BACKGROUND INFORMATION. A public hearing is required for a substantial amendment to the AAP. These requirements are outlined in the Lodi Citizen Participation Plan, which follows U.S. Department of Housing and Urban Development (HUD) requirements. Introduction: The 2020-21 AAP describes the activities and funding amounts for projects occurring during that program year. Certain reallocations of CDBG funds from one project or activity to another require a formal explanation of the reallocation of funds, as well as a public review and public hearing process, called a substantial amendment. This substantial amendment proposes to reallocate approximately $114,418 from multiple existing projects that were not fully spent down, have been delayed or cancelled, or are in progress but that have additional funding. These reallocated funds will go to two other projects that are currently in progress but are lacking in funds. This reallocation allows the City to stay current on its AAP goals, including staying consistent with timely expenditure requirements (e.g., spending down funds within the AAP program year) and meeting performance objectives. Transfer Sources: The first source of reallocated funds will come from CDBG funds that were allocated for the property acquisition portion of the HEAP: Tiny Homes project during the 2019-20 program year. The City experienced delays in finding suitable sites for the tiny homes within the originally anticipated time frame, which delayed the overall implementation of this project. Additionally, after assessing the program requirements further, City staff determined that the administrative burden associated with allocating CDBG funds to this project could lead to added project costs. The City is working on identifying a site for development and is moving forward in the process of implementing this project; however, the City has decided to reallocate CDBG funds to existing projects that are scheduled to be completed or implemented sooner. The second source of reallocated funds will come from San Joaquin Fair Housing's (SJFH) 2019- 20 unspent CDBG funds. In this instance, due to reasons beyond the subrecipient's control, SJFH's 2019-20 allocation was unable to be fully spent down before the end of the 2019-20 APPROVED: Stephen Schwa u ity Manager 2020-21 AAP Amendment No. 1 Page 2 of 4 program year. This was largely due to the COVID-19 pandemic, which created several safety and health restrictions on in-person gatherings and face-to-face contact. These restrictions resulted in the cancellation of the second scheduled tenant and landlord workshop during the third quarter of the 2019-20 program year. This left a portion of SJFH's 2019-20 CDBG funds unspent. The third source of funds will come from the Salvation Army: HVAC & Refrigerator Repairs project. This project was originally scheduled to be completed by the end of the 2019-20 CDBG program year; however, due to delays in the project's implementation and reductions in staff capacity, the subrecipient now anticipates the project to be completed by December 2020. The 2020-21 CDBG AAP originally approximated an amount of funds for this project because, at the time of the 2020- 21 AAP's drafting, an official budget had not been finalized by the subrecipient. The subrecipient has officially provided the City with a finalized budget and the total project cost is significantly lower than originally anticipated. Therefore, some funds originally allocated to this project are now able to be transferred elsewhere. Another source of reallocated funds will come from resources that were returned to HUD from prior year canceled CDBG capital improvement projects. This amendment outlines how these funds will be repurposed. This reallocation is possible due to multiple projects from prior years being canceled (Grace and Mercy, City Hall Carnegie Forum Improvements, and Public Counters Improvements) once CDBG funds had already been spent on a portion of the project's activities. As a result of the cancellations, the funds that were spent on the projects become ineligible expenses, and the City must reimburse HUD for these ineligible expenses. Once the funds are paid back to HUD, the resources are then returned to the City's Line of Credit with HUD, and the funds are in effect able to be repurposed for other projects. Lastly, reallocated funds will come from multiple prior year CDBG projects with resources that are uncommitted or unspent. These funds are left over from capital improvement projects that spent fewer funds than anticipated during project's completion. The prior year resources used in this amendment will come from 2014, 2017, and 2018 leftover resources. Transfer Recipients: The AAP amendment will allow the City to transfer funds from the sources mentioned above to the following two projects: 1. (19.02) Blakely Park Restroom Improvements 2. (16.04) Housing Rehabilitation and Repair Improvements The Blakely Park Restroom Improvements project (19.02) consists of the construction of a new restroom facility at Blakely Park. The facility will be complete with ADA -compliant accessibility improvements. The bids received for this project came in higher than the City originally anticipated. This amendment will add additional funds that would cover the entire cost of the project. The Housing Rehabilitation and Repair Improvements project (16.04) provides grants to lower- income elderly persons, persons with disabilities, and families who are in need of financial assistance. These grants are used to make minor interior and exterior repairs and improvements to the recipient's home. A more detailed description is provided in the AAP Amendment No. 1 (Exhibit A): Project Name Estimated Balance Transferred 19.02 Blakely Park Restroom Improvements $ 45,000 16.04 Housing Rehabilitation and Emergency Repair $ 69,418 Estimated Total $114,418 When an amendment occurs and funds are reallocated from one project to another, the City must assess the change in the type and number of individuals served from the projects that are transferring funds, as well as the projects that are receiving funds. The following summarizes the change in anticipated individuals that will be served in relation to each above-mentioned project: Upon completion, the HEAP: Tiny Homes project is projected to serve approximately 10-15 low -to - moderate income individuals on an annual basis. Non-CDBG funds will be used to complete this project; therefore, the reallocation will not have an impact on this project's anticipated accomplishments. In the 2019-20 CDBG program year, SJFH's fair housing activity assisted 538 individuals, which was more than the 350 originally anticipated to be served. The reallocation of leftover funds from this activity will have no effect on the number of people served during the 2019-20 program year. The Salvation Army HVAC & Refrigeration Repairs project is projected to serve 5,200 individuals who would directly benefit as a result of the facility improvements. This project is expected to be completed by December 2020. The transfer of funds from this project will not cause a loss in the number of individuals expected to be served. For those projects that will be receiving the allocated funds, the Blakely Park Restroom (19.02) project is projected to serve approximately 30,000 low- to moderate -income individuals within the project's surrounding census tracts. The additional funds to this project will improve access and long-term sustainability of this facility; however, the number and type of individuals served by these improvements does not change. As for the Housing Rehabilitation and Emergency Repair project, the additional funds will supplement the administration of the program but will not change the anticipated number of households to be served. Ten low- to moderate -income households are anticipated to receive improvements through this project. The public review and comment period for this Annual Action Plan amendment began on September 28, 2020, and ended on November 4, 2020. 2020-21 AAP Amendment No. 1 Page 4 of 4 FISCAL IMPACT: The 2020-21 Annual Action Plan Amendment No. 1 documents are being completed as an activity that is funded through the City's CDBG allocation from U.S. Department of Housing and Urban Development. FUNDING AVAILABLE: The approximately $45,000 transferred from the combination of multiple realiocable CDBG project funds will mitigate the use of general funds being spent on the overages incurred by the Blakely Park Restroom Improvements project. INTRODUCTION The 2020-21 Community Development Block Grant (CDBG) Annual Action Plan (AAP) is a one- year plan to address housing and community development needs in Lodi, with a particular focus on the needs of low-income households. This is the second year of the implementation of the five-year 2019-2023 Consolidated Plan. Both the Consolidated Plan and the AAP are implemented by the Neighborhood Services Division in the City of Lodi Community Development Department. The 2020-21 AAP was adopted by the City Council on May 6, 2020, and at the time of this amendment's drafting, is currently in the process of being reviewed for approval by the US Department of Housing and Urban Development (HUD). The AAP may be amended in accordance with the City's Citizen Participation Plan and HUD guidelines. This amendment is prepared pursuant to the City's Citizen Participation Plan as approved by HUD. The City is working to streamline project management, and part of that process includes identifying projects that are not ready to be funded, not a good fit for CDBG funding, or are delayed in their delivery and therefore unlikely to meet HUD spending deadlines. In this amendment, the City is looking to reallocate funds from multiple existing projects that were not fully spent down, have been cancelled, or are in progress but that have additional funding. These funds will go to two other projects that are currently in progress but lacking in funds. One source of reallocated funds will come from multiple prior year CDBG allocations with unallocated resources. These funds are left over from capital improvement projects that spent fewer funds than anticipated in the project's completion. The prior year resources used in this amendment will come from 2014, 2017, and 2018 leftover allocations. This amendment will also reallocate leftover funds from the 2019-20 CDBG program year— specifically, the CDBG funds that were allocated for property acquisition for the HEAP: Tiny Homes project in the 2019-20 CDBG program year. Originally, the City had allocated funds to this project through the 2019-20 AAP; however, the City experienced delays in finding suitable sites for the tiny homes within the originally anticipated time frame, which delayed the overall implementation of this project. Additionally, after assessing the program requirements further, City staff determined that the administrative burden and requirements associated with allocating CDBG funds to this project could lead to added project costs. Examples include the requirements needed to comply with the prevailing wage standards, the Davis -Bacon Act, the National Environmental Protection Agency Act, and the California Environmental Quality Act. The City is working on identifying a site for development and is moving forward in the process of implementing this project; however, the City has decided to reallocate funds to existing projects that are scheduled to be completed or implemented sooner. 2020-21 Annual Action Plan - Amendment #1 p. 2 of 4 In some instances, subrecipients of 2019-20 CDBG program funds were unable to fully spend down their annual allocation due to reasons beyond the subrecipient's control. In particular, San Joaquin Fair Housing's (SJFH) fair housing services program experienced restrictions in the program's implementation due to the COVID-19 pandemic. Specifically, the pandemic resulted in several safety and health related restrictions on in-person gatherings and face-to-face contact. ACTIVITY CHANGES The City has identified two existing projects to which it will commit these reallocated CDBG funds: • 19.02: Blakely Restroom • 16.04: Housing Rehabilitation and Emergency Repair Program As outlined in the City's Citizen Participation Plan, in order to commit these funds to existing activities, the City must amend the 2020-21 AAP. Descriptions of activities and proposed reallocation amounts are as follows: PUBLIC FACILITIES 19.02 Blakely Park Restroom Improvements Project City of Lodi - Public Works Department This project consists of the construction of a new restroom facility at Blakely Park. The bids received came in higher than anticipated by the City. This amendment will add additional funds that would cover the entire cost of the remainder of the project. This amendment will add additional funds to this project to help cover program administration costs. The CDBG program provides funding for activities that benefit low-income persons, eliminate slum or blight, or serve an urgent need. Eligible activities include property acquisition, public improvements, housing rehabilitation, economic development, and public services. As a recipient of Community Development Block Grant (CDBG) funding, the City developed the 2020- 21 Annual Action Plan which describes how the City utilizes program funds for eligible activities during the fiscal year. The Action Plan can be amended as needed to reallocate funds to housing and community development activities. The City proposes to reallocate those funds among various projects which in some cases includes funding from previous years.
