RECOMMENDED ACTION: Conduct a public hearing to consider adoption of a resolution to
vacate a 16.5 -foot public utility easement located at 2500, 2505,
2506 Mayfair Court and Lot A, Gateway North Unit 1, Tract 3940.
BACKGROUND INFORMATION: At its regular meeting on April 21, 2021, the Council adopted a
resolution of intention to vacate a 16.5 -foot public utility easement
located at 2500, 2505, 2506 Mayfair Court and Lot A,
Gateway North Unit 1, Tract 3940. Posting, publishing and mailing notices have been accomplished.
In 2005, the public utility easement was dedicated, as shown on Exhibit A, for overhead Pacific Gas &
Electric utilities and future City of Lodi Electrical overhead utilities. As part of the public improvements of
the Gateway Unit No. 1 project, the existing overhead utilities were either removed or moved and
undergrounded to the public right-of-way. The 16.5 -foot public utility easement is no longer needed. The
proposed easement vacation is requested by Tom Schulz, on behalf of FCB Homes, owner/developer of
the above mentioned parcels.
The Community Development Director discussed the proposed abandonments with the applicants
through their design approval process. The Planning Department has no issue with the abandonment.
The City of Lodi Electric Utility Department, City of Lodi Water/Wastewater and Street Divisions, AT&T,
Pacific Gas & Electric, and Comcast have approved the public utility easement abandonment without
further comment or conditions.
Staff recommends that the request to vacate the 16.5 -foot public utility easement located at 2500, 2505,
2506 Mayfair Court and Lot A, Gateway North Unit 1, Tract 3940, be granted.

Records, lying within the boundary lines of Lots 27, 28, 29 and Lot "A" as shown on that certain
map entitled `Tract No. 3940, Gateway North, Unit No. 1", filed for record July 22, 2019, in Book 43
of Maps and Plats, Page 96, San Joaquin County Records, situate in the City of Lodi, San Joaquin
County, State of California, lying within the north half of the northwest quarter of Section 15,
Township 3 North, Range 6 East, Mount Diablo Base and Meridian. A plat (EXHIBIT "B") showing
the above described area is attached hereto and made a part thereof.

A RESOLUTION OF THE LODI CITY COUNCIL VACATING
EXISTING 16.5 -FOOT PUBLIC UTILITY EASEMENT LOCATED
AT 2500, 2505, AND 2506 MAYFAIR COURT AND LOT A,
GATEWAY NORTH UNIT NO. 1, TRACT 3940
WHEREAS, the proposed easement vacation is requested by Tom Schulz, on behalf of
FCB Homes, owner/developer of the above-mentioned parcels; and
WHEREAS, as part of the public improvements of the Gateway North Unit No. 1 project,
the existing overhead utilities were either removed or moved and undergrounded to the public
right-of-way; and
WHEREAS, staff recommends vacating existing 16.5 -foot public utility easement located
at 2500, 2505, and 2506 Mayfair Court and Lot A, Gateway North Unit 1, Tract 3940.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby vacate
existing 16.5 -foot public utility easement located at 2500, 2505, and 2506 Mayfair Court and
Lot A, Gateway North Unit 1, Tract 3940; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to
the above -referenced document(s) that do not alter the compensation or term, and to make
clerical corrections as necessary.

NOTICE IS HEREBY GIVEN that on Wednesday, June 2, 2021, at the hour of
7:00 p.m., or as soon thereafter as the matter may be heard, the City Council will
conduct a public hearing at the Carnegie Forum, 305 West Pine Street, Lodi, to consider
the following item:
a) A resolution vacating existing 16.5 -foot Public Utility Easement
located at 2500, 2505, and 2506 Mayfair Court and Lot A, Gateway
North Unit 1, Tract 3940.
While social distancing measures are imposed due to COVID-19, Council chambers are
closed to the public during meetings of the City Council. Members of the public may
