HomeMy WebLinkAboutResolutions - No. 2018-198RESOLUTION NO. 2018-198 A RESOLUTION OF THE LODI CITY COUNCIL OPPOSING SAN JOAQUIN COUNTY'S COUNTY COMMERCIAL CANNABIS BUSINESS TAX: MEASURE B WHEREAS, Measure B, the San Joaquin County Commercial Cannabis Business Tax, will adversely impact the health and safety in cities and unincorporated communities; and WHEREAS, cannabis cultivation and other commercial cannabis activities have been a magnet for thefts, robberies, illegal firearms, shootings, and homicides; and WHEREAS, the San Joaquin County Sheriff's Office has eradicated 612,938 cannabis plants between 2011 and 2017, resulting in over 80 arrests and seizure of 45 firearms, equipment, and over $125,000 in cash; and WHEREAS, both outdoor and indoor grows require Targe amounts of water, which is sometimes illegally diverted from farms, homes, wells, or waterways; and WHEREAS, indoor grows require extensive energy consumption, which is often illegally consumed and/or wired in an improper and dangerous manner; and WHEREAS cannabis cultivation is harmful to the welfare of residents, creates a nuisance, threatens the health and safety of nearby landowners and their families, has caused millions of dollars in environmental damage and cleanup, and may contain armed guards and/or booby trap devices that threaten severe bodily harm or death to those who attempt to access them; and WHEREAS, the passage of Measure B will never produce the promised revenues or programs offered; and WHEREAS, if cannabis cultivation is not banned to the extent possible under state law then large quantities of illegal cannabis may be introduced into the local market and will bring with it increasing threats to public peace, health, and safety. NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that it has a compelling interest in protecting the public health, safety, and welfare of its residents and businesses, in preventing the establishment of cannabis businesses in the County, while also allowing the consumption of medical cannabis for all residents pursuant to the Compassionate Use Act of 1996 and the Medical Marijuana Program Act and consumption of adult use cannabis pursuant to the Adult Use of Marijuana Act; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby oppose the San Joaquin County's County Commercial Cannabis Business Tax: Measure B.
