HomeMy WebLinkAboutResolutions - No. 2019-261RESOLUTION NO. 2019-261 A RESOLUTION OF THE LODI CITY COUNCIL REJECTING THE LOWEST BID AND AWARDING THE CONTRACT FOR WELL 3R REHABILITATION PROJECT TO ZIM INDUSTRIES, INC., OF FRESNO; AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDERS; AND FURTHER APPROPRIATING FUNDS WHEREAS, in answer to notice duly published in accordance with law and the order of this City Council, sealed bids were received and publicly opened on October 30, 2019, at 11:00 a.m., for Well 3R Rehabilitation Project, described in the plans and specifications therefore approved by the City Council on October 2, 2019; and WHEREAS, said bids have been checked and tabulated and a report thereof filed with the City Manager as follows: Above/(Below) Engineer's Bidder Base Bid Estimate Nor -Cal Pump & Well Drilling, Inc.* $147,370 ($21,380) Zim Industries $167,450 ($1,300) Howk Systems $169,824 $1,074 Maggiora Bros. Drilling Inc. $204,260 $35,510 "Non -Responsive - Did not Submit Receipt of Addendum No. 1 WHEREAS, the apparent low bidder, Nor -Cal Pump & Well Drilling, Inc., did not submit the required Receipt of Addendum No. 1 with the bid and was deemed non-responsive; and WHEREAS, staff recommends that the City Council reject the lowest bid and award the contract for Well 3R Rehabilitation Project to Zim Industries, Inc., of Fresno, in the amount of $167,450; and WHEREAS, staff also recommends the City Council authorize the City Manager to execute the contract and change orders in an amount not to exceed $30,000; and WHEREAS, staff also recommends the City Council appropriate funds in the amount of $250,450 from the fund balance of Water Capital (56199000.77020) for Fiscal Year 2019/20, NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby reject the lowest bid and award the contract for Well 3R Rehabilitation Project to Zim Industries, Inc., of Fresno, California, in the amount of $167,450; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute change orders, in an amount not to exceed $30,000; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to continue budget authority up to the full project budget for this project from fiscal year to fiscal year until such point as the project is complete and is accepted by Council. At such time, all unspent budget authority will return to the fund for re -appropriation by the City Council; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize an appropriation for the Well 3R Rehabilitation Project, in the amount of $250,450, as set forth above.
