A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO EXECUTE CHANGE ORDERS TO THE
CENTRAL PLUME PCE/TCE GROUNDWATER AND SOIL VAPOR
EXTRACTION SYSTEM DECOMMISSIONING AND REMOVAL
PROJECT; APPROPRAITING FUNDS; AND AUTHORIZING THE
CITY MANAGER TO EXECUTE ANY NECESSARY AGREEMENTS
WITH ADJACENT PROPERTY OWNERS
WHEREAS, on August 19, 2020, Council approved specifications and authorized
advertisement for bids for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction
System Decommissioning and Removal Project; and
WHERAS, on October 21, 2020, Council rejected all bids, approved specifications,
authorized re -advertisement for bids, authorized the City Manager to award the contract to the
lowest responsive bidder for the Central Plume PCE/TCE Groundwater and Soil Vapor
Extraction System Decommissioning and Removal Project, in an amount not to exceed
$600,000, and authorized the City Manager to execute change orders in an amount not to
exceed $80,000; and
WHEREAS, because the lowest responsive bid, provided by A.M. Stephens
Construction Co., Inc., of Lodi, was $601,713.90, which was $1,713.90 over the authorized
amount, on January 6, 2021, Council awarded the contract for the Central Plume PCE/TCE
Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project to
A.M. Stephens Construction Co., Inc., of Lodi, in the amount of $601,714; and
WHEREAS, during pre -construction efforts for the current project, and subsequent to
Council awarding the project, staff identified additional wells (and accessory utilities) inside the
project limits that were part of the initial extraction pilot program and should have been removed
when that system was replaced, and which now must be included in this scope of work; and
WHEREAS, staff recommends authorizing the City Manager to execute change orders
to the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System
Decommissioning and Removal Project, in an additional amount not to exceed $150,000; and
WHEREAS, staff also recommends that the City Council appropriate funds in the
amount of $150,000, from the fund balance of Central Plume Settlement Funds
(59099000.77020) for Fiscal Year 2020/21; and
WHERAS, staff also recommends authorizing the City Manager to execute any
necessary agreements with adjacent property owners.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to execute change orders to the Central Plume PCE/TCE
Groundwater and Soil Vapor Extraction System Decommissioning and Removal Project, in an
additional amount not to exceed $150,000; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize an
appropriation for the Central Plume PCE/TCE Groundwater and Soil Vapor Extraction System
Decommissioning and Removal Project in the amount of $150,000, as set forth above
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
