BACKGROUND INFORMATION: This agreement modifies the existing Statement of Benefits between the City and Lodi Fire Mid -Management. The current contract is effective January 1, 2018 through June 30, 2019. During the negotiation process, Fire Mid -Management agreed to a cost-sharing agreement; however, they desire to amend the language that was included in the Statement of Benefits to provide them with the ability to negotiate a different cost-sharing agreement and to eliminate language about the unilateral elimination of any salary adjustment. In addition, upon review of the Statement of Benefits, staff accidentally left out the Article for the Special Leave bank as approved by Council and as presented by staff during the Council meeting on October 17, 2018. Adele Post, Human Resources Manager p ty City Manager/Internal Services Director u APPROVED: K drew ysDe chwabaity Manager Side Letter Agreement Amending the Statement of Benefits Between the City of Lodi and Lodi Fire Mid -Management January 1, 2018 — June 30, 2019 This agreement is entered into between the City of Lodi, a municipal corporation ("City"), and Lodi Fire Mid -Management ("LFMM"). WHEREAS, the Statement of Benefits between LFMM and the City has a term of January 1, 2018 through June 30, 2019; and WHEREAS, the Statement of Benefits provides for a 3% salary adjustment for employees entering a cost-sharing agreement to pay 3% of the employer's normal pension cost of Ca1PERS; and WHEREAS, the City and LFMM mutually agree that should LFMM wish to negotiate a different cost-sharing agreement, or to eliminate the cost-sharing, the parties would negotiate any change to the 3% salary adjustment and it would not be unilaterally eliminated. Representatives from the City and from LFMM have met and conferred regarding Article 1.1 and Article 10.5 of the LFMM Statement of Benefits, and mutually agree to the following amendments: ARTICLE I - SALARY 1.1 Effective August 27, 2018, the City shall increase the salary ranges by three percent (3%) in exchange for a Ca1PERS cost sharing agreement pursuant to California Government Code §20516; whereby Fire Mid -Management employees agree to pay three percent (3%) of the employer's normal pension cost of Ca1PERS. The parties agree that should the parties negotiate the elimination of the three percent (3%) cost-sharing by the employee, the corresponding three percent (3%) salary adjustment by the City shall also is subject to reduction, elimination or change through the negotiation process. 1.4 Effective as soon as administratively possible after the approval of the Statement of Benefits by the City Council. each member of this bargaining unit will receive a special bank of non-cashable leave to be used by December 31. 2019. Non shift employees will receive 80 hours and shift employees will receive 112 hours. All leave not used by December 31, 2019 will be forfeited. ARTICLE X - RETIREMENT 10.5 Effective as soon as administratively possible, but no earlier than April 1, 2019, in accordance with California Government Code §20516 contract amendment process requirements, each employee in this unit shall pay three percent (3%) towards the employer's share of Ca1PERS normal pension cost (cost-sharing). In exchange, the City shall provide a three percent (3%) salary adjustment. The parties agree that should the parties negotiate the elimination of the three percent cost-sharing by the employee, the corresponding salary adjustment is subject to reduction, elimination or change through the negotiation process All other provisions of the MOU remain in full force and effect. MAGDICH City Clerk City Attorney RESOLUTION NO. 2018-251 A RESOLUTION OF THE LODI CITY COUNCIL AMENDING THE STATEMENT OF BENEFITS BETWEEN THE CITY OF LODI AND THE LODI FIRE MID -MANAGEMENT THROUGH A SIDE -LETTER AGREEMENT EFFECTIVE JANUARY 1, 2018 THROUGH JUNE 30, 2019 WHEREAS, the Lodi City Council approved a successor Statement of Benefits with Lodi Fire Mid -Management (LFMM) Unit on October 17, 2018, that provided for a cost-sharing agreement of the employer's share of normal retirement costs pursuant to Government Code §20516 CaIPERS retirement; and WHEREAS, LFMM wishes to amend the language of the Statement of Benefits to provide for the ability to negotiate a different cost-sharing agreement that would not unilaterally eliminate the salary adjustment during future negotiations; and WHEREAS, the City wishes to amend the language to allow for the negotiation of a different cost-sharing agreement with LFMM; and WHEREAS, the City wishes to amend the language in the Statement of Benefits to include a special bank of leave that was negotiated and agreed upon but was inadvertently omitted from the agreement as approved by Council on October 17, 2018; and WHEREAS, it is recommended that Council approve revisions to the Statement of Benefits with LFMM through a Side -Letter Agreement. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby approve the attached Side -Letter Agreement (Exhibit A) between the City of Lodi and Lodi Fire Mid -Management.
