RECOMMENDED ACTION Adopt resolution authorizing and adopting revisions to Lodi Electric
Utility Rules and Regulations.
BACKGROUND INFORMATION On March 22,1989, the City Council approved Resolution No. 89-29
adopting the Lodi Electric Utility (LEU) Rules and Regulations which
set forth how the utility will furnish electric service to any premises
within the LEU Service Territory.
Since 1989, a number of revisions have been approved by City Council, the most recent of which was in
2012. With continuous changes in the electric utility industry including legislative and regulatory
requirements, technological advances, and local requirements, staff has completed a more
comprehensive review of the full suite of LEU Rules and Regulations.
On November 27,2018, LEU staff presented the City Council with the proposed changes to its Rules and
Regulations. Prior to this meeting, staff met with interested parties on two separate occasions - June 3,
2018 and October 4, 2018. On June 1 1,2019, staff presented additional information to City Council as it
relates to specific changes to Rule 1 whereby LEU is proposing to define the customer point of
interconnection within the Downtown District and outlining various criteria which would ensure
compliance with the proposed rule change under certain conditions. The proposed Rule 1 change will
result in increased safety, improved reliability and more timely response/repairs in the event of failing
infrastructure.
Based on Council's discussion and direction provided at the June 1 1, 2019 meeting, conditions for
compliance will include failure of a service lateral, major renovation, the sale of property or full
compliance within 15 years. At the request of Council, the City's Business Development Manager will
continue to research possible funding opportunities that could possibly help offset the cost of compliance
for Downtown business owners.
A detailed redline of the proposed changes to the LEU Rules and Regulations is available at LEU for
review. A summary of the proposed changes is provided as Exhibit A.
FISCAL IMPACT:The actualfiscal impact associated with the proposed Rule 1 changes as
outlined above will be determined at the time of compliance.
FUNDING AVAILABLE Funding needs, if required, will be determined and accounted for annually
as part of LEU's operating and capital budget planning each year.

A RESOLUT¡ON OF THE LODI CITY COUNCIL AUTHORIZING
AND ADOPTING REVISIONS TO LODI ELECTRIC UTILITY
RULES AND REGULATIONS
WHEREAS, on March 22, 1989, the City Council approved Resolution No. 89-29
adopting the Lodi Electric Utility (LEU) Rules and Regulations; and
WHEREAS, since 1989, a number of revisions have been approved by City Council, the
most recent of which was in 2012; and
WHEREAS, LEU staff has completed a more comprehensive review of the full suite of
LEU Rules and Regulations in response to continuous changes ín the electric industry,
including legislative and regulatory requirements, technological advances, and local
requirements; and
WHEREAS, LEU staff has presented the proposed changes to the City Council at public
meetings on November 27,2018, and June 11, 2019; and
WHEREAS, the proposed changes are in accordance with LEU's Strategic Plan
adopted by the City Council on October 4, 2017, whereby LEU will design, operate, and
maintain the distribution system to ensure reliable electric service.
NOW, THEREFORE, BE lT RESOLVED that the Lodi City Council hereby authorizes
and adopts revisions to the Lodi Electric Utility Rules and Regulations, a summary of which is
included as Exhibit A.
