RECOMMENDED ACTION: Accept improvements under contract for Harney Lane Grade
Separation Project.
BACKGROUND INFORMATION: The Harney Lane Grade Separation Project was awarded to DeSilva
Gates Construction, LP, of Dublin, in the amount of $14,313,075, on
November 18, 2015. The contract has been completed in substantial
conformance with the plans and specifications approved by City Council on July 15, 2015. Pictures of the
completed work are provided in Exhibit A.
The project consisted of constructing, widening, and realigning Harney Lane, including the construction of
a new three -span, cast -in-place, post -tensioned concrete box girder, approximately 248 feet long and 88
feet wide, to grade separate Harney Lane at the Union Pacific Railroad (UPRR) track. Work included
signal modifications (temporary and permanent), drainage and utility installation, street lighting,
landscaping, constructing raised medians, curbs, gutters, and sidewalks, and other incidental and related
work, all as shown on the plans and specifications for the project.
The contract completion required the work to be completed in 535 calendar days, and the actual
completion was 502 calendar days, 33 days ahead of contract schedule. The roadway was open to public
use on December 22, 2017. The final cost of the contract was $15,067,228.89. The difference between
the original contract amount and final contract was due to 14 change orders, totaling $851,541.79, which is
six percent of the original contract amount.
Change Order No. 1 included cost associated with expediting the vineyard survey and demolition work to
meet contract requirements with the land owner ($8,285.00).
Change Order No. 2 included costs associated with Drainage System No. 9 changes, Sound Wall No. 1
pile changes, and lowering the bore pit for utilities under the UPRR tracks due to elevation of existing
petroleum pipeline ($75,327.32).
Change Order No. 3 included costs associated with time and materials work due to conflicts with existing
utilities requiring changes at the Valley Iron Works access road and installation of a new 10 -inch water
main ($92,133.18).
Change Order No. 4 included a new footing at the Valley Iron Works gate, increased demolition costs
related to the transite water main in Harney Lane, drainage system changes for temporary drainage, City
requested changes to traffic signal controls, and added north -slope protection ($170,065.86).
Change Order No. 5 included removing the contract and payment for UPRR flagging from the construction
contract, as requested by UPRR. Costs were paid directly by the City to UPRR ($168,000.00 CREDIT).
Change Order No. 6 included work related to the saturated slide of the north -slope soil onto Harney Lane.
Slope protection, additional traffic control, and protection modifications were required due to abnormally
wet weather conditions ($51,387.14).

Change Order No. 7 included continued north -slope protection measures, added two strands of barbed
wire to the temporary cherry orchard security fence, additional grading at Sound Wall No. 1 footings and
additional Stage 2B Traffic Control requested by City traffic engineer ($53,351.28).
Change Order No. 8 included removal and replacement of unsuitable soil near Winchester Drive, additional
Stage 2C Traffic Control, and removal of two small trees near Banyan Drive, conflicting with electrical lines
($78,241.53).
Change Order No. 9 included the extension of Sound Wall No. 2 to the bridge deck, a total of
approximately 214 lineal feet of footings and 1,430 square feet of concrete masonry unit wall, as requested
by City staff ($173,662.35).
Change Order No. 10 included changes to the Stage 1A/1C Roadway Structural Section, additional
pavement on South Stockton Street to Rocky Lane, grading changes at Driveway No. 8, and premium time
costs for asphalt placement on Sunday November 19, 2017, to stay ahead of forecast wet weather
($154,961.18).
Change Order No. 11 included adding approximately 2,300 lineal feet of chain link fence at the back of
sidewalk, as requested by City staff, and replacement of Valley Iron Works decorative fence posts
($62,706.65).
Change Order No. 12 included time -and -materials work, including grading under the bridge structure
adjacent to the UPRR tracks, as required by UPRR, completion of temporary drainage related work, and
various other items of work to complete the project, as requested by City staff ($147,091.64).
Change Order No. 13 included a credit for revised curb detail at existing asphalt locations ($25,567.34
CREDIT).
Change Order No. 14 included a credit for City incurred costs related to Public Utility Easements
associated with six utility vault installation locations ($22,104.00 CREDIT).
There were also adjustments to the quantities of unit items installed, totaling a reduction in the final
contract amount by $97,387.65. A complete breakdown, and supporting documentation, of each change
order is on file in the Public Works department.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to inform vendors and subcontractors
that the project is complete and to initiate the 30 -day period to file a stop notice requiring the City to
withhold payments from the prime contractor in the event of a payment dispute.
FISCAL IMPACT:
FUNDING AVAILABLE:
There will be a slight increase in the long-term maintenance of the
streetlights, landscape, and streetscape, and a short-term decrease in
street maintenance costs.
This project was funded with Regional Surface Transportation Program
(30799000), State Transportation Improvement Program (30799000), Section
190 (30799000), Union Pacific Railroad Contribution (30799000), Regional
Transportation Impact Fee (31499000), and Measure K (30399000) Funds.
