Adopt resolution confirming a separate Police Executive Management Agreement with an additional nine percent (9%) employee cost-sharing pursuant to Government Code Section 20516 (employees sharing additional cost), for a total employee cost-sharing of eighteen percent (18%) BACKGROUND INFORMATION: Pursuant to Resolution 2018-214 and 2019-157, the Police Chief agreed to a cost sharing agreement of three percent (3%) and six percent (6%) respectively; whereby, the employee agreed to contribute to the City's normal contribution to CalPERS, in addition to the nine percent (9%) employee's normal contribution, for a total contribution of eighteen percent (18%). The Police Chiefs cost-sharing agreement is in alignment with the cost-sharing agreements with the Police Officer's Association of Lodi (POAL) and the Lodi Police Mid -Manager's Association (LPMMA). Prior to October 2019, the Police Chief and the Fire Chief had the same cost-sharing contribution and were in the same CalPERS unit for contribution and payroll reporting purposes. Resolution 2019-157 did not include additional cost-sharing for the Fire Chief; as such, CalPERS requires separate contribution units, one for the Police Chief and one for the Fire Chief based on their different cost-sharing agreements. The City will submit an amendment to the CalPERS contract, upon adoption of this resolution, in order to create a new unit for Police Executive Management (Police Chief) and a new unit for Fire Executive Management (Fire Chief). This will allow Police Executive Management to have a separate cost-sharing amount from all other Executive Management employees, including the Fire Chief. FISCAL IMPACT: No fiscal impact. FUNDING AVAILABLE: No additional funding needed - Adele Post, Human Resources Manager lJ 1 Andrew Keys, Deputy City Manager Attachment — Resolutions 2018-214 and 2019-157 APPROVED: ep en Schwa y Manager RESOLUTION NO. 2018-214 A RESOLUTION OF THE LODI CITY COUNCIL APPROVING COMPENSATION AND BENEFIT MODIFICATIONS TO THE EXECUTIVE MANAGEMENT (EXCLUDING COUNCIL APPOINTEES) EMPLOYEE CONTRACTS EFFECTIVE JANUARY 1, 2018 THROUGH DECEMBER 31, 2019 WHEREAS, the City has completed negotiations with all Mid -Management bargaining units; and WHEREAS, Council approved modifications to compensation and benefits provided to the Mid -Management bargaining units; and WHEREAS, it is recommended that Council approve the following compensation and benefit modifications to the Executive Management (excluding Council Appointees) employee contracts, similar to modifications provided to the Mid -Managers: • Increase to the City's maximum contribution to healthcare premiums by 5%. ■ Amend the Flexible 125 plan to provide for carryover of contributions. • Special bank of 80 hours of non-cashable leave to be used by December 31, 2019. • Three percent (3%) salary adjustment for a three percent (3%) employee contribution (cost- sharing) of the employer's normal contribution toward CalPERS, pursuant to Government Code Section 20516. WHEREAS, staff recommends the above amendments for the Deputy City Manager; Electric Utility Director; Fire Chief; Library Director; Parks, Recreation and Cultural Services Director; Police Chief; and Public Works Director. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby approve compensation and benefit modifications to Executive Management (excluding Council Appointees) employee contracts. Date: November 7, 2018 ----------------------------------------------------------------------- ----------------------------------------------------------------------- I hereby certify that Resolution No. 2018-214 was passed and adopted by the Lodi City Council in a regular meeting held November 7, 2018, by the following vote: AYES: COUNCIL MEMBERS — Chandler, Johnson, Kuehne, and Mayor Nakanishi NOES: COUNCIL MEMBERS — None ABSENT: COUNCIL MEMBERS — Mounce ABSTAIN: COUNCIL MEMBERS — None VNII E R FERRAIOLO City Clerk 2018-214 RESOLUTION NO. 2019-157 A RESOLUTION OF THE LODI CITY COUNCIL APPROVING COMPENSATION AND BENEFIT MODIFICATIONS TO THE FIRE CHIEF AND POLICE CHIEF'S EMPLOYMENT CONTRACTS WHEREAS, the City has completed negotiations with the Fire and Police Mid -Management bargaining units that include increases to compensation and amendments to benefits for the Fire and Police Mid -Managers; and WHEREAS, it is recommended that Council approve the following compensation and benefit modifications to the Fire Chief and Police Chief's employment contracts, consistent with what was provided to their Mid -Managers: Fire Chief: • 4.25 percent salary adjustment, effective August 12, 2019; • 3 percent salary adjustment, effective the first full pay period in July 2020; and • 3 percent salary adjustment, effective the first full pay period in July 2021. Police Chief: • 4.3 percent salary adjustment, effective August 12, 2019; • 6 percent salary adjustment, effective October 21, 2019; • 4 percent salary adjustment, effective the first full pay period in January 2020; • 3 percent salary adjustment effective the first full pay period in July 2020; • 3 percent salary adjustment effective the first full pay period in July 2021; and • 6 percent cost sharing participation in the City's Normal Cost contribution to CalPERS, effective October 21, 2019, in addition to cost sharing already in place, for a total of 18 percent. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby approve compensation and benefit modifications to the Fire Chief and the Police Chief's employment contracts, as set forth above. Date: August 7, 2019 ------------------------------------------------------------------------ ------------------------------------------------------------------------ I hereby certify that Resolution No. 2019-157 was passed and adopted by the Lodi City Council in a regular meeting held August 7, 2019, by the following vote: AYES: COUNCIL MEMBERS — Johnson, Kuehne, Nakanishi, and Mayor Chandler NOES: COUNCIL MEMBERS — None ABSENT: COUNCIL MEMBERS — Mounce ABSTAIN: COUNCIL MEMBERS — None j��NIF�ER.ERRAIOLO City Clerk 2019-157 RESOLUTION NO. 2021-182 A RESOLUTION OF THE LODI CITY COUNCIL CONFIRMING A SEPARATE UNREPRESENTED POLICE EXECUTIVE MANAGEMENT AGREEMENT THAT INCLUDES A NINE PERCENT (9%) EMPLOYEE COST-SHARING PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION §20516 ----------------------------------------------------------------------- ----------------------------------------------------------------------- WHEREAS, pursuant to Resolution No. 2018-214 and No. 2019-157, and in accordance with California Government Code §20516, the Police Chief shall pay three percent (3%) and six percent (6%) respectively, towards the employer's share of CalPERS normal pension cost (cost-sharing), in addition to the employee's normal contribution for both Classic and PEPRA; and WHEREAS, CaIPERS requires a separate contribution unit for the Police Chief based on the different cost-sharing agreement; and WHEREAS, the City of Lodi will submit an amendment to the CalPERS contract that will create a new contribution unit for unrepresented Police Executive Management; and WHEREAS, unrepresented Police Executive Management agree to a separate cost- sharing amount from all other Executive Management employees. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby approve the separate cost-sharing agreement for unrepresented Police Executive Management.
