RECOMMENDED ACTION Adopt resolution authorizing City Manager to execute Amendment No. 2
to Professional Services Agreement with Harris and Associates, lnc., of
Tracy, lor 2017 lmpact Mitigation Fee Program update, in the amount of
$10,000.
BACKGROUND INFORMATION: On August 15, 2012, City Council approved an updated lmpact Mitigation
Fee Program (IMFP). The IMFP establishes a schedule of fees for water,
wastewater, storm drainage, transportation, police, fire, parks, electric,
general city facilities, and art in public places. These fees are to pay for public improvements needed to
accommodate impacts resulting from new development. On October 16,2013, City Council approved an
amendment to the storm and parks fees. The City commissioned Harris and Associates, lnc. to prepare the new
IMFP in2012 and the amendment in 2013.
To conform with State law, the City must perform an update to the program every five years demonstrating a
reasonable relationship between the current impact fees and the purpose for which they are charged. To
comply with these requirements, the City entered into a Professional Services Agreement with Harris and
Associates, lnc., for 2017 IMFP update, in an amount not-to-exceed $40,000, on June 1 5,2017. On June 21,
2018, the City executed Amendment No. 1 to the Professional Services Agreement to extend the term of the
agreement through May 31 ,2019. The proposed Amendment No. 2 will again extend the term of the
agreement, while adding $10,000 to the not-to-exceed amount of $40,000, for a total not-to-exceed amount of
$50,000, within the existing scope of work. This amendment is necessary to complete the IMFP update as
required by State law.
Staff recommends authorizing City Manager to execute Amendment No. 2 to Professional Services Agreement
with Harris and Associates, lnc., of Tracy, lor 2017 lmpact Mitigation Fee Program update, in the amount of
$10,000.
FISCAL IMPAGT:IMFP revenues support the implementation of public infrastructure to serve new
development. Without impact revenues, other City funding sources would be
utilized.

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING
THE CITY MANAGER TO EXECUTE AMENDMENT NO, 2 TO
THE PROFESSIONAL SERVICES AGREEMENT WITH
HARRIS AND ASSOCIATES, INC., OF TRACY, FOR 2017
IMPACT MITIGATION FEE PROGRAM UPDATE
WHEREAS, on August 15, 2012, City Council approved an updated lmpact Mitigation
Fee Program (IMFP), establishing a schedule of fees for water, wastewater, storm drainage,
transportation, police, fire, parks, electric, general city facilities, and art in public places; and
WHEREAS, on October 16, 2013, City Council approved an amendment to the storm
and parks fees. The City commissioned Harris and Associates, lnc., to prepare the new IMFP
in 2012 and the amendment in 2013; and
WHEREAS, to conform with State law, the City must peform an update to the program
every five years demonstrating a reasonable relationship between the current impact fees and
the purpose for which they are charged. To comply with these requirements, the City entered
into a Professional Services Agreement with Harris and Associates, lnc., for 2017 IMFP update,
in an amount not to exceed $40,000, on June 15,2Q17, and on June 21,2018, the City
executed Amendment No. 1 to the Professional Services Agreement to extend the term of the
agreement through May 31, 2019; and
WHEREAS, staff recommends authorizing the City Manager to execute Amendment
No. 2 to Professional Services Agreement with Harris and Associates, lnc., of Tracy, for 2017
lmpact Mitigation Fee Program update, extending the term of the agreement and increasing the
not{o-exceed amount by $10,000.
NOW, THEREFORE, BE lT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to execute Amendment No. 2 to the Professional Services
Agreement with Harris and Associates, lnc., of Tracy, California, for the 2017 lmpact Mitigation
Fee Program update, extending the term of the agreement through May 31 , 2Q20, and
increasing the not{o-exceed amount by $10,000.
