BACKGROUND INFORMATION: On August 29, 2014, the California Legislature passed comprehensive groundwater legislation enacting the Sustainable Groundwater Management Act (SGMA). Governor Brown signed the legislation on September 16, 2014 and it became effective on January 1, 2015. SGMA requires the formation of groundwater sustainability agencies (GSA's) and the development and implementation of one or more groundwater sustainability plans (GSP's) for each groundwater basin categorized by the California Department of Water Resources (DWR) as high or medium priority. To address the possibility where a GSA might overlie two separate groundwater basins, DWR developed regulations to allow local agencies the opportunity to request that DWR consider modifying existing groundwater basin boundaries. In this case, the City of Lathrop GSA overlies portions of both the Tracy Subbasin and the Eastern San Joaquin Subbasin. This geographical condition requires Lathrop to develop two separate GSA's and two separate GSP's in order to comply with SGMA requirements. The City of Lathrop has requested letters of support from agencies within the Eastern San Joaquin Subbasin to facilitate the groundwater basin boundary modification request to locate the City of Lathrop entirely within the Tracy Subbasin. The basin modification will allow Lathrop to develop and implement a single GSA and GSP. The City of Lathrop is the third smallest city in San Joaquin County and its groundwater usage represents only 0.04 percent of the total groundwater use in the Eastern San Joaquin Subbasin. It is expected the request for the basin modification will have minimal impact on agencies in either affected subbasin. For this reason, Staff recommends Council approve a letter of support (Exhibit A) from the City of Lodi for the City of Lathrop groundwater basin boundary modification request. FISCAL IMPACT: Removing the City of Lathrop from the Eastern San Joaquin Subbasin will have a de minimis fiscal impact on the City of Lodi. APPROVED: SigitriPq Step chwab. Public Works Director Subject: City of Lodi Support for Basin Boundary Modification Request to be Filed by the City of Lathrop The purpose of this letter is to express City of Lodi's support for the basin boundary modification request ("Request") to be submitted by the City of Lathrop to the California Department of Water Resources ("DWR") pursuant to Basin Boundary Emergency Regulations ("Regulations"). We understand that the Request proposes to align the boundaries of the Tracy Subbasin (DWR 5-022.15) and the Eastern San Joaquin Subbasin (DWR 5-022.01) with the City's boundary and is based on a body of evidence that demonstrates that including the entire City within the Tracy Subbasin would promote sustainable groundwater management. This letter constitutes City of Lodi's support for the Request.
