RECOMMENDED ACTION: Adopt resolution accepting Vineyard Terrace Subdivision, Unit No.
2, Tract No. 4011, public improvements; and authorizing
reimbursement in the amount of $4,950.
BACKGROUND INFORMATION: Vineyard Terrace Subdivision, Unit No. 2, is the second and final
phase of the multi -phase residential development located east of
Lower Sacramento Road and north of Century Boulevard, as shown
on Exhibit A. Unit No. 2 consists of 114 single-family, residential lots.
The project includes the installation of all interior subdivision public improvements and street widening
improvements on Lower Sacramento Road, from Henri Lane to the existing improvements at Sunwest
Plaza intersection.
A total 0.7 miles of new interior City streets is to be accepted with this subdivision. The developer, K.
Hovnanian CA Land Holdings, LLC, has furnished the two-year warranty bond for the improvements.
The developer, at the City's request, constructed certain off-site street improvements on the east side of
Lower Sacramento Road to complete the curb, gutter, sidewalk, and pavement improvements, from the
north project boundary to the Sunwest Plaza intersection (Food 4 Less shopping center). The work also
includes the acquisition of addition street easements and some miscellaneous improvements along the
properties at 1606, 1610, and 1626 South Lower Sacramento Road.
During the construction of these off-site improvements, it was discovered that the existing wastewater
manhole in Lower Sacramento Road was not completed when the original roadway was built in the early
2000's. This situation required additional work in the manhole to complete the connection of the new
wastewater service to 1606 South Lower Sacramento Road. The cost of the work is determined to be
$4,950. The developer completed the additional work for the City and is requesting reimbursement for
the extra work.
Staff recommends accepting Vineyard Terrace Subdivision, Unit No. 2, Tract No. 4011, public
improvements; and authorizing reimbursement in the amount of $4,950.
FISCAL IMPACT: There will be an increase in long-term maintenance costs for public
infrastructure and City services, such as police, fire, and parks. This cost
will be partially offset by proceeds from the Community Facilities District
No. 2007-1.

RESOLUTION NO. 2020-296
A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING
VINEYARD TERRACE SUBDIVISION, UNIT NO. 2,
TRACT NO. 4011, PUBLIC IMPROVEMENTS; AND
FURTHER AUTHORIZING REIMBURSEMENT
WHEREAS, the Vineyard Terrace Subdivision, Unit No. 2, is the second and final
phase of the multi -phase residential development located east of Lower Sacramento
Road and north of Century Boulevard; and
WHEREAS, Unit No. 2 consists of 114 single-family residential lots; and
WHEREAS, a total 0.7 miles of new interior City streets is to be accepted with
this subdivision; and
WHEREAS, the developer, at the City's request, constructed certain off-site
street improvements on the east side of Lower Sacramento Road to complete the curb,
gutter, sidewalk, and pavement improvements, from the north project boundary to the
Sunwest Plaza intersection (Food 4 Less shopping center); and
WHEREAS, the work also includes the acquisition of addition street easements

WHEREAS, the public improvements have been completed in substantial
conformance with City policy and other requirements of City codes have been met and
the developer has provided the required maintenance bond; and
WHEREAS, staff recommends accepting Vineyard Terrace Subdivision, Unit
No. 2, Tract No. 4011, public improvements; and
WHEREAS, staff also recommends authorizing reimbursement in the amount of
$4,950.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
accept Vineyard Terrace Subdivision, Unit No. 2, Tract No. 4011, public improvements;
and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize
reimbursement in the amount of $4,950; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council
Protocol Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make
minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
