BACKGROUND INFORMATION: Gateway North Subdivision, Unit No. 1, is located west of Lower Sacramento Road and south of Lodi Shopping Center, as shown on Exhibit A. Unit No. 1 consists of 98 single-family, residential lots. This project is part of the Community Facilities District No. 2007-1 (Public Services) (CFD). Routinely, final maps and improvement agreements are presented to Council at the same time. For this project, the developer, Blossom Land Company, requested the approval of the improvement agreement prior to the approval of the final map because the subdivision had not yet been annexed into the CFD as required by the approved tentative map. Staff agreed with this request, with the intention of returning to Council for final map approval after the CFD annexation was completed. The improvement agreement for the subdivision was approved by the City Council on April 17,2019 and the agreement was fully executed on May 1 , 2019. Resolution No. 2019-66 stated that the final map will be presented at a later date for City Council approval. Staff inadvertently presented the final map to the City Clerk's office for signature on July 18,2019. The final map was subsequently recorded by the County on July 22,2019 without City Council approval and became a legal map. To remedy the procedural error, this proposed Council action retroactively approves the map and ratifies the action taken by the City Clerk upon signing the City Clerk's Statement on the final map. The County Surveyor has been consulted by staff and has agreed that no other action shall be required on behalf of the County Surveyor.
