AGENDA TITLE: Public Hearing to Consider Adopting a Resolution Approving Amendment No. 1
to the Permanent Local Housing Allocation (PLHA) Program

RECOMMENDED ACTION: Adopt a resolution approving Amendment No. 1 to the
Permanent Local Housing Allocation (PLHA) Program.
BACKGROUND INFORMATION: A public hearing is required under the California Department of
Housing and Community Development (HCD) Permanent Local
Housing Allocation (PLHA) Program when the reallocation of
funds to a different eligible activity exceeds 10 percent.
In 2017 Governor Jerry Brown signed a package of housing bills aimed at addressing California's
housing shortage and high housing costs. This legislation package included Senate Bill (SB) 2,
the Building Homes and Jobs Act, which established a $75 recording fee on real estate documents to
increase the supply of affordable homes in California and to address other urgent housing issues.
Under SB 2 the revenue from these recording fees is deposited into the established Building Homes
and Jobs Trust Fund. Beginning in 2019 seventy (70) percent of the monies collected and deposited
into this fund are allocated to the Permanent Local Housing Allocation (PLHA) program to support
locally administered affordable housing.
As required by HCD, staff prepared a PLHA plan that outlined the anticipated project costs and
schedule over the five-year period. The original plan submission designated support for
predevelopment of a permanent homeless navigation center in Lodi. The requested amendment
would allow the first-year allocation to be redirected towards the support of the construction and
development of the Harmony Homes Project which location was approved on December 2, 2020 by
City Council. The City's Harmony Home project will create four units of permanent housing for
homeless individuals and families or those at risk of homelessness. This supportive housing will help
at -risk individuals/families move into long-term, affordable housing where they can continue their
progress toward stable and independent living.
FUNDING ALLOCATION:
On October 23, 2020, the City of Lodi received a first-year award amount of $336,265 in PLHA funds
of the estimated $2,017,590 available over the five-year plan period.
NEXT STEPS:
If approved, staff will submit Amendment No. 1 to the PLHA Program to HCD.
FISCAL IMPACT There is no fiscal impact, since there is no obligated City match for this
grant program.

§302(c)(4)(A) Describe the manner in which allocated funds will be used for eligible activities.
Emergency Shelter: PLHA funds will be used for capital costs for a permanent emergency homeless shelter, including predevelopment, infrastructure and site improvements.
Permanent Supportive Housing: PLHA funds will also be used for capital costs for development and construction of four units of permanent supportive housing for homeless individuals
and families or those at risk of homelessness.
§302(c)(4)(B) Provide a description of the way the Local government will prioritize investments that increase the supply of housing for households with incomes at or below 60 percent
of Area Median Income (AMI).
Lodi does not currently have a permanent shelter for people experiencing homelessness. The Lodi Committee on Homelessness, in collaboration with several local and regional
homeless experts, has determined that a low -bar shelter with supportive services is critical to assisting the city's unsheltered homeless population The proposed emergency shelter
facility will provide temporary emergency shelter for individuals and families that are typically at or below 30 percent of Area Median Income. The emergency shelter will serve as an
Interim step in assisting the unsheltered homeless population in securing long-term housing.
The construction of additional permanent supportive housing in Lodi will allow individuals and families to transition from homelessless to stability. In doing so, the supportive housing
units will also free up emergency shelter beds for people experiencing homelessness.
§302(c)(4)(C) Provide a description of how the Plan is consistent with the programs set forth in the Local Government's Housing Element.
Program 4.3 of the City of Lodi's Housing Element (2014-2023) is to "Pursue Regional Solutions to Homeless Needs." This implementation program calls on the City to collaborate with
nonprofit service organizations in the region to support and implement solutions to homelessness. The City has created an interagency Lodi Committee on Homelessness (LCOH), and
City staff participates with community groups and service organizations in the San Joaquin Continuum of Care (SJCoC), a regional program promoting community -wide action to end
homelessness. These efforts focus on leveraging partnerships to create effective solutions to homelessness, and the goal to establish a permanent emergency shelter for homeless
individuals and families in Lodi has been identified as one of the top priorities of both the LCOH and the SJCoC. Construction and operation of a shelter is one of the most immediate
and concrete actions the City can take in implementing Program 4.3 of the Housing Element to address homelessness. The development of permanent supportive housing will also
address Program 4.3 of the Housing Element. In addition to the development of emergency faciliites, permanent supportive housing is key to addressing homelessness.

PLHA funds will be used to support predevelopment, infrastructure and site improvements for a permanent homeless shelter. Specific activities may include: identifying a site,
preliminary environmental studies, business and operational plan, conceptual design, site layout, site and facility improvement plans, cost estimates, development schedule,
entitlements, construction documents, contractor bid and selection process, site preparation and infrastructure improvements and maintenance/operations. PLHA funds will also be
used for four units of permanent supportive housing. Specific activites may include: site preparation, infrastructure improvement, and construction activities.

A RESOLUTION OF THE LODI CITY COUNCIL APPROVING
AMENDMENT NO. 1 TO THE PERMANENT LOCAL HOUSING
ALLOCATION (PLHA) PROGRAM
WHEREAS, the California Department of Housing and Community Development (the
"Department") was authorized to provide up to $195 million under the SB 2 Permanent Local
Housing Allocation Program Formula Component from the Building Homes and Jobs Trust Fund
for assistance to Cities and Counties (as described in Health and Safety Code section 50470 et
seq. (Chapter 364, Statutes of 2017 (SB 2)); and
WHEREAS, the Department issued a Notice of Funding Availability ("NOFA") dated
February 26, 2020 under the Permanent Local Housing Allocation (PLHA) Program; and
WHEREAS, the City of Lodi ("Applicant') was an eligible Local government applying for
the program to administer one or more eligible activities, or a Local or Regional Housing Trust
Fund to whom an eligible Local government delegated its PLHA formula allocation; and
WHEREAS, the Applicant applied for funding under the PLHA Program on July 30, 2020
and was awarded funds by the Department on October 23, 2020; and
WHEREAS, the Applicant's PLHA application outlined that PLHA funds would be used to
fund the predevelopment costs of a permanent navigation center that will assist individuals that
are homeless or at risk of homelessness for each annual allocation of the five-year PLHA
Program; and
WHEREAS, an amendment to the PLHA Program is required when a reallocation to a
different eligible activity exceeds 10 percent; and
WHEREAS, Amendment No. 1 to the PLHA Program would reallocate the Applicant's first-
year PLHA allocation to the construction and development of the Harmony Homes project, which
would create four units of permanent supportive housing for homeless individuals and families or
those at risk of homelessness; and
WHEREAS, notice of the January 6, 2021 public hearing on the draft Amendment No. 1
to the PLHA Program was published on the City of Lodi website on December 22, 2020; and
WHEREAS, draft Amendment No. 1 to the PLHA Program was made available for public
review and comment for a period of at least seven days, commencing no later than
December 30, 2020, and continuing through the date of the public hearing before the Lodi City
Council on January 6, 2021.
NOW THEREFORE BE IT RESOLVED BY THE LODI CITY COUNCIL THAT:
1. If Department approves the above reference Amendment, Applicant certifies that it will use
all such funds in a manner consistent and in compliance with all applicable state and federal
statutes, rules, regulations, and laws, including without limitation all rules and laws regarding
the PLHA Program, as well as any and all contracts Applicant may have with the Department.
2. Applicant hereby agrees to use the PLHA funds for eligible activities as approved by the
Department and in accordance with all Program requirements, Guidelines, other rules and
laws, as well as in a manner consistent and in compliance with the Standard Agreement and
other contracts between the Applicant and the Department.
3. Pursuant to Applicant's certification in this resolution, the PLHA funds will be expended only
for eligible Activities and consistent with all program requirements.
4. Applicant certifies that, if funds are used for the development of an Affordable Rental Housing
Development, the Local government shall make PLHA assistance in the form of a low-
interest, deferred loan to the Sponsor of the Project, and such loan shall be evidenced through
a Promissory Note secured by a Deed of Trust and a Regulatory Agreement shall restrict
occupancy and rents in accordance with a Local government -approved underwriting of the
Project for a term of at least 55 years. The City will retain ownership of the Harmony Homes
site through a land lease agreement.
5. Applicant shall be subject to the terms and conditions as specified in the Standard Agreement,
the PLHA Program Guidelines and any other applicable SB 2 Guidelines published by the
Department.
6. Stephen Schwabauer, City Manager, is authorized to execute the PLHA Program Application,
the PLHA Standard Agreement and any subsequent amendments or modifications thereto,
aswell as any other documents which are related to the Program or the PLHA grant awarded
to Applicant, as the Department may deem appropriate.
