Adopt a Resolution Accepting Improvements at 301 West Kettleman Lane

RECOMMENDED ACTION: That the City Council adopt a resolution accepting the development improvements for
301 West Kettleman Lane.
BACKGROUND INFORMATION: Improvements at 301 West Kettleman Lane have been completed in substantial
conformance with the requirements of the Improvement Agreement between the
City of Lodi and Prime Shine Express Partners, Inc., as approved by the City Manager
on June 19, 2000, and as shown on Drawing No. 000D034.
The project site is located north of Kettleman Lane between Lee and Pleasant avenues. The northerly portion of the site
was previously developed for residential purposes with the balance of the site containing commercial development
(a Chevron station). A public 3 -inch water main extended northerly from Kettleman Lane through the western portion of the
site to the boundary between the residential and commercial development. The water main then extended easterly along
this boundary to approximately the center of the site and then northerly through a residential subdivision. Since the entire
site was to be redeveloped for commercial use, it was necessary to relocate the east -west portion of the water main to the
northerly boundary of the project.
In keeping with the City's on-going effort to improve service by bringing existing public services up to current standards
whenever possible, staff requested that the developer install a new 8 -inch water main in Lee Avenue and abandon the
existing 3 -inch water main on the site. The installation of an 8 -inch main provides improved water pressure for fire and
domestic purposes and will allow future extension in Lee Avenue and eventual elimination of the 3 -inch water main currently
serving the residences north of the project site. The new 8 -inch water main is connected to the existing 3 -inch main serving
the residential properties by a 4 -inch water main along the northerly site boundary. The location of the abandoned 3 -inch
water main, as well as the new water main configuration, is shown on Exhibit A.
Since the net cost of all fees and payments covered in the Improvement Agreement was under $50,000.00, the
Improvement Agreement was signed by the City Manager on June 19, 2000, without separate Council action as authorized
by Council on September 17, 1997. Under the terms of the Improvement Agreement, the developer is to be reimbursed for
the cost of the 8 -inch main installation plus 10% for engineering and administration in conformance with Lodi Municipal Code
§16.40, Reimbursements for Construction. Installation and payment for the 4 -inch main is the developer's responsibility.
As a matter of information, staff will return to Council to institute abandonment proceedings for the on-site 5 -foot public utility
easement (PUE) that contained the 3 -inch water main in the near future. The 10 -foot PUE, shown on Exhibit A, still
contains a public 6 -inch sanitary sewer main and will remain.
FUNDING: Funds for reimbursements will be obtained from the following sources:
1. Miscellaneous water mains (181451) $15,000.00
2. Miscellaneous system relocations (181457) $11.836.11

A RESOLUTION OF THE LODI CITY COUNCIL
ACCEPTING THE DEVELOPMENT IMPROVEMENTS
INCLUDED IN THE IMPROVEMENT AGREEMENT FOR
301 WEST KETTLEMAN LANE
The City Council of the City of Lodi finds:
1. That all requirements of the Improvement Agreement between the City of Lodi and
Prime Shine Express Partners, Inc., for the improvements at 301 West Kettleman Lane,
have been substantially complied with. The improvements are shown on Drawing No.
000D034 on file in the Public Works Department and as specifically set forth in the plans
and specifications approved by the City Manager on June 19, 2000.

The City Council of the City of Lodi, at its meeting on Wednesday, December 20, 2000,
accepted the public improvements that were made in the subject project.
Enclosed for your files is a copy of the resolution accepting the public improvements.
From the date of the resolution, the City of Lodi will maintain the street and other public
improvements installed within rights-of-way and public utility easements as shown on
the approved plans.
The Certificate of Deposit assigned to the City to guarantee faithful performance can
now be reassigned to you. The Certificate of Deposit guaranteeing labor and materials
will have to remain in effect for a period of ninety days from the date of the resolution in
conformance with State law. Your representative can pick up the reassignment and
certificate for faithful performance at our office during normal business hours. You will
be notified when the labor and materials guarantee is released.

This letter constitutes notice to you that the subject Certificate of Deposit, dated
June 9, 2000, in the amount of $39,286.11 to guarantee faithful performance has now
been reassigned to Prime Shine Express Partners, Inc. The City of Lodi no longer has
an interest in this Certificate of Deposit.
Certificate of Deposit No. 15009947, dated June 9, 2000, in the amount of $19,643.05 to
guarantee labor and materials will be reassigned March 20, 2001, ninety days from the
date of acceptance of the improvements in conformance with State law.
