HomeMy WebLinkAboutAgenda Report - December 6, 2000 E-09AGENDA TITLE: Adopt a Resolution Approving the Final Disadvantaged Business Enterprise (DBE) Program and Established Overall Annual Goal of 8% for Federal Fiscal Year 2001 MEETING DATE: December 6, 2000 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution approving the Final Disadvantaged Business Enterprise (DBE) Program and Established Overall Annual DBE Goal of 8% for Federal Fiscal Year 2001, to facilitate timely submission to the California Department of Transportation (Caltrans) for funding authority approval, by January 1, 2001, on behalf of the City of Lodi. BACKGROUND INFORMATION: The City of Lodi is required to develop and submit a Disadvantaged Business Enterprise Program and Overall Annual Goal for DBE participation on U.S. Department of Transportation (DOT) assisted contracts, as a condition of federal financial assistance, pursuant to recently revised regulations set forth under Title 49 CFR Part 26, Participation by Disadvantaged Business Enterprises in Department of Transportation Programs. In accordance with these DBE regulations, the City of Lodi has developed a Final DBE Program and Established Overall Annual DBE Goal for Federal Fiscal Year (FFY) 2001, to ensure full compliance with relevant regulatory requirements. The Final Disadvantaged Business Enterprise (DBE) Program and Established Overall Annual DBE Goal of 8% for FFY 2001 DOT -assisted contracts addresses critical components and fulfills specific requirements for narrow tailoring in accordance with Title 49 CFR Part 26. The City of Lodi's Established Overall Annual DBE Goal was developed utilizing the federal prescribed two-step goal -setting methodology. The first step included establishing a Base Figure utilizing quantifiable evidence to determine the relative availability of DBEs within specified industries identified as a part of the City's DOT - assisted contracting projects anticipated to be awarded by the City of Lodi within FFY 2001. The City utilized the Caltrans Directory of Certified DBE firms and the Census Bureau County Business Patterns database to complete this step. Upon establishing the Base Figure, the second step was for the City to survey and assess other known relevant evidence to determine what additional adjustments, if any, were needed to narrowly tailor the Base Figure to the City of Lodi's market area. Factors considered in the adjustment of the Base Figure included the historical and current capacity of DBEs measured by actual attainments on similar projects. Caltrans has approved the City's DBE Program and is waiting for Council approval and the City Manager's signature before they sign off on the program. The Established Overall Annual Goal for Federal Fiscal Year 2001 will be updated annually to maintain relevancy to local market conditions and factors impacting DBE availability. City Council approval and adoption of the Final Disadvantaged Business Enterprise (DBE) Program and Established Overall Annual DBE Goal for Federal Fiscal Year 2001 is required to ensure compliance with Department of Transportation's federal funding requirements, provisions and financial responsibilities. Failure to do so by the January 1, 2001 timeline will directly jeopardize the City of Lodi's federal financial assistance. A copy of the document is on file at Public Works Department. FUNDING: None needed at this time. However, preparation of this program required a significant administrative effort. In order to reduce necessary staff time, the City pooled our resources with the cities of Tracy, Manteca, Ripon and Escalon to retain Padilla and Associates to do much of the work. Council previously approved up to $6,500 for this participation. Dixon Flynn -- City Manager DBEGOAL � 11/30/00 10 RESOLUTION NO. 2000-219 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI AUTHORIZING THE CITY OF LODI TO APPROVE AND ADOPT THE FINAL DISADVANTAGED BUSINESS ENTERPRISE (DBE) PROGRAM AND ESTABLISHED OVERALL ANNUAL DBE GOAL OF 8% FOR FEDERAL FISCAL YEAR 2001 WHEREAS, the City of Lodi is required to develop and submit a Disadvantaged Business Enterprise (DBE) Program and Overall Annual Goal for DBE participation for DOT -assisted contracts, as a condition of federal financial assistance, pursuant to Title 49 CFR Part 26; Participation by Disadvantaged Business Enterprises in U.S. Department of Transportation (DOT) Programs; and WHEREAS, in accordance with new DBE regulations, the City of Lodi has developed a narrowly tailored Final Disadvantaged Business Enterprise (DBE) Program and Established Overall Annual DBE Goal of 8% for Federal Fiscal Year 2001; and WHEREAS, City Council adoption is required to ensure compliance with Department of Transportation federal funding requirements, provisions and financial responsibilities. NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council does hereby authorize the approval and adoption of the Final Disadvantaged Business Enterprise (DBE) Program and Established Overall Annual Goal for Federal Fiscal Year 2001, and, submission to the California Department of Transportation (Caltrans), on behalf of the City, for final approval.
