HomeMy WebLinkAboutAgenda Report - November 15, 2000 H-10AGENDA TITLE: Authorize the transfer of funds for additional work on the Electric Utility Substructures, Turner Road/McLane Substation Contract ($195,000.00) MEETING DATE: November 15, 2000 PREPARED BY: Electric Utility Director RECOMMENDED ACTION: That the City Council authorize the transfer of $195,000.00 from the Electric Utility Department's budgeted capital funds to the project specific accounts. BACKGROUND INFORMATION: This project was awarded to Golden State Utility Company, of Turlock, on March 1, 2000 (Res. No. 2000-28) in the amount of $304,999.00. Three change orders were issued during the contract period in the total amount of $29,607.00 or 9.71%. These change orders expanded the project boundary and funded lighted message (advisory) boards for traffic control not included in the original contract. At this time the project is substantially complete with the exception of work still to be performed around six vaults located in the street. During construction numerous conflicts with existing but unmarked utilities as well as an abandoned septic system, a house foundation and an oak tree located just below the pavement were encountered. These obstacles required redesign in order to locate the vaults and conduits in conflict free areas all of which resulted in considerable delays and significant additional work by the contractor. Due to the condition of the subgrade in some areas of Turner Road several cave-ins did occur and extra excavations were necessary to position the conduits and vaults, again adding additional work and materials not considered in the contract. For traffic control an engineered traffic plan as well as weekend work were required. The construction delays necessitated the use of the lighted traffic boards in excess of the estimated time thereby adding an additional cost. All of the above events are not the responsibility of the contractor and therefore have resulted in a cost adder. An error in the contract quantity for trenching (1000 ft.) coupled with associated trench safety and the adjustments in other contract quantities to compensate the contractor for actual work performed has resulted in cost adders_ The asphalt concrete paving increased significantly due to the many necessary additional excavations to locate facilities. The condition of the street base (cave-ins) and existing pavement likewise resulted in unexpected additional paving. All of the above conditions have resulted in an additional expenditure of $195,000 to complete the project. Negotiations between the contractor and the Department have resulted in this final settlement amount. The negotiating process was discussed with Public Works Department's engineering staff. It is felt that the City obtained a fair and equitable settlement given the numerous problems encountered. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lodi does hereby authorize the transfer of $195,000.00 from the Electric Utility Department's budgeted capital funds to the project specific accounts.
