HomeMy WebLinkAboutAgenda Report - January 17, 2001 E-18CITY OF LODI COUNCIL COMMUNICATION E LL AGENDA TITLE: Adopt Resolution Establishing Fees for Administration of Adult - Oriented Business Ordinance MEETING DATE: January 17, 2001 PREPARED BY: City Attorney RECOMMENDATION: That the Council adopt the attached Resolution Establishing Fees for the processing of Adult -Oriented Business Licenses. BACKGROUND: As you will remember recently the City Council adopted an Ordinance dealing with Adult -Oriented business. Provisions of that Ordinance require that Owners as well as persons employed by Adult -Oriented Businesses receive licenses to carry out their respective roles. Under the terms of the Ordinance, the City Council is to adopt a Resolution establishing the fees to be paid by applicants in order to reimburse the City for the costs associated with the conducting of background investigations, fingerprinting and processing of applications. This process is to be administered by the Police Department. Lee Patterson, on behalf of the Police Department, has reviewed the Ordinance and the activities that the Ordinance requires of the Police Department in processing license applications. He has found that it takes approximately the same amount of investigating time and paperwork to process these applications as is spent in the processing applicants for massage licenses. The Department has recommended, and the Resolution has been prepared based upon that recommendation, that the fee structure be the same as the one which the City utilizes for the issuance of massage licenses. D' on Flynn — tity Manager RESOLUTION NO. 2001-09 A RESOLUTION OF THE LODI CITY COUNCIL ESTABLISHING FEES FOR THE PROCESSING OF ADULT-ORIENTED BUSINESS LICENSES BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS: SECTION 1. WHEREAS, the Lodi Municipal Code requires the City Council, by Resolution, to set fees for various services provided by the City of Lodi to recover those costs associated with providing specific services and programs; and WHEREAS, the City Council adopted Ordinance No. 1696 on October 18, 2000 relating to the regulation of Adult -Oriented Businesses; and WHEREAS, Ordinance No. 1696 requires that every person who proposes to maintain, operate, conduct, or establish an Adult -Oriented Business in the City shall file an application with the Chief of Police on a form provided by the City and shall pay a non-refundable application, investigation, and licensing fee set forth by resolution from time to time by the City Council; and WHEREAS, staff recommends the following fee schedule: State City Total Adult -Oriented Business Proprietor $32.00 $281.50 $313.50 Adult -Oriented Business Employee $32.00 $156.00 $188.00 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lodi does hereby implement the fee schedule for the regulation of Adult -Oriented Businesses as set forth above. SECTION 2. All resolutions or parts of resolutions in conflict herewith are repealed insofar as such conflict may exist. SECTION 3. This resolution shall be published one time in the Lodi News Sentinel, a daily newspaper of general circulation printed and published in the City of Lodi, and shall be in force and take effect immediately.
