Council Member Mounce noted that funding has been available through No Place Like Home for three years and expressed frustration at the amount of time it has taken to address the homelessness problem. Council Member Mounce made a motion, second by Mayor Kuehne, to adopt Resolution No. 2020-119 authorizing the City Manager to draft a 2020 Permanent Local Housing Allocation (PLHA) grant application to the California Department of Housing and Community Development for Permanent Homeless Shelter Project - Predevelopment Phase, in the amount of $2,017,590. Comments by the City Council Members on Non-Aaenda Items Council Member Mounce stated that she would like to hear from the City Attorney regarding the bond issue mentioned in public comments and have the Police Chief speak regarding a possible curfew. She noted that for 50 years there have been peaceful protests surrounding the injustice that is rampant in our society regarding people of color, she is truly disgusted with what happened; racism is alive in America and it is our responsibikiy to take a stand and make sure the message is clear that this is no longer going to be tolerated in our society, starting with leadership. Police Chief Sierra Brucia stated that if the City Council chooses to enact a curfew, the Police Department would enforce it. However, he noted the Police Department is preparing for the protest on Sunday, and having a curfew in affect could take away resources from the preparation. He further stated that in his opinion the people that will follow a curfew are not the people who are causing problems. In response to Council Member Mounce regarding preparation for the protest on Sunday, Chief Brucia stated that the Police Department has been monitoring events throughout the Stale and nation on a daily basis, including social media news reports. He noted that a peaceful demonstration was held today in front of the Police Department with 40 to 50 people in attendance. There was a significant number of officers on duty, with other officers joining on their own. Regarding the event on Sunday, the Police Department has been in contact with organizers and the business owners in the area; there will be double patrols shifts; the mobile field force will be ready; the SWAT team will be on standby; all five lieutenants will be on duty to act as incident commanders; the entire command staff of the Police Department will be available; a contingent will be monitoring and protecting the Police Department and the Fire Department; the Stockton Police Department will be on standby with their mobile field force; the Sheriffs' Office has been contacted regarding staffing in town during the demonstration and being on standby for support; and LPD mobile field force commander will be meeting with the National Guard Commander. In response to Council Member Mounce, City Attorney Magdich stated that clearly people have the constitutional right to exercise free speech in a peaceful manner. The City does not have an ordinance to require a permit or indemnification for protests; the court would find $10 million unconsciounable because of the dollar amount; and the City cannot put up barriers to the exercise of free speech rights. She further noted that the last two days of protests in Stockton have been very peaceful, so it would be wrong to assume that Sunday's protest will turn violent, but the Police Department is prepared. Mayor Pro Tempore Nakanishi stated that what was done to George Floyd was atrocious and should never have happened in the United States, but the citizens and businesses of Lodi do not want demonstrations. Now that I see we are no longer enforcing social distancing or even following the law in San Joaquin county, when is the county going to let kids start playing their youth sports? My children are getting depressed and this quarantine has caused more harm to our children then good. When are our country supervisors going to step up and let our kids be kids? We need to start thinking about our kids and their health. They don't want to go on walks anymore, they want to play sports with their friends and teammates. They can't even go to the park, but then you have people looting the town. How is this okay? Our kids need sports to STAY OUT OF TROUBLE! They need activity and discipline. I have found San Diego County supervisors and Placer County have put in a request to the governor to allow their kids play. Has the countyPutin any type of request to allow our children get back to a normal life? My fear is if we don't get our kids back onto the fields they will startgetting into trouble and cause more problems for our county. Our children are suffering right naw. They've social distanced, they haven't played at the parks, they haven't played with their teammates, they are depressed, starting to get unmotivated, and I fear for my kids mental health. From my understanding we are in stage 3. Stage 3 we were supposed to allow sports again and the governor has turned this into a waiting game once again waiting on him, while he's out with his face mask hanging off his face and not social distancing while he has a photo op cleaning off all the looting and rioting mess. The governor has allowed 10005 of looting and rioting in our California towns without batting an eye about social distancing. Why is this okay? We need to stand up to this governor and put our kids first. His kids aren't suffering, they have their own pool, private tennis courts, basketball courts, and play areas, what about our children? Open our pools for our kids. I know you guys say you have to go by what the PHO says. Well Ms. Parks is not doing anything but what the governor states. And we all can agree he is not going by science. And he refuses to tell us what he is going by. CDC (I linked in a previous email) has stated that Covid19 dies within minutes being exposed to the sun. It doesn't stay alive on surfaces but for a minute or two. I understand Mayor Kuehne you were appointed to this position but I request you to step down If this is to stressful or causing you anxiety. Sitting on your seat for power, Please start exhibiting this power by taking control of this downward slide this city has been in for the last 2 years. Some major steps toward Improvement have been down just recently because of the power and presence of your female council member who has been unduly overlooked as appointed mayor the last 2 terms. Please step down if you are not feeling up to performing the duty of being proactive in protecting our town during this time. If seeing the downtown being boarded up and benches and BBO's removes doesn't bother you. If our water destruction with disease and filth infiltrating our drinking water isn't enough. Thank you for responding to my email. That being said, I wasn't even sure if you were checking email anymore, since you are my district's representative and have declined to respond to any of my recent emails regarding the ongoing problems with the homeless encampment that's plagued my neighborhood for the last 15 years. That being said, you prove my point with your response. How is anyone in the public to be aware of your conversations with the organizers of the protest when this council hasn't shared those details with the public? How is the Chief of Police and DA aware of the article and you are not? Do you not work together to stay abreast of this ongoing situation? The Chief didn't contact city council prior to or immediately after having given a statement? Either way, as soon as the LNS had published that front page headline, the City of Lodi should've felt an obligation to make a public statement to reassure the community and reiterate the sentiments of the chief of police and encourage unity and peaceful demonstrations. How dare you skirt your responsibilities and try to disparage and belittle me. Your response is unacceptable, and it again shows the systemic lack of transparency in Lodi's leadership. I have personally engaged with their representative, Brian Wratten, who has been in touch with Chief Brucia and has repeatedly assured me of a peaceful protest. People are very fearful of what is to come—especially amidst the Covid-19 pandemic. During a time that the citizens of this city need reassurance more than ever, nothing but deafening silence from this council. Even in Tuesday's Lodi Sentinel article regarding the planned protest, no comments from any member of this council or the city manager. Again, this city council has shoveled off their leadership responsibility on to our understaffed Lodi Police Department. It's not the first time. Quite frankly, it's become par for the course. Thus sewing more anti -police sentiments in our community. Mahatma Gandhi said, "I object to violence because when it appears to do good, the good is only temporary; the evil it does is permanent." This council has an opportunity to address the civil unrest and injustice happening in our country and peacefully diffuse this potential situation. All of you have a responsibility to attempt to bridge this rift among the citizens of this town and to encourage peace and unity. Many Lodi citizens and business owners do not want the City to allow a public gathering at the present time to avoid the violence and enormous property damage taking place in other cities from the supposedly peaceful gatherings. Please immediately post an agenda for a special City Council meeting this coming Friday in order to vote to temporarily suspend public protest gatherings until the current national tensions subside. 2. In the past few days we have had to take extraordinary measure to try and protect our properties. As an "Essential Business" we are asked to remain open to serve our customers and the community and to have to expend the dollars and time to board up our facilities is outrageous. Though some may try to politicize this situation, it's not. You need to stand up for the businesses that support our city. The impact on local businesses who are already financially stressed by shelter -in-place would be devastated with the destruction we have witnessed in other places. I am recommending continued monitoring which would include a Friday night council meeting to allow maximum reaction, monitoring and protection. I also recommend a curfew to ensure that criminal elements can no longer infiltrate peaceful protestors. Any criminal activity should be aggressively prosecuted. I do not want a protest rally to occur in Lodi this Sunday. I am afraid that this protest could turn violent as it has in many other local cities and towns and I don't want Lodi citizens to Ilve in fear. There should be a special council meeting called to address creating a temporary ban on all rallies until it can determined that these rallies will not negatively harm the citizens. If a rally permit is issued the city should require that they post a public Bond that protects against property damage and business interruption coverage.
