RECOMMENDED ACTION Accept improvements under contract for Candy Cane Park 2019
lmprovements and adopt resolution reallocating project funding, in
the amount of $100,000.
BACKGROUND INFORMATION: Candy Cane Park was originally built in the late 1950's and the play
structure was replaced in 1992. The playground had minor
American's with Disabilities (ADA) improvements completed in
1997; however, the play structure had since deteriorated and was ultimately removed for code-
compliance, accessibility, and safety reasons.
This project consisted of removing the remaining equipment (swings, footings, benches, etc.) and
installing ADA-accessible playground, benches, picnic tables, swings, drinking fountain, fencing, new
accessible sidewalks, and a new park sign. Before and after photos of the park are shown in Exhibit A.
The plans and specifications for this project were approved on March 6,2019. The contract was
awarded on June 19,2019, to A. M. Stephens Construction Co., lnc., of Lodi, in the amount of $347,600.
This Council action also authorized the City Manager to execute change orders in an amount not to
exceed $102,400.
The original contract completion date was November 14,2019. The contract was substantially complete
on November 8,2019. The final contract amount is $394,063. The difference between the original
contract amount and final contract amount is $46,463 due to three contract change orders, resulting from
a combination of building code and ADA-required changes, sign modification (deduction), fence removal
(deduction), and sidewalk replacement additions.
Change Order No. 1 included the addition of landscaping and irrigation to the original scope of work, and
several value engineering changes, including sign modifications, that resulted in line item deductions
($19,924.10).
Change Oder No. 2 included the installation of a swing structure and additional paving costs ($15,951).
Change Order No. 3 included the removal and replacement of 85 linear feet of sidewalk that was not
ADA compliant ($1 0,587)
When the Fiscal Year 2019/20 Capital lmprovement Program budget was prepared, staff did not
anticipate funding from Measure L would be needed for this project. Upon contract award, the budget
process had been completed and due to higher than expected bid prices, the project needed additional
funding, in the amount of $100,000. lncluded in the Fiscal Year 2019120 Capital lmprovement Budget is

a project to replace playground equipment at Beckman, English Oaks, and Katzakian parks funded by
Measure L. Staff recommends reallocating $100,000 from the playground replacement project to the
Candy Cane Park lmprovements project and addressing the reduction in the playground replacement
project in the next budget cycle.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors
that the project is complete and begins their 30-day period to file a stop notice requiring the City to
withhold payments from the prime contractor in the event of a payment dispute.
Staff recommends accepting improvements under contract for Candy Cane Park 2019 lmprovements and
reallocating project funding, in the amount of $100,000.
FISCAL IMPACT:Staff anticipates a nominal increase in Parks maintenance costs; however,
the project reduces City liability with improved accessibility and safer
playground facilities. The project was funded through a combination of
Parks Capital, Storm, Streets, and Measure L.
