A. Roll Call by City Clerk
An Informal Informational Meeting ("Shirtsleeve" Session) of the Lodi City Council was held
Tuesday, November 27, 2018, commencing at 7:04 a.m.
Present: Council Member Johnson, Council Member Kuehne, Mayor Pro Tempore Mounce,
and Mayor Nakanishi
Absent: Council Member Chandler
Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Ferraiolo
NOTE: Council Member Johnson participated in the meeting via teleconference.
B. Topic(s)
B-1 Review Proposed Updates to Lodi Electric Utility Rules and Regulations (EU)
Senior Power Engineer Hasan Shahriar provided a PowerPoint presentation regarding Lodi
Electric Utility rules and regulations update. Specific topics of discussion included background; list
of rules and regulations; summary of changes; proposed changes to Rule No. 1 (Point of
Interconnection) - new definitions, updated definitions, history and map of Downtown District,
public outreach and timeline, benefits, impact, and conditions of compliance; proposed changes
to Rule Nos. 2 through 22; and history of changes.
In response to Council Member Johnson, Mr. Shahriar stated he would provide Council an
estimate of how much of the downtown has the point of interconnection for multiple businesses
housed and locked behind one business versus having the point of interconnection for multiple
businesses in the open and accessible to Utility staff. Mr. Shahriar added there are also a number
of electrical wires that run underground and through basements of businesses, which makes it
difficult for staff to access. He used the example of the Lodi Beer Company, which is currently
doing tenant improvements, that agreed to cage the section with the main electrical panel and
create a staircase and street access for Utility staff to get to the panel.
In response to Mayor Pro Tempore Mounce and Council Member Kuehne, City Manager
Schwabauer stated the current solution to the tangled mess of electric wires and points of
interconnection is to gain access to businesses where panels are locked behind gates or in
basements and to make those changes when businesses make improvements to their properties
over a certain value. Mayor Pro Tempore Mounce expressed concern that this approach places a
burden on business owners that could put them out of business. Mr. Schwabauer explained that
these improvements to the Utility system, including replacing the aging infrastructure in the near
future, must be done and the question becomes who pays for it: rate payers or business owners
operating at these locations. Mayor Pro Tempore Mounce suggested a third way to pay for the
improvements: a bond that would be paid back over time by the affected businesses as a group.
Mayor Pro Tempore Mounce stated it was difficult discussing the rule changes without seeing the
amended rules, to which City Attorney Magdich assured Council that a red -line version of the
rules and regulations will be provided to Council when it comes before it for approval.
Mr. Schwabauer added that the goal was to bring this to Council in December for approval;
however, it will likely be pushed out further to give staff time to look into the concept of a bond to
pay for the upgrades and what that cost would be.
Council Member Kuehne stated he is supportive of Mayor Pro Tempore Mounce's suggestion that

the area of service pay for the upgrades as a whole, depending on what the final numbers are
and questioned how that would work. Mr. Schwabauer explained that the cost would be paid
through a municipal bond secured by rates for standard participation. Council Member Kuehne
stated he is not fond of bonds; however, this work must be done and this option would make it
less painful on businesses and would focus on the area receiving the benefit. He reiterated his
support, pending the final figures.
Myrna Wetzel, member of the public, questioned if downtown Lodi was strictly commercial use
because there are residential units above businesses, to which Mr. Schwabauer responded that
downtown is a mixed use corridor that includes commercial and residential. Changes to the rules
would apply to the residential units located downtown, but not residences outside of the area.
Alex Aliferis suggested that potential costs be added to each of the rule changes and stated that
greater effort should be made to get business owner participation on these proposed changes.
Mayor Nakanishi pointed out that the downtown property owners had an opportunity to attend a
meeting on the issue, but only one person participated. Mr. Schwabauer stated staff will meet
with downtown businesses again if there are new concepts brought forward.
Mayor Pro Tempore Mounce further suggested another Shirtsleeve Session to discuss options on
paying for the upgrades, in addition to a meeting with downtown owners to get their feedback on
paying for the improvements.
Mayor Nakanishi stated that a Town Hall meeting may be a better option than an early morning
Shirtsleeve Session.

No action was taken by the City Council. The meeting was adjourned at 7:59 a.m.

RECOMMENDED ACTION: Review proposed updates to Lodi Electric Utility Rules and
Regulations.
BACKGROUND INFORMATION
On March 1, 1989, the City Council adopted Resolution No. 89-29
approving Lodi Electric Utility (LEU) Rules and Regulations that
determine how the utility will furnish electric service to any premises
within the corporate limits of the City.
From time to time, updates have been made to these Rules and Regulations based on changes in the
electric utility industry such as, legislative and regulatory requirements, technological advances, and local
requirements. Attachment A lists the historical updates as adopted by the City Council.
A comprehensive review of the full suite of LEU Rules and Regulations has been completed. Updates
include non -substantial typographical, formatting, and reference -related issues. Staff also recommends
clarifications and/or additions for the following items: 1) utility easements; 2) temporary service
availability; 3) vegetation management; 4) inspections and testing; 5) bill adjustments; 6) service ties; 7)
infrastructure responsibility and ownership; 8) energy data; 9) customer -owned parallel generation
facilities; and 10) point of interconnection in the downtown district.
Staff will provide the Council with the details regarding the aforementioned recommended changes.
