Relating to Truck Parking in the City Limits

RECOMMENDED ACTION: That the City Council extend the sunset date allowing limited on -street truck
parking by approving the introduction of an ordinance amending Title 10 -
Vehicles and Traffic, by repealing and reenacting Section 10.52.050(B),
"Parking Restrictions", to the Lodi Municipal Code (LMC) relating to truck
parking in the city limits, as shown on Exhibit A.
BACKGROUND INFORMATION: The current LMC section regulating truck parking in the city limits will
expire on January 1, 2001. After that date, on -street truck parking
will not be permitted unless the truck is in the process of being
loaded or unloaded. The locations where truck parking is currently
permitted and descriptions of the LMC sections regulating truck parking are shown on Exhibit B. The
following report provides a review of current restrictions and alternatives.
The reason an expiration date was placed on the adopted truck -parking ordinance was to encourage the
development of a private parking lot within the City limits. Although initially there were some inquires,
there are no parties actively pursuing constructing a lot. It is possible that those interested in the past
may have felt the parking lot business was not economically feasible.
Our surveys of truck parking in the allowable areas observed an average of about 15 parked trucks.
This is less than 20% usage given that over 100 truck/trailer units can be accommodated in the signed
areas. Up to 15 parked trucks have also been observed on a regular basis on West Lane south of
Harney Lane. This area is regulated by San Joaquin County and we understand the County is
considering prohibiting truck parking for safety and maintenance reasons. These displaced trucks will
likely move to areas within the Lodi city limits or nearby County roads.
Since the last modification to truck parking regulations, we have received no complaints from businesses
in the allowable parking areas until recently. Two businesses on South Guild Avenue have complained
about parked trucks creating visibility problems from streets and driveways, as well as blocking the view
of their facilities. The great majority, if not all, of the trucks parked are waiting to enter another business
in the area. We have contacted the business in an effort to resolve this matter. We also can modify the
parking restrictions in this area to address the problem.
DISCUSSION: This issue has been discussed in depth at previous meetings. The below -described
alternative actions are provided for consideration:
The alternatives are: 1) to extend the expiration date and allow truck parking to continue for one
additional year; 2) two additional years; or 3) take no action. Extending the expiration date will not
guarantee that a private party will develop a truck lot, as there may not be the originally -predicted

demand. However, it will allow us to evaluate the effect of parking restrictions imposed by the County
and the Flying J Truck Stop project, located at Highway 12 and Interstate 5, currently in the County's
building permit review stage.
Taking no action will result in expiration of the LMC section and truck parking in the city limits will not be
permitted unless the truck is in the process of being loaded or unloaded. Compliance enforcement by
City police will increase to direct trucks to unrestricted county areas or truck parking facilities. Generally,
truck parking facilities only permit overnight parking.
RECOMMENDATION: Due to the apparent lack of private -sector interest to develop a truck parking lot,
staff recommends extending the expiration date to January 1, 2003. The current restriction allowing
trucks to park in designated industrial areas provides a successful compromise between truck drivers
and the community. Staff will also modify the allowable parking areas based on complaints received
from businesses, which requires no Council action as a LMC section does not apply.
FUNDING: Funding to remove and modify signs from the Street Maintenance Account at an
approximate cost of $500.

10.52.050 Parking restrictions.
A. It is unlawful to park a commercial vehicle exceeding a maximum gross
vehicle weight rating (GVWR) of ten thousand pounds on any street in a
residential district. For the purposes of this section, "residential district"
means residentially zoned areas designated by the city zoning code
(any "R" district) and includes schools, parks, playgrounds, community
centers, churches, museums, golf courses (excluding miniature golf
courses) and similar recreational uses of a noncommercial nature, and
public utility service buildings where they are located in a residential
district.
B. It is unlawful to park a commercial vehicle exceeding a maximum gross
vehicle weight rating (GVWR) of ten thousand pounds on any street in a
commercial or industrial zone except where specifically signed to allow
commercial vehicle parking between the hours of seven p.m. and seven
a.m. unless otherwise indicated. This subsection B shall remain in effect

C. It is unlawful to park a commercial vehicle exceeding a maximum gross
vehicle weight rating (GWR) of ten thousand pounds on any street in a
commercial or industrial zone.
D. This section shall not prohibit parking of commercial vehicles in the

The City of Lodi regulates truck parking on public streets
under Lodi Municipal Code Section 10.52.050. Per this
section, trucks exceeding a maximum gross vehicle
weight rating of 10,000 pounds can park only in signed
areas. Parking in some areas is allowed only between the
hours of 7 p.m. and 7 a.m., with all day parking allowed in
other areas. Truck parking on all other streets is
prohibited unless the vehicle is in the process of being
loaded or unloaded.

IMPORTANT NOTICE
Truck parking on the streets shown on this map will be
permitted until January 1, 2001. After January 1, 2001,
truck parking on public property will not be permitted
within the city limits of Lodi except while in the process of
being loaded or unloaded.
PRIVATE PROPERTY
The City of Lodi also regulates truck parking on private
property in residential zones under Lodi Municipal Code
Section 17.57.190. This section prohibits the parking of
vehicles which are strictly commercial in nature and have
a gross load capacity of one and one-half tons. The types
of vehicles include but are not limited to tow trucks,
ambulances, mini -buses, large delivery and/or service
trucks. Vehicles placed out of public view and located
behind the designated front setback line or in the process
of loading or unloading goods or people are exempt from
this restriction.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODI
AMENDING TITLE 10 — VEHICLES AND TRAFFIC BY REPEALING
AND REENACTING SECTION 10.52.050-(B) "PARKING
RESTRICTIONS," TO THE LODI MUNICIPAL CODE RELATING TO
TRUCK PARKING
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS:
SECTION 1. Title 10, Section 10.52.050-(B) "Parking Restrictions" of the Lodi
Municipal Code is hereby repealed and reenacted to read as follows:
10.52.050 Parking restrictions.
A. It is unlawful to park a commercial vehicle exceeding a maximum
gross vehicle weight rating (GVWR) of ten thousand pounds on any street
in a commercial or industrial zone except where specifically signed to
allow commercial vehicle parking between the hours of seven p.m. and
seven a.m. unless otherwise indicated. This subsection B shall remain in
effect until January 1, 2003, or until a private parking lot is developed or
located in or near the city limits, at which time subsection C of this section
shall become effective.
SECTION 2. All ordinances and parts of ordinances in conflict herewith are repealed
insofar as such conflict may exist.
SECTION 3. No Mandatory Duty of Care. This ordinance is not intended to and shall
not be construed or given effect in a manner which imposes upon the City, or any officer
or employee thereof, a mandatory duty of care towards persons or property within the
City or outside of the City so as to provide a basis of civil liability for damages, except as
otherwise imposed by law.
SECTION 4. Severability. If any provision of this ordinance or the application thereof
to any person or circumstances is held invalid, such invalidity shall not affect other
provisions or applications of the ordinance which can be given effect without the invalid
provision or application. To this end, the provisions of this ordinance are severable. The
City Council hereby declares that it would have adopted this ordinance irrespective of
the invalidity of any particular portion thereof.
SECTION 5. This ordinance shall be published one time in the "Lodi News Sentinel', a
daily newspaper of general circulation printed and published in the City of Lodi and shall
take effect thirty days from and after its passage and approval.
