BACKGROUND INFORMATION: Vineyard Terrace Subdivision is located east of Lower Sacramento Road and north of Century Boulevard, as shown on Exhibit A. It consists of 235 single-family residential lots and the last phase of the project was accepted on December 16, 2020 by the City Council. At the request of the City, the Developer, K. Hovnanian CA Land Holdings, LLC (Developer), constructed certain off-site street improvements on the east side of Lower Sacramento Road to complete the curb, gutter, sidewalk, and pavement improvements, from the north project boundary to the Sunwest Plaza intersection (Food 4 Less shopping center). The request also includes the acquisition of additional street easements and other miscellaneous improvements along the properties at 1606, 1610, and 1626 South Lower Sacramento Road. It should be noted the Developer invested considerable funding and effort in obtaining the necessary easements. This effort facilitated the completion of a 415 LF gap that has lingered for over 15 years and finally provides a safe pedestrian and bicycle path along the east side of Lower Sacramento between Kettleman Lane and Debenedetti Park south of Century Boulevard. Per Lodi Municipal Code Chapter 17.62 "Reimbursement for Construction", these off-site public improvements qualified for reimbursement. Developer prepared an engineering report for the reimbursement and the establishment of the area of benefit from the properties as shown on Exhibit B. The State of California, in Government Code Sections 66485 through 66489, requires that the City either pay for or enter into an agreement to reimburse the installing party, including an amount attributable to interest for such installations. To pay the costs as required by the reimbursement agreement, the City may collect funds from the other properties which benefit from such installations. In this case however, the frontage improvements along Lower Sacramento Road will be paid by the City since the City had plans to make the improvements in the past but were not successful in acquiring the necessary easements. Typically, the City's practice is to exchange frontage improvements for street easement dedication from the fronting properties. The Developer constructed a sound wall and other improvements along these properties at the Developer's own expense in exchange for acquiring the necessary street easements; and is not seeking reimbursement from the benefiting properties. In total, Developer absorbed more than $115,000 towards completing the off-site Lower Sacramento Road improvements. Providing a safe pedestrian and bicycle path of travel between the development of 235 medium density homes and the commercial center to the north is a substantial benefit to the community. Staff recommends the Council authorize the reimbursement for the Lower Sacramento Road public improvements in the amount of $151,869.39 and appropriate the funds. FISCAL IMPACT: The completed improvement provides a much needed safe route for the pedestrian and bicyclists. There will be a slight increase in street maintenance for the new improvements. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the reimbursement for the Lower Sacramento Road public improvements in the amount of $151,869.39; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the appropriation of funds as set forth above.
