AGENDA TITLE: Authorize City Manager to Execute Lease Agreement with West Coast PCS LLC,
dba RCS Wireless, at Water Tower, 125 North Stockton Street
MEETING DATE: May 3, 2000

RECOMMENDED ACTION: That the City Council authorize the City Manager to execute a lease
agreement with West Coast PCS LLC, dba RCS Wireless, for the purpose
of installing a small equipment building on City property and erecting
antenna on the City's elevated water tank.
BACKGROUND INFORMATION: A representative for RCS Wireless recently approached the City
about placing antenna on the water tower on Main Street. There is
an existing lease with AirTouch Cellular for the use of the water
tower; however, that lease allows another provider to use the tower
with the written permission of AirTouch. The RCS antenna will be located below the existing AirTouch
equipment at approximately 85 feet on the tower. Their ground equipment will be located on the
northwest of the tower, inside the fenced area. Wires will run up the inside of the tower and will not be
easily visible. RCS will lease 200 square feet of ground space. This is one-half the ground space that
AirTouch leases.
The terms of the lease with RCS are the same as the most recent communication leases. RCS will pay
the City a $2,500 processing fee, $728 per month rent with a 4% escalation each year, and post a
$25,000 performance bond. The performance bond is a new requirement of our leases for
communication equipment. They will also be responsible for their pro rata share of the costs to improve
the Main Street site frontage, i.e., new sidewalk, fencing or landscaping, at the appropriate time.
RCS will take out a building permit and satisfy any structural or code requirements regarding
attachments to the tower.
The City Attorney will review and approve the proposed lease once Council gives approval to proceed.
FUNDING: Not applicable. Lease will provide the City with additional revenue of $8,736 per year.

RECOMMENDED ACTION: That the City Council authorize the City Manager to execute a lease
agreement with West Coast PCS LLC, dba RCS Wireless, subject to
receipt of AirTouch Cellular's approval, for the purpose of installing a small
equipment building on City property and erecting antenna on the City's
elevated water tank.
BACKGROUND INFORMATION: This is supplemental information in addition to the
Council Communication that is part of the Council packet.
AirTouch Cellular has an existing lease for location of antennae
on the water tower. According to their lease, they have the right
to object to the location of any other facilities on the water tower. AirTouch has 30 days from receipt of
the request of RCS to co -locate to make any objection to the request. A non -response is considered
consent. AirTouch still has approximately 2 weeks of the 30 -day period to make their response;
however, indications are that they are agreeable.
The City Manager will be notified as soon as the response is received from AirTouch. If AirTouch
concurs with the location of additional antennae on the tower, RCS will submit the processing fee and
bond. At that time the City Manager will be able to execute the lease.
FUNDING: Nat applicable. Lease will provide the City with additional revenue of $8,736 per year.
