HomeMy WebLinkAboutAgenda Report - June 16, 2021 H-02AGENDA ITEM CITY OF LODI COUNCIL COMMUNICATION TM H-2 AGENDA TITLE: Adopt Resolution Authorizing City Manager to Extend Temporarily Modified Customer Assistance & Relief Energy (CARE) Package Program Term to September 30, 2021, and Execute Third Amendments to Term of the Professional Services Agreements with Efficiency Services Group, LLC, the Salvation Army, and Community Partnership for Families of San Joaquin to September 30, 2021; and Further Authorize FY 21 Appropriations and Expenditures to Carry Over into FY 22 MEETING DATE: June 16, 2021 PREPARED BY: Business Development Manager RECOMMENDED ACTION: Adopt a resolution authorizing the City Manager to extend the temporarily modified Customer Assistance & Relief Energy (CARE) Package Program term to September 30, 2021, and execute third amendments to term of the Professional Services Agreements with Efficiency Services Group, LLC, the Salvation Army, and Community Partnership for Families of San Joaquin to September 30, 2021; and further authorize FY 21 appropriations and expenditures to carry over into FY 22. BACKGROUND INFORMATION: Resolution No. 2020-121 approved by City Council on July 17, 2020 temporarily modified eligibility requirements to make additional emergency electric payment assistance available to Lodi Electric Utility customers to August 31, 2020, during COVID-19 mitigation. Resolution No. 2020-184 approved by the City Council on August 19, 2020 extended the modified CARE program to June 30, 2021. The modified program has increased participation by 200 percent from FY 20 to FY 21. However, the total assistance in FY 21 was lower than anticipated providing approximately $16,500 in utility assistance payments. Staff recommends extending the modified CARE program's eligibility requirements to supplement the American Debt Relief utility payments program currently being applied by the Department of Finance. It is important to note that CARE assistance payments can only be applied to the electric portion of the outstanding utility bill while American Debt Relief payments are applied to other utility services. The proposed resolution will also extend the terms of the third party administrators who currently administer this program including the Salvation Army, Community Partnership for Families, and Energy Services Group (ESG) from June 30, 2021 to September 30, 2021. New third -party administrator contracts will be brought to the City Council for approval before the September 30, 2021 expiration date with an effective date of October 1, 2021. FISCAL IMPACT: The additional assistance, including third party administrative costs was capped at $351,000 per Resolution 2020-121 and funds were appropriated in Fiscal Year 2020/21 This resolution will authorize the roll over and availability of funds to FY 2021/22. WITNESSETH: WHEREAS, CONTRACTOR was retained by the City to provide application administration services for the Lodi Electric Utility's Customer Assistance & Relief (CARE) Package program; and 2. WHEREAS, CONTRACTOR and CITY entered into a Professional Services Agreement on June 13, 2019, (the "Agreement"), the original of which is on file with the City Clerk's Office; and 3. WHEREAS, on June 3, 2020, CONTRACTOR and CITY executed Amendment No. 1 to expand the Contractor's scope of services as a third -party administrator of the Customer Assistance & Relief Energy (CARE) Package program (Amendment No. 1), the original of which is on file with the City Clerk's Office; and 4. WHEREAS, on August 19, 2020, CONTRACTOR and CITY executed Amendment No. 2 to expand the term of the Agreement as a third -party administrator of the Customer Assistance & Relief Energy (CARE) package program (Amendment No. 2), the original of which is on file with the City Clerk's Office; and 5. WHEREAS, the CARE program will be extended through September 30, 2021; and 4. WHEREAS, by approval of Resolution No. 2020-121, and Resolution No. 2020-184, Lodi City Council has authorized the City Manager to increase CARE Program third -party administrator contract limits by an indefinite amount each, however, collectively, not -to -exceed $102,000; and 6. WHEREAS, the Agreement, Amendment No. 1, and Amendment No. 2 are collectively referred to as the "Agreement" and by this reference are incorporated as if fully set forth herein. NOW, THEREFORE, the parties agree to amend the Agreement to extend the term of the Agreement to and including September 30, 2021. MAGDICH City Attorney RESOLUTION NO. 2021-183 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CITY MANAGER TO EXTEND TEMPORARILY -MODIFIED CUSTOMER ASSISTANCE & RELIEF ENERGY (CARE) PACKAGE PROGRAM TERM TO SEPTEMBER 30, 2021 AND TO EXECUTE THIRD AMENDMENTS TO TERM OF THE PROFESSIONAL SERVICES AGREEMENTS WITH EFFICIENCY SERVICES GROUP, LLC, THE SALVATION ARMY, AND COMMUNITY PARTNERSHIP FOR FAMILIES OF SAN JOAQUIN TO SEPTEMBER 30,2021; AND FURTHER AUTHORIZE FISCAL YEAR 2021 APPROPRIATIONS AND EXPENDITURES TO CARRY OVER INTO FISCAL YEAR 2022 WHEREAS, by Resolution No. 2020-121, the Lodi City Council temporarily modified eligibility requirements to make additional emergency electric payment assistance available to Lodi Electric Utility (LEU) customers to August 31, 2020, during COVID-19 mitigation; and WHEREAS, by Resolution No. 2020-184, participation in the temporarily -modified program was extended to June 30, 2021; and WHEREAS, the City of Lodi, located within San Joaquin County, is continuing its efforts to protect, promote, and improve the health and well-being of its citizens and has identified the extension of the CARE Program as a necessary component of this effort; and WHEREAS, staff recommends extending the temporarily -modified CARE Program until September 30, 2021; and WHEREAS, the CARE assistance authorized to be applied to outstanding utility bills will only be applied to the electric portion of the utility bill; and WHEREAS, sufficient funding in the amount of $351,000 was authorized by Resolution No. 2020-184 to extend the temporarily -modified CARE Program, including third party administrative costs and will roll and be available in Fiscal Year 2021/2022 for said extension. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to extend the temporarily -modified Customer Assistance & Relief Energy (CARE) Package Program term to September 30, 2021; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute Third Amendments to term of the Professional Services Agreements with Efficiency Services Group, LLC, the Salvation Army, and Community Partnerships for Families of San Joaquin; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the carryover of appropriations from the Public Benefits Fund (50465300.72450 and 50465300.72921) from FY 21 to FY 22; and BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
