HomeMy WebLinkAboutAgenda Report - October 6, 2021 C-07AGENDA ITEM Cw7 4 CITY OF LODI COUNCIL COMMUNICATION TM AGENDA TITLE: Adopt Resolution Ratifying Expenses, Authorizing the City Manager to Execute Change Order No. 3, Accepting Improvements under Contract for Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System Decommissioning and Removal MEETING DATE: PREPARED BY: October 6, 2021 Public Works Director RECOMMENDED ACTION: Adopt Resolution ratifying expenses, authorizing the City Manager to execute Change Order No. 3, accepting improvements under contract for Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System Decommissioning and Removal. BACKGROUND INFORMATION: On August 19, 2020, Council approved specifications and authorized advertisement for bids for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project. On October 21, 2020 Council rejected the original bids and authorized a re -bid of the project due to inconsistencies in the original bids submitted. Council awarded the contract to A.M. Stephens Construction Co. in the amount of $601,714, on January 6, 2021. On April 7, 2021 Council authorized an increased appropriation of $150,000 to account for the removal of additional extraction wells that were part of the initial extraction pilot program; and authorized the City Manager to execute additional change orders resulting in a total appropriation of $987,500 with City Manager change order authority of $230,000. This project generally consisted of decommissioning the soil vapor extraction and the groundwater extraction and treatment systems, located near the alleyway between Pine and Oak Streets, and Pleasant Avenue and Church Street, as shown on Exhibit A. Before and after photos are included as Exhibit B. Specifically, the project included the removal of several extraction wells in the area that all fed into the central extraction/capture unit that was constructed in 2010. Since a portion of the work was performed on private property, multiple use agreements between the City and adjacent property owners were executed to facilitate construction of the initial extraction system and related underground utilities. The agreements required that upon decommissioning and removal of the extraction systems, the City was required to remove the wells and all of the underground piping on the private property and replace any damage to existing improvements caused by the removal. During construction it became apparent that resurfacing was necessary on the majority of the adjacent parking lots where the utilities were being removed due to the impact of the construction equipment and utility removals. The original contract completion date was June 11, 2021, with the adjusted contract completion date (including the change orders) being September 10, 2021. The actual project completion date was September 8, 2021. The additional contract days were added to accommodate the expanded scope of work included in the change orders. The original contract amount was $601,713.90. The final contract amount was $839,323.18. The reasons for the increase in project cost are reflected below: APPROVED: Steve Schwabauer Stephen Schwabauer, City Manager K:\WP\PROJECTS\WATERWCE,TCE\Central\Exlradion System Demo.doc 9/28/2021 Adopt Resolution Ratifying Expenses, Authorizing the City Manager to Execute Change Order No 3, Accepting Improvements under Contract for Central Plume PCEfrCE Groundwater and Soil Vapor Extraction System Decommissioning and Removal October 6, 2021 Page 2 Change Order No. 1 ($134,075.00): Included removal of unknown piping and appurtenances left over from the original pilot test study located in the parking lot of 6 S. Pleasant Avenue. These items should have been removed/abandoned in 2010. Due to the extensive surface impacts caused by this additional work, most of the parking lot needed resurfacing to comply with the terms of the private property use agreements. Change Order No. 2 ($38,380.92): Included additional City requested parking lot resurfacing to abandon an additional, unknown extraction well not included in the original scope of work; and the cost to dispose of contaminated soil excavated from the alley to comply with the State approved closure plan. Change Order No. 3 ($65,153.36): Included additional City requested demolition, paving, concrete and landscape work associated with returning the affected properties to their former condition in accordance with the private property use agreements. Although the City Manager's authorized change order authority exceeds the total of Change Orders 1-2, the addition of Change Order No. 3 increases the total project cost to $839,324 which exceeds the City Manager's change order authority. For this reason, staff is recommending ratifying the expenses ($9,324), authorizing Change Order No. 3. Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors that the project is complete and begins their 30 -day period to file a stop notice requiring the City to withhold payments from the prime contractor in the event of a payment dispute. FISCAL IMPACT: Annual operation and maintenance costs for this facility will be eliminated as a result of system removal. The project was entirely funded by the Central Plume Settlement Fund and did not impact the General Fund. FUNDING AVAILABLE: This project was funded by the Central Plume Settlement Fund as follows. The PCE/TCE Rates Fund was budgeted but not used. Stephens Construction Co. in the amount of $601,714; and WHEREAS, this project generally consisted of decommissioning the soil vapor extraction and the groundwater extraction and treatment systems, located near the alleyway between Pine and Oak Streets, and Pleasant Avenue and Church Street; and WHEREAS, on April 7, 2021, Council authorized an increased appropriation of $150,000 and authorized the City Manager to execute additional change orders, resulting in a total appropriation of $830,000; and WHEREAS, the final contract amount was $839,324 which exceeds the Council -approved appropriation of $830,000; and WHEREAS, staff recommends Council ratify expenses, authorize the City Manager to execute Change Order No. 3, and accept improvements under the contract for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby ratify expenses for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute Change Order No. 3 to the contract for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby accept improvements under the contract for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project; and BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
