BACKGROUND INFORMATION: This project resurfaced five tennis courts at Kofu Park with a new textured, colored surfacing system and applied new colored game lines. This project also includes restriping two of the most westerly tennis courts at Legion Park into six pickleball courts and resurfacing the six courts at Legion Park. The contract was awarded on May 15,2019, to First Serve Productions, lnc., of Danville, in the amount of $81,888. The contract has been completed in substantial performance with the plans and specifications approved by Council on March 20,2019. The final contract price was $96,888. The difference between the original and final contract price is due to one change order in the amount of $15,000, to resurface and restripe the two easterly tennis courts at Legion Park. This work was not included in the original scope but was necessary to avoid a strong color contrast between the newly striped pickleball courts and the existing tennis courts. To minimize the additional cost, the additional work needed to be completed before the contractor left the jobsite. The City Manager, upon recommendation by both, the Public Works Director and Parks, Recreation, and Cultural Services Director, executed Change Order No. 1 in order to secure a final project that looks complete and finished for the City's tennis and pickleball players. Before and after photos of the completed work are shown in Exhibit A. Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors that the project is complete and begins their 30-day period to file a stop notice requiring the City to withhold payments from the prime contractor in the event of a payment dispute. Staff recommends accepting improvements under contract for Kofu Park and Legion Park - Court Resurfacing lmprovements and adopting resolution ratifying expenses for Change Order No. 1, in the amount of $15,000, and appropriating funds in the amount of $15,000. FISCAL IMPACT The project will have a minimal impact on annual maintenance costs. This project did not impact the General Fund. NOW, THEREFORE, BE lT RESOLVED that the Lodi City Council does hereby ratify Change Order No. 1 to Kofu Park and Legion Park - Court Resurfacing lmprovements Project, in the amount of $15,000; and BE lT FURTHER RESOLVED that the Lodi City Council does hereby authorize an appropriation for the Kofu Park and Legion Park - Court Resurfacing lmprovements Project, in the amount of $15,000, as set forth above.
