REGULAR CITY COUNCIL MEETING
CARNEGIE FORUM, 305 WEST PINE STREET
WEDNESDAY, DECEMBER 16, 2020
The Regular City Council meeting of December 16, 2020, was called to order by Mayor Kuehne
at 7:03 p.m.
Due to the COVID-19 pandemic and pursuant to Executive Order N-29-20, all Council Members
participated in the meeting via teleconference and the meeting was available for viewing by the
public via livestream at https://www.facebook.com/CityofLodi/ and
https://zoom.us/j/97854687709?pwd=bEE3cy90K09WSzNMQWlsZFFNSlN6Zz09; the
opportunity for public comment was available through councilcomments@lodi.gov and

Present: Mayor Kuehne, Mayor Pro Tempore Nakanishi , Council Member Chandler, Council
Member-Elect Hothi, Council Member-Elect Khan, City Manager Schwabauer, City Attorney
Magdich, and City Clerk Cusmir
Absent: Council Member Mounce
Also Present: None
Mayor Kuehne presented the Mayor's Community Service Award to Mr. Mike Carouba and
Mr. John Narvaez.
Mayor Kuehne and the Council acknowledged the service of the 2020 retired Boards,
Commissions, and Committee members. Doug Bojack (Lodi Improvement Committee) was
present at the meeting. Other retired members included: Greater Lodi Area Youth Commission
Student Members - Kevin Armknecht, Brendon Duran, Arriana Galvan, Jordyn Hummel, and
Jasmine Shukla; Greater Lodi Area Youth Commission Adult Advisor - Jean Powell; Library
Board of Trustees - David Main; Lodi Improvement Committee - Alfredo Almazan, Fran Forkas,
and Rehana Zaman; Planning Commission - Tiffany Gomes; Lodi Senior Citizens Commission -
Susan Crosby and Robert N. Anderson; Site Plan & Architectural Review Committee - John Della
Monica and Gary Yocum.
Council Member Chandler made a motion, second by Mayor Kuehne, to approve the following
items hereinafter set forth, in accordance with the report and recommendation of the City
Manager.

C. Consent Calendar (Reading; Comments by the Public; Council Action) All matters listed on
the consent calendar are considered to be routine and will be acted upon by one motion.
There will be no separate discussion of these items. If a member of the public would like a
consent calendar item pulled and discussed separately, refer to the Special
Teleconference Notice at the beginning of this agenda.

ROLL CALL VOTE
The City Council held a ROLL CALL vote (all voiced their votes).
Claims were approved in the amount of $4,091,208.93.
The minutes of November 24, 2020 (Shirtsleeve Session), December 1, 2020 (Shirtsleeve
Session), and December 2, 2020 (Regular Meeting) were approved as written.
Adopted Resolution No. 2020-296 accepting Vineyard Terrace Subdivision, Unit No. 2, Tract
No. 4011, public improvements; and authorizing reimbursement in the amount of $4,950.
Adopted Resolution No. 2020-297 authorizing the City Manager to execute Amendment No. 1 to
the Professional Services Agreement with Mission Linen Supply, in the amount of $10,000.
Adopted Resolution No. 2020-298 authorizing the City Manager to execute Amended
Confirmation under Northern California Power Agency Support Services Program Agreement for
engineering services for Northern San Joaquin 230 kV Transmission Project, in the amount of
$275,811.
Adopted Resolution No. 2020-299 accepting Fiscal Year 2019/20 Measure L Citizens' Oversight
Committee Annual Accountability Report and accepting Committee's recommendation to create
one-page flyer to promote success of Measure L.
Adopted Resolution No. 2020-300 approving 2021 pre-approved rate sunset for usage-based and
flat water rates for residential, commercial, and industrial customers.
C-1 Receive Register of Claims for November 13, 2020 through November 26, 2020 in the

Set public hearing for December 22, 2020, to consider adopting resolution approving Amendment
No. 2 to Community Development Block Grant (CDBG) Program 2019-2023 Consolidated Plan
and Amendment No. 2 to the 2020-2021 Annual Action Plan (AAP) to allocate Coronavirus Aid,
Relief, and Economic Security (CARES) Act CDBG (CDBG-CV) grant funding and amendment to
Citizen Participation Plan (CPP) to establish citizen participation practices during declared
emergencies.
Monica Davenport, a citizen, provided public comment regarding the Regional Stay At Home
Order and the Limited Stay At Home Order. Ms. Davenport encouraged the City Council to
support local businesses and to consider adoption of a resolution declaring the City of Lodi a
"Sanctuary City for Small Businesses."
Mayor Kuehne verified that the City Council had received Ms. Davenport's email regarding the
matter.
Pamela Coburn provided public comment via email, in support of the Harmony Homes Project.
Jennifer Lynn provided public comment via email, asking the City Council to uphold the
Constitution, declare the City a "Sanctuary City" for houses of worship, small businesses, and
schools, and to make the City of Lodi a Charter City.
None.
C-8 Appoint Teri Spring and Sandra Legan to Lodi Senior Citizens Commission and Post for
Expiring Terms on Lodi Improvement Committee (CLK)
C-9 Set Public Hearing for December 22, 2020, to Consider Adopting Resolution Approving

City Clerk Cusmir presented the results of the November 3, 2020, General Municipal Election,
stating that the San Joaquin Registrar of Voters completed its canvass of election on
December 3, 2020, with District 4 electing Shak Khan and District 5 electing Mikey Hothi, which
was further detailed in the Certificate of Election.
Council Member Chandler made a motion, second by Mayor Pro Tempore Nakanishi, to adopt
Resolution No. 2020-301 certifying the election results of the November 3, 2020, General
Municipal Election.

The City Council held a ROLL CALL vote (all voiced their votes).
This item took place following the Administration of the Oaths of Office.
City Manager Schwabauer presented outgoing Mayor Kuehne with a plaque in appreciation of his
dedicated service to this community.
City Clerk Cusmir administered the Oath of Office to Lodi City Council Members Shak Khan and
Mikey Hothi and presented Certificates of Election.
City Clerk Cusmir, serving as Chair, conducted the election for the office of Mayor as follows.

Council Member Chandler made a motion, second by Mayor Kuehne, to nominate Mayor Pro
Tempore Nakanishi to the office of Mayor.
There being no further nominations for the office of Mayor, the nominations were closed.

Member Kuehne, and Mayor Pro Tempore Nakanishi
Noes: None
City Clerk Cusmir turned over the gavel to newly-elected Mayor Nakanishi who then conducted
the election for the office of Mayor Pro Tempore.

Council Member Kuehne made a motion, second by Council Member Hothi, to nominate Council
Member Chandler to the office of Mayor Pro Tempore.
There being no further nominations for the office of Mayor Pro Tempore, the nominations were
closed.
