RECOMMENDED ACTION: Adopt resolution authorizing City Manager to execute change orders
to Central Plume PCE/TCE Groundwater and Soil Vapor Extraction
System Decommissioning and Removal Project, in an amount not to
exceed $150,000, appropriating funds in the amount of $150,000, and authorizing City Manager to
execute any necessary agreements with adjacent property owners.
BACKGROUND INFORMATION: On August 19, 2020, Council approved specifications and authorized
advertisement for bids for Central Plume PCE/TCE Groundwater
and Soil Vapor Extraction System Decommissioning and Removal
Project and awarded the Contract to A.M. Stephens Construction Co., Inc., of Lodi, in the amount of
$601,714, on January 6, 2021.
This project consists of decommissioning the Soil Vapor Extraction and the groundwater extraction and
treatment systems located near the alleyway between Pine and Oak Streets, and Pleasant Avenue and
Church Street, as shown on Exhibit A.
The Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System Decommissioning and
Removal Project encompasses a number of different wells in the area that all feed into the central
extraction/capture unit. There are existing use agreements between the City and adjacent property
owners that were executed to allow construction of the initial extraction pilot program. Upon
decommissioning and removal of the extraction systems, the City is required to remove the wells and all
of the underground piping on the private property and replace any damage caused by the removal.
During pre -construction efforts for the current project, and subsequent to Council awarding the project,
Staff identified additional wells (and accessory utilities) inside the project limits that were part of the initial
extraction pilot program. These items should have been removed when that system was replaced, and
now must be included in this scope of work. Removing the pilot system well and utility equipment will
further damage adjacent, privately owned parking lots requiring pavement repairs. Staff recommends the
additional change order authority and appropriation to accommodate these additional pavement repairs
on the adjacent private property, as well as, any unforeseen conditions that may arise while complying
with the terms of the existing use agreements.
The scope of the decommissioning project requires that the excavated soil to be temporarily stored onsite

(during the testing period). The City will need to enter into an agreement with the adjacent property
owner in order to utilize their parking lot for the temporary storage. Other items, such as the limits of the
pavement replacement and the utility removals may be negotiated in the agreement(s).
Council previously authorized the City Manager to execute change orders in an amount not to exceed
$80,000. This Council action, if approved, would authorize the City Manager to execute change orders in
an amount not to exceed $150,000, for a total authorization of $230,000.
Staff recommends authorizing City Manager to execute change orders to Central Plume PCE/TCE
Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project, in an amount not
to exceed $150,000, appropriating funds in the amount of $150,000, and authorizing City Manager to
execute any necessary agreements with adjacent property owners.
FISCAL IMPACT: Annual operation and maintenance costs will decrease as a result of system
removal. This project will not impact the General Fund.

This project will provide funding
for the decommissioning of the City owned and contractor operated soil/vapor and groundwater extraction (SVE) system located at the Central Plume
Source Area (CPSA). The CPSA is defined as the area bounded by Pine Street and Oak Street to the north and south, respectively, and by Pleasant Avenue and Church Street to the
west and east, respectively.
Justification/factor driving project
The current SVE system has
been in operation since April 2011 and has successfully removed over 2,400 pounds of tetrachloroethene (PCE), in addition to trichloroethene (TCE)
another known groundwater contaminant. Decommissioning the SVE system would reduce the operation and maintenance costs by an estimated $150,000 annually.

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO EXECUTE CHANGE ORDERS TO THE
CENTRAL PLUME PCE/TCE GROUNDWATER AND SOIL VAPOR
EXTRACTION SYSTEM DECOMMISSIONING AND REMOVAL
PROJECT; APPROPRAITING FUNDS; AND AUTHORIZING THE
CITY MANAGER TO EXECUTE ANY NECESSARY AGREEMENTS
WITH ADJACENT PROPERTY OWNERS
WHEREAS, on August 19, 2020, Council approved specifications and authorized
advertisement for bids for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction
System Decommissioning and Removal Project; and
WHERAS, on October 21, 2020, Council rejected all bids, approved specifications,
authorized re -advertisement for bids, authorized the City Manager to award the contract to the
lowest responsive bidder for the Central Plume PCE/TCE Groundwater and Soil Vapor
Extraction System Decommissioning and Removal Project, in an amount not to exceed
$600,000, and authorized the City Manager to execute change orders in an amount not to
exceed $80,000; and
WHEREAS, because the lowest responsive bid, provided by A.M. Stephens
Construction Co., Inc., of Lodi, was $601,713.90, which was $1,713.90 over the authorized
amount, on January 6, 2021, Council awarded the contract for the Central Plume PCE/TCE
Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project to
A.M. Stephens Construction Co., Inc., of Lodi, in the amount of $601,714; and
WHEREAS, during pre -construction efforts for the current project, and subsequent to
Council awarding the project, staff identified additional wells (and accessory utilities) inside the
project limits that were part of the initial extraction pilot program and should have been removed
when that system was replaced, and which now must be included in this scope of work; and
WHEREAS, staff recommends authorizing the City Manager to execute change orders
to the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System
Decommissioning and Removal Project, in an additional amount not to exceed $150,000; and
WHEREAS, staff also recommends that the City Council appropriate funds in the
amount of $150,000, from the fund balance of Central Plume Settlement Funds
(59099000.77020) for Fiscal Year 2020/21; and
WHERAS, staff also recommends authorizing the City Manager to execute any
necessary agreements with adjacent property owners.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to execute change orders to the Central Plume PCE/TCE
Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project, in an
additional amount not to exceed $150,000; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize an
appropriation for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System
Decommissioning and Removal Project in the amount of $150,000, as set forth above
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
