BACKGROUND INFORMAT¡ON This project was awarded to F. Loduca Co., of Stockton, on June 20, 2018, in the amount of $394,596. The contract has been completed in substantial conformance with the plans and specifications. This project consisted of removing accessibility barriers near seven Grapeline bus stops, installing 16 curb ramps, and associated Americans with Disabilities Act (ADA)-compliant paths of travel to the bus stop locations that lacked accessibility. The project also installed shelters at five locations. Each new shelter included lighting, a bench, and a trash can. The locations of work are shown in Exhibit A. The final cost of the project was $402,202. The difference between the original contract amount and final contract amount is due to a slight increase in unit quantities for the City-requested repair concrete of sidewalk panels adjacent to the work, and additional work to preserve a previously unknown street light conduit. The original contract completion date was November 13,2018 and the actual contract completion date was May 15,2019. There were multiple reasons that the project was completed 183 days after the original date. The main reasons were that the contractor did not provide sufficient manpower to complete the work in the contract time limits, and that there were numerous components of the project that had to be reconstructed after they did not meet ADA and City standards. Staff advised the contractor numerous times that it was not on track to meet the contract schedule. No additional manpower; however, was implemented by the contractor to address the deficiency. Staff also provided the contractor's crews with multiple copies of the City's Standard Plans in order to increase the chances that it would construct the improvements correctly; however, numerous items still needed to be removed and replaced. There were multiple occasions where the Company's owner yelled at various City employees and tried blaming the City for its failure to complete the project in a correct and timely manner. The contractors' shortcomings and less than professional behavior is well-documented. Finally, multiple complaints were received from citizens and City employees regarding the contractor's poor noticing to neighbors, lack of traffic control, and unkempt construction sites. Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors that the project is complete and begins their 30-day period to file a stop notice requiring the City to withhold payments from the prime contractor in the event of a payment dispute.
