2019 Sidewalk and Miscellaneous Concrete Repair Program ($40,198) and
Appropriating Funds ($33,398)

RECOMMENDED ACTION: Adopt resolution authorizing City Manager to execute change orders
to 2017-2019 Sidewalk and Miscellaneous Concrete Repair
Program, in an amount not to exceed $40,198, and appropriating
funds in the amount of $33,398.
BACKGROUND INFORMATION: This project consists of the construction, removal, and/or the
replacement of curb, gutter, sidewalk, ramps, or other miscellaneous
concrete items at various locations throughout the City.
Occasionally, other divisions need to have small amounts of miscellaneous concrete work done. It is
beneficial for the City to utilize this existing contract for the concrete needed by these divisions.
On, June 7, 2017, Council awarded the 2017-2019 Sidewalk and Miscellaneous Concrete Repair Program
contract to Popuch Concrete Contracting, Inc., of Lodi, in the amount of $203,232. On November 15,
2018, Council authorized the City Manager to execute change orders for this contract, in an amount not to
exceed $300,000. On December 18, 2019, Council authorized the City Manager to execute additional
change orders in an amount not to exceed $150,000, for a total change order authority of $450,000.
Currently, the City Manager has executed 10 change orders totaling $417,749 over the entire term of the
contract, leaving $32,251 in remaining change order authority at this time.
The additional change order authority of $40,198, if approved, would increase the remaining change order
authority to $72,449, allowing the City to address sidewalk and concrete needs through the remaining
contract term and utilize the proposed appropriation of TDA Bike/Ped funds ($38,398) recently received
for the contract.
Staff recommends authorizing City Manager to execute change orders to 2017-2019 Sidewalk and
Miscellaneous Concrete Repair Program, in an amount not to exceed $40,198, and appropriating funds
in the amount of $33,398.
FISCAL IMPACT: This project extends the useful life of City sidewalks and miscellaneous
concrete. If this street maintenance activity is not performed on a regular
basis, future, more costly repairs may be necessary, and leave the City
vulnerable to expensive claims. This project does not impact the general
fund.

RESOLUTION NO. 2020-263
A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO EXECUTE CHANGE ORDERS TO THE
2017-2019 SIDEWALK AND MISCELLANEOUS CONCRETE
REPAIR PROGRAM; AND FURTHER APPROPRIATING FUNDS
WHEREAS, on June 7, 2017, Council awarded the 2017-2019 Sidewalk and
Miscellaneous Concrete Repair Program contract to Popuch Concrete Contracting, Inc., of Lodi,
in the amount of $203,232; and
WHEREAS, on November 15, 2018, Council authorized the City Manager to execute
change orders for this contract, in an amount not to exceed $300,000; and
WHEREAS, on December 18, 2019, Council authorized the City Manager to execute
additional change orders in an amount not to exceed $150,000; and
WHEREAS, staff recommends authorizing the City Manager to execute change orders
to the 2017-2019 Sidewalk and Miscellaneous Concrete Repair Program, in an amount not to
exceed $40,198; and
WHEREAS, staff also recommends that the City Council appropriate funds in the
amount of $33,398 from the fund balance of TDA Bike Ped (33199000.77020) for
Fiscal Year 2020/21.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to execute change orders to the 2017-2019 Sidewalk and
Miscellaneous Concrete Repair Program, in an amount not to exceed $40,198; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize an
appropriation for Sidewalk and Miscellaneous Concrete Repair Program, in the amount of
$33,398, as set forth above; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
