BACKGROUND INFORMATION: Council approved the 2021-2023 Block Wall Repair Program specifications and authorized advertisement for bids on April 21, 2021 - This contract is intended to facilitate block wall repairs on an "as - needed basis" in lieu of separately procuring contractors on a case-by-case basis. This allows the City to avoid time delays and minimize City liability. The initial term of the Contract is two years and includes two optional, one-year extensions, for a total of four years, if all extensions are executed. The City received the following two bids on June 09, 2021 Above/(Below) Bidder Location Bid Engineer's Estimate Engineers Estimate $75,000.00 John Wait Masonry, Inc. Lodi *$54,599.00 ($20,401) David Hall Masonry, Inc. Ripon $153,900.00 $78,900.00 'Unresponsive Bid The bid from John Wait Masonry, Inc. was deemed nonresponsive as it did not include Receipt of Addendum No. 1. Staff then reviewed the bid documents from the lowest responsive bidder, David Hall Masonry, Inc. David Hall Masonry, Inc., submitted a bid approximately three times higher than the bid from John Wait Masonry, Inc. Due to this substantial difference, Staff recommends Council reject all bids and authorize re -advertisement. The specifications are on file in the Public Works Department. The planned re -bid opening date is August 11, 2021. The estimate remains at $37,500 annually. Staff recommends rejecting all bids, approving specifications, authorizing re -advertisement for bids, authorizing City Manager to award Contract to lowest, responsive bidder for 2021-2023 Block Wall Repair Program, in an amount not -to -exceed $75,000, and authorizing City Manager to execute change orders in an amount not to exceed $10,000. This project does not impact the General Fund. FUNDING AVAILABLE: Fiscal Year 2021/22 Budget: Measure K (30399000.77020) $25,000 Remaining funds will be budgeted in Fiscal Year 2022/23. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby reject all bids for the 2021-2023 Block Wall Repair Program, approve specifications, and authorize re -advertisement for bids; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to award a contract to the lowest responsive bidder for the 2021-2023 Block Wall Repair Program, in an amount not to exceed $75,000; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute change orders in an amount not to exceed $10,000; and BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
