Project; Adopt Resolution Authorizing City Manager to Execute Change Order No. 1
($23,661), and Appropriating Funds ($24,000)

RECOMMENDED ACTION: Accept improvements under contract for Westgate Drive Street
lmprovement Project; adopt resolution authorizing City Manager to
execute Change Order No. 1, in the amount of $23,661, and
appropriating funds in the amount of $24,000.
BACKGROUND INFORMATION: This project consisted of removing the center landscape median
(including 18 red oak trees) on Westgate Drive, from 450 feet south of
Taylor Road to 300 feet north of Kettleman Lane, replacing the
median space with asphalt concrete pavement, and other miscellaneous and related items of work. This
project was initiated at the request of the Fire Department to improve emergency access to new homes east
of Westgate Drive.
The plans and specifications for this project were approved on June 19,2019. To expedite the work,
Council authorized the City Manager to award a contract to the lowest responsive bidder, up to $100,000.
Three bids were received on July 17,2019, all of which exceeded the amount Council authorized the City
Manager to award.
On August 7,2019, Council awarded the project to the lowest responsive bidder, Anthem Builders, lnc., in
the amount of $1 11,362, and authorized the City Manager to retain his prior change order approval
authorization, not to exceed $10,000.
The final project cost is $135,022. The difference between the original bid and the final cost is due to one
change order. Change Order No. 1 ($23,660.28) was requested by the City to remedy unstable soil below
the new pavement area. Change Order No. 1 also added 10 days to the completion date.
The contract was completed on November 6, 2019, prior to the revised project completion date. Photos of
completed work are shown in Exhibit A.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors that
the project is complete and begins their 30-day period to file a stop notice requiring the City to withhold
payments from the prime contractor in the event of a payment dispute.
Staff recommends accepting improvements under contract for Westgate Drive Street lmprovement Project;
adopt resolution authorizing City Manager to execute Change Order No. 1, in the amount of $23,661, and
appropriating funds in the amount of $24,000.

FISCAL IMPAGT:There will be a decrease in long-term maintenance associated with the
landscape and median upkeep. The difference between the requested
appropriation and the final project cost is to account for staff time and
materials testing costs.
