-310-29, 28, 27, 26, 25, and 24; and BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
