Public hearing to consider introducing an ordinance
reducing the amount of residential Growth Management
Allocations currently available in the program.
BACKGROUND INFORMATION: The City's Growth Management Program was instituted
by Ordinance 1521 in 1991. The allocation system gives
priority through point assignments to projects that reduce
impacts on services, infrastructure, and resources. The ordinance sets an annual growth limit of two
percent of the City's population, compounded annually. Once the amount of allocation units is
figured, the City requires that the allocation of units be distributed among housing types as follows:
44 percent low density, 28 percent medium density and 28 percent high density.
The Growth Management Ordinance includes a priority location area and a point system to assist
the City with prioritizing issuance of growth management allocations. The priority location area
designates lands available for development and provides development categories and priority area
based on availability of city services (e.g., water, wastewater, storm drains, streets, police, fire and
parks). The system was established to rate projects based on various project merits in order to
determine if one project should be approved before another, particularly if there are more allocation
requests than there are available allocations.
Because the City has issued growth management allocations at a rate less than what the ordinance
allows, surplus allocations have accumulated. The City Council is being asked to review the number
of unused allocations. As of 2018, that number is 3,835 units across the three density categories.
Arguably, it would be nearly impossible for all of these units to be used in any given year, or number
of years for that matter. The concern that may be more realistic is the perception of the potential
pace of growth.
The City Council should consider an action to expire a certain number of unused allocations in the
three density categories. The current allocation program has been suspended since 2012 and staff
processed growth management requests at any time during the year as long as there are unused
allocations in reserve. The formal Growth Allocation program will be reinstated in 2020.
The California Department of Finance (DOF) estimates the City population for January 1st of each
year. Identified below are original populations estimates received and revised numbers that were
provided at later dates. Staff is not entirely clear on the DOF's methodology of calculating
population. DOF states that it is based upon constructed dwelling units and adjusted based upon

residents per structure type. The population appears to be generated at a rate exceeding our actual
construction of residences within the past few years.

Since 2010 the City has had an average growth rate of 0.86%.
Growth Allocations for 2013 and 2014 were higher because the persons per household was lower.
New Department of Finance numbers show Lodi at 2.85 persons per household in 2015 compared
with 2.7 in the past.
The City of Lodi has finaled the following residential units per year.

The following calculation explains the current City population of 67,121 as of January 1, 2018 and
471 units available for 2018:
1. Calculate two percent of the City's current population: 67,121 x 2% = 1,342.42
2. Divide 1,342 by the average number of persons per household 1,342 / 2.85 = 470.87
3. Divide the 470.87 (471 du) units into the 3 housing types:
44% low density = 207 units
28% medium density = 132 units
28% high density = 132 units.

In 2012, the City Council expired allocations accumulated since 2008. In the five-year period since
2008, 2,235 allocations were added to the reserve. The Council eliminated 800 Low Density and
1,435 High Density allocations. This Council action created a new balance of 4,674 as detailed
below in Table A.

In 2017, the City Council expired allocations accumulated since 2013. The Council eliminated 1,056
Low Density allocations. This Council action created a new balance of 4,085 as detailed below in
Table G.

Based upon what allocations have been issued since 2012 and the amount of land currently
available in Lodi, the 2,113 Low Density and 3,835 overall growth allocations are more than what the
Council could issue in the upcoming years. More importantly, Lodi does not currently have the land
available to allocate that many growth allocations.
The following table identifies how many allocations are available in 2018 and then how many
allocations would be typical for one, two, three, four and five years' worth of allocations.

RECOMMENDED DIRECTION
Staff would recommend that a minimum of four years' worth of allocations be maintained for the
medium and high density allocations. Staff also recommends that six years' worth of allocations be
maintained in the low density allocation category. This will allow the Council flexibility in working
with the development community on future projects.
The reduction of 1,273 allocations to a working total of 2,562 is a significant reduction in total
allocations.
The recommendation was reviewed by the Development Community/ Building Industry Association and
they fully support the recommendation. This recommendation was also reviewed by the Planning
Commission and they supported annual reviews of the Growth Allocation process.

EXPIRING 1,273 UNUSED RESIDENTIAL GROWTH
ALLOCATIONS
WHEREAS, the Lodi City Council adopted Ordinance No. 1521 in 1991 establishing a
Growth Management Plan for residential development within the City of Lodi; and
WHEREAS, the Ordinance sets an annual growth limit of two percent (2%) of the City's
population, compounded annually, and once the number of allocable units is figured, the City
requires that the allocation units be distributed among housing types as follows: 44 percent low
density, 28 percent medium density, and 28 percent high density (General Plan GM -P4); and
WHEREAS, there are currently 3,835 Growth Allocations including 2,113 Low Density
Allocations, 770 Medium Density Allocations and 952 High Density Allocations; and
WHEREAS, based upon the amount of land currently available in Lodi, the current
growth allocations are more than what the Council could issue in the upcoming years; and
WHEREAS, staff recommends that 871 Low Density Allocations, 110 Medium Density
Allocations and 292 High Density Allocations be eliminated from the Growth Management
Program, leaving a balance of 2,552 Allocations.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS:
SECTION 1.
That 871 Low Density Allocations, 110 Medium Density Allocations and 292 High
Density Allocations be expired and eliminated and the remaining balance of allocations for 2018
be as follows:
a) 1,242 Low -Density Allocations
b) 660 Medium -Density Allocations
c) 660 High -Density Allocations
TOTAL 2,562 Allocations
SECTION 2. No Mandatory Duty of Care. This Ordinance is not intended to and shall not be
construed or given effect in a manner that imposes upon the City or any officer or employee
thereof a mandatory duty of care towards persons and property within or without the City, so as
to provide a basis of civil liability for damages, except as otherwise imposed by law.
SECTION 3 Severability. If any provision of this ordinance or the application thereof to any
person or circumstances is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are severable. This City Council
hereby declares that it would have adopted this ordinance irrespective of the invalidity of any
particular portion thereof and intends that the invalid portions should be severed and the
balance of the ordinance be enforced.
SECTION 4. Effective Date and Publication. This uncodified Ordinance shall take effect thirty
(30) days after its adoption. In lieu of publication of the full text of the ordinance within fifteen
(15) days after its passage, a summary of the ordinance may be published at least five (5) days
prior to and fifteen (15) days after adoption by the City Council, and a certified copy shall be
posted in the office of the City Clerk pursuant to Government Code section 36933(c)(1).

AN UNCODIFIED ORDINANCE OF THE LODI CITY COUNCIL LEVYING AND
APPORTIONING THE SPECIAL TAX IN TERRITORY ANNEXED TO COMMUNITY
FACILITIES DISTRICT NO. 2007-1 (PUBLIC SERVICES) (ANNEXATION NO. 7). The purpose
of this ordinance is to levy and apportion the special tax within the territory annexed into the
Community Facilities District No. 2007-1 (Public Services) as Annexation No. 7. Introduced
August 1, 2018. Adopted August 15, 2018, and effective September 14, 2018. AYES: Chandler,
Johnson, Kuehne, and Mayor Nakanishi; NOES: None; ABSENT: Mounce.
ORDINANCE NO. 1957
AN UNCODIFIED ORDINANCE OF THE LODI CITY COUNCIL REVISING THE GROWTH
MANAGEMENT ORDINANCE BY EXPIRING 1,273 UNUSED RESIDENTIAL GROWTH
ALLOCATIONS. The purpose of this ordinance is to reduce the number of Residential Growth
Management Allocations currently available in the program. Introduced August 15, 2018.
Adoption to be considered September 19, 2018. AYES: Chandler, Johnson, Kuehne, and
Mayor Nakanishi; NOES: None; ABSENT: Mounce.

invited to present their views and comments on this matter. Written statements may be
filed with the City Clerk, City Hall, 221 West Pine Street, 2nd Floor, Lodi, 95240, at any
time prior to the hearing scheduled herein, and oral statements may be made at said
hearing.
