BACKGROUND INFORMATION On March 22,1989, the City Council approved Resolution No. 89-29 adopting the Lodi Electric Utility (LEU) Rules and Regulations which set forth how the utility will furnish electric service to any premises within the LEU Service Territory. Since 1989, a number of revisions have been approved by City Council, the most recent of which was in 2012. With continuous changes in the electric utility industry including legislative and regulatory requirements, technological advances, and local requirements, staff has completed a more comprehensive review of the full suite of LEU Rules and Regulations. On November 27,2018, LEU staff presented the City Council with the proposed changes to its Rules and Regulations. Prior to this meeting, staff met with interested parties on two separate occasions - June 3, 2018 and October 4, 2018. On June 1 1,2019, staff presented additional information to City Council as it relates to specific changes to Rule 1 whereby LEU is proposing to define the customer point of interconnection within the Downtown District and outlining various criteria which would ensure compliance with the proposed rule change under certain conditions. The proposed Rule 1 change will result in increased safety, improved reliability and more timely response/repairs in the event of failing infrastructure. Based on Council's discussion and direction provided at the June 1 1, 2019 meeting, conditions for compliance will include failure of a service lateral, major renovation, the sale of property or full compliance within 15 years. At the request of Council, the City's Business Development Manager will continue to research possible funding opportunities that could possibly help offset the cost of compliance for Downtown business owners. A detailed redline of the proposed changes to the LEU Rules and Regulations is available at LEU for review. A summary of the proposed changes is provided as Exhibit A. FISCAL IMPACT:The actualfiscal impact associated with the proposed Rule 1 changes as outlined above will be determined at the time of compliance. FUNDING AVAILABLE Funding needs, if required, will be determined and accounted for annually as part of LEU's operating and capital budget planning each year. *= rlAPPROVED , City Manager Adopt Resolution Authorizing and Adopting Revisions to Lodi Electric Utility Rules and Regulations September4,2019 Page 2 ol 2 Andrew Keys Deputy City Manager, Internal Services Director Electric Utility Director PREPARED BY: Hasan Shahriar, PE, Senior Power Engineer EXHIBIT A Lodi Electric Utility Rules and Regulations Summary of Revisions Rule No.Title Current Revision New Revision Summary of changes 2 Description of Service 1 2 -Revisions Page added -Formatting changes -Added being able to change subsurface equipment to current standard padmount equipment -Added references to the “Lodi Municipal Code” -Added “Relocation of Facilities” Section -Added “Non-Residential Customer Requested Scheduled Outages” Section -Added tables where applicable 3 Application for Service 1 2 -Revisions page added -Formatting changes -Clarification of when the “Service and Meter Application” is required -Added reference to the “Lodi Municipal Code” 4 Contracts 1 2 -Revisions page added -Formatting changes - Clarification that Energy Data Pulse contracts are for legacy equipment only -Added references to the “Lodi Municipal Code” -Added reimbursement agreement authorization for the City Manager and LEU Director. 1 General statement and definitions 2 3 -Revisions page added -Added the definitions of “Business Day”, “Demand”, “Downtown District”, “Distribution System”, “Electric Emergency Plan”, “Load”, “Power Factor”, “Public Right-of-Way”, “Public Utility Easement”, “Smart Inverter”, “Sub-metering”, and “Sub- transmission.” -Updated the definitions of “Point of Interconnection”, “Service”, and “Temporary Service.” Page 1 of 4 EXHIBIT A Lodi Electric Utility Rules and Regulations Summary of Revisions 5 Special Information Required on Forms 1 2 -Revisions page added -Formatting changes -Added references to the “Lodi Municipal Code” 6 Establishment and Re- establishment of Credit 1 2 -Revisions page added -Formatting changes - Added references to the “Lodi Municial Code” to further show that the Finance Director can use special information to assure proper Customer billing and to establish credit. -Added that the Customer Services Manager and the Financial Services Manager may grant exceptions for establishing and re-establishing credit on a case by case basis. 7 Deposits 1 2 -Revisions page added -Formatting changes -Changed the reference to the “Lodi Municipal Code” 8 Notices 1 2 -Revisions page added -Formatting changes -Updated address to which Customer notices are to be sent 9 Rendering and Payment of Bills 1 2 -Revisions page added -Formatting changes 10 Disputed Bills 1 2 -Revisions page added -Formatting changes -Added references to the “Lodi Municipal Code” 11 Discontinuance and Restoration of Service 1 2 -Revisions page added -Formatting changes -Added references to the “Lodi Municipal Code” 12 Application of Rate Schedules 1 2 -Revisions page added -Formatting changes -Added references to the “Lodi Municipal Code” -Changed “Rate Schedules” to “Electric Service Rates” Page 2 of 4 EXHIBIT A Lodi Electric Utility Rules and Regulations Summary of Revisions 13 Temporary Service 3 4 -Revisions page added -Formatting changes -Added Temporary Service might not be available until the City has time to obtain necessary rights-of-way and install equipment 14 Continuity of Service 1 2 -Revisions page added -Formatting changes -Now referencing the Electric Emergency Plan (EEP) when a shortage of supply occurs -Added “Conflict with Equipment and Facilities” Section 15 Extension of Facilities 5 6 -Revisions page added -Formatting changes -Added the “Electrical Service Inspections” Section 16 Service Connections and Facilities on Customer's Premises 3 4 -Revisions page added -Formatting changes -Added a max number of times LEU will do inspections before charging for both overhead and underground -Added “Service Connections” Section -Added “Ownership of Facilities” Section 17 Measurement of Service 1 2 -Revisions page added -Formatting changes -Made “Energy Data Pulses” only apply to legacy equipment 18 Meter Tests and Adjustments of Bills for Meter Error 1 2 -Revisions page added -Formatting changes -Added one free meter test per year per premise 19 Supply to Separate Premises and Resale 2 3 -Revisions page added -Formatting changes -A reference to the “Lodi Municipal Code” was added. -Added section D-7 regarding resale of power. 20 Replacement of Overhead with Underground Facilities 2 3 -Revisions page added -Formatting changes -A reference to the “Lodi Municipal Code” was added.
