HomeMy WebLinkAboutResolutions - No. 2019-96RESOLUTION NO. 2019-96 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CITY MANAGER TO AWARD THE CONTRACT FOR WESTGATE DRIVE STREET IMPROVEMENT PROJECT TO THE LOWEST RESPONSIVE BIDDER; AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDERS; AND FURTHER APPROPRIATING FUNDS WHEREAS, the Westgate Drive Street Improvement Project consists of removing the center landscape median (including 18 red oak trees) on Westgate Drive from 450 feet south of Taylor Road to 300 feet north of Kettleman Lane, replacing the median space with asphalt concrete pavement, and other miscellaneous and related items of work; and WHEREAS, in February 2019, the City of Lodi Fire Department notified the Public Works Department that they would need access across the median to serve the subdivision since initial fire response will be coming from Fire Station No. 4, located on Lower Sacramento Road, north of the subdivision. This requirement will require up to three median openings or complete removal of the median to allow unrestricted emergency vehicle access to the Luca Place development; and WHEREAS, the Fire Department desires to have the project completed in anticipation of residents occupying the new homes in late summer of 2019; and WHEREAS, staff recommends that, in the interest of saving time, the City Council authorize the City Manager to award the contract for Westgate Drive Street Improvement Project to the lowest responsive bidder, in an amount not to exceed $100,000; and WHEREAS, staff also recommends that the City Council authorize the City Manager to execute change orders in an amount not to exceed $10,000; and WHERAS, staff also recommends the City Council appropriate funds in the amount of $100,000, from the fund balance of Streets Fund (30099000.77020) for Fiscal Year 2018/19. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to award the contract for Westgate Drive Street Improvement Project to the lowest responsive bidder, in an amount not to exceed $100,000; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute the contract on behalf of the City and to execute change orders in an amount not to exceed $10,000; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize an appropriation for the Westgate Drive Street Improvement Project, in the amount of $100,000, as set forth above; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to continue budget authority up to the full project budget for this project from fiscal year to fiscal year until such point as the project is complete and is accepted by Council. At such time, all unspent budget authority will return to the fund for re -appropriation by the City Council.
