HomeMy WebLinkAboutResolutions - No. 2020-202RESOLUTION NO. 2020-202 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CITY MANAGER TO WAIVE THE BID PROCESS AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH GARLAND/DBS, INC., OF CLEVELAND, OHIO, FOR WHITE SLOUGH WATER POLLUTION CONTROL FACILITY ELECTRICAL ROOM AND DIGESTER BUILDING ROOF REPLACEMENT PROJECT, UTILIZING U.S. COMMUNITIES CONTRACT NO. PW1925, AND TO CARRY FORWARD UNSPENT BUDGET AUTHORITY FOR THIS PROJECT, UP TO $48,593, UNTIL PROJECT COMPLETION; AND FURTHER APPROPRIATING FUNDS WHEREAS, the electrical room and digester building at White Slough Water Pollution Control Facility contain equipment critical for wastewater treatment operations; and WHEREAS, the existing roofs have reached their useful life, potentially exposing the equipment inside the building to damage; and WHEREAS, this project will replace the existing roofing materials with a multi -ply membrane system, as well as replace the failing metal flashing; and WHEREAS, per Lodi Municipal Code Section §3.20.045, State and Local Agency Contracts, the bidding process may be waived when it is advantageous for the City, with appropriate approval by the City Manager and City Council, to use contracts that have been awarded by other California public agencies, provided that their award was in compliance with their formally -adopted bidding or negotiation procedures; and WHEREAS, staff recommends authorizing the City Manager to waive the bid process and execute a Professional Services Agreement with Garland/DBS, Inc., of Cleveland, Ohio, for White Slough Water Pollution Control Facility Electrical Room and Digester Building Roof Replacement Project, in the amount of $140,593, utilizing U.S. Communities Contract No. PW1925, and to carry forward unspent budget authority for this project, up to $140,593, until project completion; AND WHEREAS staff also recommends that the City Council appropriate funds in the amount of $48,593, from the fund balance of Wastewater Capital (53199000.77020) for Fiscal Year 2020/21. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to waive the formal bidding process and execute a Professional Services Agreement with Garland/DBS, Inc., of Cleveland, Ohio, for White Slough Water Pollution Control Facility Electrical Room and Digester Building Roof Replacement Project, in the amount of $140,593, utilizing U.S. Communities Contract No. PW1925; and BE IT FURTHER RESOLVED that Lodi City Council does hereby authorize the City Manager to carry forward unspent budget authority for this project, up to $140,593, until project completion; and BE IT FURTHER RESOLVED that funds in the amount of $48,593 be appropriated as set forth above; and BE IT FURTHER RESOLVED pursuant to Section 6.3q of the City Council Protocol Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
