RECOMMENDED ACTION Adopt a resolution authorizing the City Manager to waive the bid process
and execute all documents necessary to enter into a Professional
Services Agreement with Devastating Pyrotechnics of San Francisco for
Fourth of July fireworks shows at Lodi Lake Park for up to three years in
an amount not to exceed $48,000.
BACKGROUND INFORMATION: Parks, Recreation and Cultural Services issued a Request for Proposals
earlier this year to select a vendor for the Fourth of July fireworks show at
Lodi Lake Park. Devastating Pyrotechnics was selected over two other
companies based on references and the quantity and type of fireworks for proposed show.
On July 4,2019, Devastating Pyrotechnics provided the City with a superior show. Devastating Pyrotechnics'
fireworks selection included large aerial shells and fireworks that displayed on the water at the lake. Unsolicited
comments from the public, both at the event and afterward, were universally favorable. ln addition, Devastating
Pyrotechnics staff was professional and cooperative with City needs.
As a result, staff wishes to enter into a Professional Services Agreement with Devastating Pyrotechnics for up
to three additional years. The company recently informed staff that the price of fireworks will increase 25
percent in December as a result of trade tariffs, but it does have a three-year inventory of fireworks similar to
those used in our 2019 show it can set aside and guarantee the same pricing. The cost of the show is $16,000
a year.
Lodi Municipal Code Section 3.20.070 - Bidding, allows staff to waive the typically competitive bidding
process when the City Council determines that the purchase or method of purchase would be in the best
interests of the City. ln light of the pending tariffs and Devastating Pyrotechnics' performance, staff believes
this purchase justifies this waiver.
Due to the time-sensitive nature of this purchase, the resolution authorizes the City Manager to sign all
required documents related to the fireworks purchase, including a Professional Services Agreement, for up to
three years of fireworks shows at Lodi Lake Park.

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO WAIVE THE BID PROCESS AND EXECUTE ALL
DOCUMENTS NECESSARY TO ENTER INTO A PROFESSIONAL SERVICES
AGREEMENT WITH DEVASTATING PYROTECHNICS, OF SAN FRANCISCO,
FOR FOURTH OF JULY FIREWORKS SHOWS AT LODI LAKE PARK
WHEREAS, the Parks, Recreation and Cultural Services Department issued a Request
for Proposals for a Fourth of July fireworks show earlier this year; and
WHEREAS, Devastating Pyrotechnics, of San Francisco, was selected as the vendor to
provide that show on July 4,2019; and
WHEREAS, Devastating Pyrotechnics provided a fireworks show of high quality and
acted in a highly professional and cooperative manner on that date; and
WHEREAS, trade tariffs taking effect in December 2019 will increase the cost of
fireworks imported from China by 25 percent; and
WHEREAS, Devastating Pyrotechnics has enough fireworks in inventory to provide the
City of Lodi with a same or similar fireworks show at the same price in 2020,2021, and 2022 if
the City is able to enter into a contract before December; and
WHEREAS, Lodi Municipal Code Section 3.20.070 - Bidding, allows staff to waive
competitive bidding when the City Council determines that the purchase or method of purchase
would be in the best interests of the City.
NOW, THEREFORE, BE lT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to waive the bid process and execute all documents necessary to
enter into a Professional Services Agreement with Devastating Pyrotechnics, of San Francisco,
California, for Fourth of July fireworks shows at Lodi Lake Park for up to three years in an
amount not to exceed $48,000.
