AGENDA TITLE: Ordinance No. 1949 Entitled, "An Ordinance of the Lodi City Council Establishing
and Implementing By -District Elections and Amending Chapter 1.12 of the
Lodi Municipal Code to Provide for City Council Elections by District"

BACKGROUND INFORMATION: Ordinance No. 1949 entitled, "An Ordinance of the Lodi City Council
Establishing and Implementing By -District Elections and Amending
Chapter 1.12 of the Lodi Municipal Code to Provide for City Council
Elections by District," was introduced at the regular City Council meeting of February 21, 2018.
ADOPTION: With the exception of urgency ordinances, no ordinance may be passed within five days of
its introduction. Two readings are therefore required — one to introduce and a second to adopt the
ordinance. Ordinances may only be passed at a regular meeting or at an adjourned regular meeting;
except for urgency ordinances, ordinances may not be passed at a special meeting. Id. All ordinances
must be read in full either at the time of introduction or at the time of passage, unless a regular motion
waiving further reading is adopted by a majority of all council persons present. Cal. Gov't Code § 36934.
Ordinances take effect 30 days after their final passage. Cal. Gov't Code § 36937.
This ordinance has been approved as to form by the City Attorney.

AN ORDINANCE OF THE LODI CITY COUNCIL
ESTABLISHING AND IMPLEMENTING BY -DISTRICT
ELECTIONS AND AMENDING CHAPTER 1.12 OF THE
LODI MUNICIPAL CODE TO PROVIDE FOR
CITY COUNCIL ELECTIONS BY DISTRICTS
WHEREAS, the City of Lodi supports the full participation of all citizens in electing
members of the City Council; and
WHEREAS, the City of Lodi currently elects its five (5) members of the City Council
using an at -large election system, where candidates may reside in any part of the City and each
member of the City Council is elected by the voters of the entire City; and
WHEREAS, California Government Code Section 34886u permits the City Council to
change the City's method of election by ordinance to a "by -district" system in which each
member of the City Council is elected only by the voters in the district in which the candidate
resides, in accordance with the California Government Code section 34871(c); and
WHEREAS, under the provisions of California Elections Code Section 10010, a city that
changes from an at -large city council method of election to a by -district city council method of
election requires a total of five public hearings, which includes at least two public hearings
regarding potential voting district boundaries prior to the release and consideration of any draft
voting district maps, and two public hearings following the release of draft voting district map(s);
and
WHEREAS, at a regular meeting of the City Council held on December 12, 2017, the
City Council adopted Resolution No. 2017-223 that initiated the process of establishing a
by -district election system and adopted the timeline for implementation; and
WHEREAS, thereafter, at regular meetings of the City Council held on
December 20, 2017 and January 17, 2018, pursuant to California Elections Code
Section 10010(a)(1), the City Council held public hearings where the public was invited to
provide input regarding the composition of the City's voting districts before any draft maps were
drawn, and the City Council considered and discussed the same; and
WHEREAS, at a regular meeting of the City Council held on December 20, 2017, the
City Council adopted Resolution No. 2017-232 setting forth the mandatory and permissive
criteria to be considered when drawing voting district maps; and
WHEREAS, thereafter at special and regular meetings of the City Council held on
January 31, 2018 and February 7, 2018, respectively, pursuant to California Elections Code
Section 10010(a)(2), the City Council held public hearings where the public was invited to
provide input regarding the content of the draft maps that had been released at least seven (7)
days before each meeting, as well as the proposed sequence of elections, and the City Council
considered and discussed the same; and
WHEREAS, at the special meeting of the City Council of the City of Lodi held on
February 13, 2018, the City Council directed staff to draft an ordinance adopting the voting
district map known as Map 119d and a sequence of elections whereby Council Districts D1, D2,
and D3 seats will be placed on the 2018 ballot, and Council Districts D4 and D5 seats on the
2020 ballot; and

WHEREAS, at a regular meeting of the City Council held on February 21, 2018, the
City Council held a final public hearing on the proposal to establish district boundaries, reviewed
additional public input, formally selected the voting district map and the election sequence
attached to, incorporated in, and set forth in this Ordinance, which was introduced for the first
reading at the same regular meeting of the City Council; and
WHEREAS, at the regular meeting of the City Council held on March 7, 2018, the City
Council conducted a second reading to adopt this Ordinance; and
WHEREAS, the purpose of this Ordinance is to enact, pursuant to California
Government Code Section 34886, an ordinance providing for the election of members of the
City Council of the City of Lodi by -district in five single -member districts, as reflected in Exhibit A
to this Ordinance, in furtherance of the purposes of the California Voting Rights Act of 2001
(Chapter 1.5 (commencing with Section 14025) of Division 14 of the Elections Code) and to
implement the guarantees of Section 7 of Article 1 and of Section of Article II of the California
Constitution.
NOW, THEREFORE BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS:
Section 1. The foregoing recitals are true and correct.
Section 2. The City of Lodi is hereby divided into five (5) Council districts and the
boundaries of the districts are more particularly depicted in Exhibit A, which is attached hereto
and incorporated by this reference.
Section 3. Chapter 1.12 of the Lodi Municipal Code is hereby amended by adding new
Sections 1.12.040, 1.12.050, 1.12.060, and 1.12.070 to read as follows:
1.12.040 By -District Electoral System.
Pursuant to California Government Code Section 34886 and the schedule established in
Section 1.12.060 of this Chapter, beginning in November 2018, members of the City
Council shall be elected on a by -district basis from five (5) single -member Council
Districts. The City's by -district electoral system shall be conducted in accordance with
California Government Code Section 34871(c).
1.12.050 Establishment of City Council Electoral Districts.
A. Pursuant to Section 1.12.040 of this Chapter, members of the City Council shall
be elected on a by -district basis, as that term is defined in California Government Code
Section 34871(c), from the five Council Districts as established and amended from time
to time by ordinance, and numerically designated as District 1, District 2, District 3,
District 4, and District 5.
B. Members of the City Council shall be elected in the electoral districts established
by this Section and subsequently reapportioned pursuant to applicable State and federal
law.
C. Except as provided in subdivision D herein and notwithstanding any other
provision of this Chapter, once this Ordinance is fully phased in, the member of the
City Council elected or (in the event of a vacancy filled by the City Council) appointed to
represent a district must reside in that district and be a registered voter in that district,
and any candidate for City Council must live in, and be a registered voter in, the district
in which he or she seeks election at the time nomination papers are issued, pursuant to
California Government Code Section 34882 and Elections Code Section 10227.

Termination of residency in a district by a member of the City Council shall create an
immediate vacancy for that Council district unless a substitute residence within the
district is established within thirty (30) days after the termination of residency.
D. Notwithstanding any other provisions of this Section, and consistent with the
requirements of California Government Code Section 36512, the members of the
City Council in office at the time of the Ordinance codified in this Chapter takes effect
shall continue in office until the expiration of the full term to which he or she was elected
and until his or her successor is qualified. At the end of the term of each member of the
City Council, that member of the City Council's successor shall be elected on a
by -district basis in the districts established in this Section and as provided in
Section 1.12.060 of this Chapter.
1.12.060 Election Schedule.
Except as otherwise required by California Government Code Section 36512, the
members of the City Council shall be elected from Council Districts D1, D2, and D3
beginning at the General Municipal Election in November 2018, and every four years
thereafter, as such Council Districts may be amended from time to time by ordinance of
the City Council. Members of the City Council shall be elected from Council Districts D4
and D5 beginning at the General Municipal Election in November 2020, and every four
years thereafter, as such Council Districts may be amended from time to time by
ordinance of the City Council.
1.12.070 Map of Council Districts.
The City Clerk shall maintain a map of the city showing the current boundaries and
numbers of each city council district as may be established and amended from time to
time by ordinance of the City Council.
Section 4. If necessary to facilitate the implementation of this Ordinance, the City Clerk is
authorized to make technical adjustments to the district boundaries that do not substantively
affect the population in the districts, the eligibility of candidates, or the residence of elected
officials within any district. The City Clerk shall consult with the City Manager and City Attorney
concerning any technical adjustments deemed necessary and shall advise the City Council of
any such adjustments required in the implementation of the districts.
Section 5. Severability, If any section, subsection, subdivision, paragraph, sentence, clause
or phrases of this Ordinance or any part thereof is for any reason held to be unconstitutional or
invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the
validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The
City Council of the City of Lodi hereby declares that it would have passed each section,
subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact
that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or
phrases be declared unconstitutional or invalid or ineffective.
Section 6. No Mandatory Duty of Care. This ordinance is not intended to and shall not be
construed or given effect in a manner which imposes upon the City, or any officer or employee
thereof, a mandatory duty of care towards persons or property within the City or outside of the
City so as to provide a basis of civil liability for damages, except as otherwise imposed by law.
Section 7. CEQA. This Ordinance is exempt from the requirements of the California
Environmental Quality Act (CEQA) pursuant to Government Code Section 15060(c)(2) (activity
will not result in a direct or reasonable foreseeable indirect physical change in the environment),

Section 15060(c)(3) (the activity is not a project as defined in Section 15378), and
Section 15061(b)(3) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because it has no potential for causing a significant effect on the environment.
Section 8. Conflict. All ordinances and parts of ordinances in conflict herewith are repealed
insofar as such conflict may exist.
Section 9. Effective Date. This Ordinance shall be published one time in the "Lodi News
Sentinel," a daily newspaper of general circulation printed and published in the City of Lodi, and
shall be in force and take effect on April 7, 2018.

ACCION RECOMENDADA:
Un pedimento renunciando a que se diera lectura en su totalidad y
(posterior a la lectura por titulo) adoptando la Ordenanza No. 1949
que se anexa.
ANTECEDENTES: Ordenanza No. 1949 Titulada, "Una Ordenanza del Consejo
Municipal de Lodi Estableciendo e Implementando las Elecciones
Por -Distrito y Enmendando el Capitulo 1.12 del Codigo Municipal de
Lodi para estipular a las Elecciones del Consejo Municipal por Distrito," fue presentada durante la junta
regular del Consejo Municipal la cual se efectuo el 21 de Febrero de 2018.
ADOPCION: Con la excepcion de las ordenanzas de urgencia, ninguna ordenanza podra ser aprobada
dentro de cinco dias despues de su presentacion. Por lo tanto dos lecturas se requeriran — la primera
para presentarla, y la segunda para adoptar la ordenanza. Las ordenanzas pueden ser aprobadas
unicamente durante una junta regular o en una sesion regular aplazada; salvo para las ordenanzas de
urgencia, las ordenanzas no pueden ser aprobadas durante juntas especiales. Id. Todas las
ordenanzas deben ser recitadas en su totalidad ya sea durante el momento en que son introducidas o
durante el momento de ratificacion, a menos que se haga un pedimento renunciando a que se les de
lectura adicional y ese pedimento sea adoptado por la mayoria de todas las personas del Consejo

LAS ELECCIONES POR-DISTRITO Y MODIFICANDO LA
SECCION 1.12 DEL CODIGO MUNICIPAL DE
ELECCIONES PARA ESTIPULAR A LA VOTACION DEL
CONSEJO MUNICIPAL POR DISTRITOS
CONSIDERANDO QUE, la Ciudad de Lodi apoya la participacion completa de todos sus
ciudadanos en la eleccion de los miembros del Consejo Municipal; y
CONSIDERANDO QUE, la Ciudad de Lodi actualmente elige a sus cinco (5) miembros
del Consejo Municipal utilizando un sistema de eleccion general, en to cual los candidatos
pueden ser residentes de cualquier parte de la Ciudad y cada miembro del Consejo Municipal
es elegido por los votantes de todo el Municipio; y
CONSIDERANDO QUE, el Articulo 34886 del Codigo Gubernamental de California le
permite a la Ciudad cambiar su metodo de elecciones por ordenanza a un sistema por-distrito,
en el cual cada miembro del Consejo Municipal es elegido unicamente por los votantes del
distrito en que cada candidato vive, conforme al Articulo 34871(c) del Codigo Gubernamental
de California; y
CONSIDERANDO QUE, de acuerdo a las disposiciones del Articulo 10010 del Codigo
Electoral de California, una Ciudad que se cambia del metodo de elecciones generales para la
votacion del Consejo Municipal a un sistema de elecciones en base a distritos para el Consejo
Municipal, requiere un total de cinco audiencias publicas, cuales incluyen al menos dos
audiencias publicas pertinente a las demarcaciones de los distritos electorales antes de la
publicacion y consideracion de cualquier boceto de mapas de los distritos electorales, y dos
audiencias publicas subsecuente a la publicacion del boceto del/los mapa(s) de los distritos
electorales
CONSIDERANDO QUE, en la junta regular del Consejo Municipal que se efectuo el 12
de Diciembre de 2017, el Consejo Municipal adopto la Resolucion No. 2017-223 la cual inicio
el proceso para establecer un sistema de elecciones por-distrito, y adopto la cronologia para la
implementacion; y
CONSIDERANDO QUE, a partir de entonces, en las juntas regulares que efectuo el
Consejo Municipal el 20 de Diciembre de 2017 y el 17 de Enero de 2018, de acuerdo al Articulo
10010(a)(1) del Codigo Electoral de California, el Consejo Municipal celebro audiencias
publicas donde el publico fue invitado a aportar opiniones referente a la composicion de los
Distritos Electorales de la Ciudad antes de, que cualquier mapa fuese disenado, y el Consejo
Municipal dialogo y considero lo mismo; y
CONSIDERANDO QUE, en la junta regular del Consejo Municipal que se efectuo el 20
de Diciembre de 2017, el Consejo Municipal adopto la Resolucion No. 2017-232 exponiendo el
parametro obligatorio y permisivo que se debe considerar cuando se disenen los mapas de los
distritos electorales; y
CONSIDERANDO QUE, a partir de entonces, en las juntas regulares y especiales del
31 de Enero de 2018 y el 7 de Febrero de 2018, que celebro el Consejo Municipal,
respectivamente, conforme al Articulo 10010(a)(2) del Codigo Electoral de California, el
Consejo Municipal Ilevo a cabo audiencias publicas, a las cuales el publico fue invitado a

proporcionar opiniones referente al contenido de los bocetos de los mapas que fueron emitidos
por lo menos siete (7) dras antes de cada junta, al igual que la secuencia sugerida de las
elecciones, y el Consejo Municipal dialogo y considero lo mismo; y
CONSIDERANDO QUE, en la junta especial del Consejo Municipal de la Ciudad de Lodi
que se efectuo el 13 de Febrero de 2018, el Consejo Municipal instruyo al personal que
redactara una ordenanza adoptando el mapa del distrito electoral conocido como Mapa 119d y
una sucesion de las elecciones, a traves de los cuales, los puestos de los Distritos Concejales
D1, D2, y D3 seran colocados en la boleta electoral del 2018 y los puestos de los Distritos
Concejales D4, D5 en la boleta electoral del 2020; y
CONSIDERANDO QUE, en la junta regular que efectuo el Consejo Municipal el 21 de
Febrero de 2018, el Consejo Municipal celebro su Ultima audiencia publica sobre la iniciativa
para establecer las demarcaciones de los distritos, analizo opiniones adicionales del publico,
formalmente selecciono el mapa del distrito electoral y la sucesion de la eleccion adherida a,
incorporada en, y expuesta en esta Ordenanza, la cual fue presentada para la primer lectura
durante la junta regular del Consejo Municipal; y
CONSIDERANDO QUE, en la junta regular del Consejo Municipal que se Ilevara a cabo
el 7 de Marzo de 2018, el Consejo Municipal realizara una segunda lectura para adoptar esta
Ordenanza; y
CONSIDERANDO QUE, el proposito de esta Ordenanza es para decretar, conforme al
Articulo 34886 del Codigo Gubernamental de California, una ordenanza que prevea la eleccion
de los miembros del Consejo Municipal de la Ciudad de Lodi, por distrito en los cinco distritos
uninominales, tal como se refleja en el Documento de Prueba A de esta Ordenanza, en
cumplimiento con los propositos de la Ley de Derecho al Voto de California de 2001(Capitulo
1.5 (iniciando con la Seccion 14025) de la Division 14 del Codigo Electoral) y para implementar
las garantras de la Seccion 7 del Articulo 1 y la Seccion del Articulo II de la Constitucion de
California
AHORA, POR LO TANTO EL CONSEJO MUNICIPAL DE LA CIUDAD DE LODI
DECRETA LO SIGUIENTE:
Eprgrafe 1. Las afirmaciones antecedentes son correctas y verrdicas.
Epigrafe 2. Por el presente la Ciudad de Lodi es dividida en cinco (5) Distritos Electorales y
las demarcaciones de los distritos se representan mas particularmente en el Documento de
Prueba A, el cual esta anexo al presente e integrado mediante esta referencia.
Eprgrafe 3. Caprtulo 1.12 del Codigo Municipal de Lodi por el presente se enmienda,
mediante la incorporacion de las nuevas Secciones 1.12.040, 1.12.050, 1.12.060, y 1.12.070
con la siguiente redaccion:
1.12.040 Sistema Electoral Por-Distritos.
De acuerdo al Articulo 34886 del Codigo Electoral de California y la clausula establecida
en la Seccion 1.12.060 de este Caprtulo, iniciando en Noviembre de 2018, los miembros
del Consejo Municipal seran elegidos en cada Distrito, de los cinco (5) Distritos
Concejales uninominales. El sistema electoral por-distrito de la Ciudad se realizara de
acuerdo al Articulo 34871(c) del Codigo Gubernamental de California.

1.12.050 Institucion de los Distritos Electorales de la Ciudad.
A. Conforme a la Seccion 1.12.040 de este Capitulo, los miembros del Consejo
Municipal deberan ser elegidos de acuerdo a cada Distrito, en virtud de la definicion de
ese termino en el Articulo 34871(c) del Codigo Gubernamental de California, de los
cinco Distritos Concejales como se establecera y modificara ocasionalmente por la
ordenanza y han sido numericamente nombrados como Distrito 1, Distrito 2, Distrito 3,
Distrito 4 y Distrito 5.
B. Los miembros del Consejo Municipal deberan ser elegidos en los distritos
electorales instituidos por este Articulo y posteriormente redistribuidos conforme a ley
federal y estatal correspondiente.
C. Salvo a lo provisto en la subdivision D aqui dentro y sin perjuicio a cualquier otra
clausula de este Capitulo, una vez que esta Ordenanza sea introducida plenamente, el
miembro del Consejo Municipal electo o (en caso de que el Consejo Municipal cubra
una vacante) denominado para representar a un distrito debe residir en ese distrito y
debe ser un votante empadronado en ese distrito, y cualquier candidato para el Consejo
Municipal debe vivir en, y ser un votante empadronado en el distrito en el cual el o ella
aspira a ser elegido(a) en el momento en que se expidan los documentos de
nominacion, conforme al Articulo 34882 del Codigo Gubernamental de California y al
Articulo 10227 del Codigo Electoral. A la cesacion de residencia en un distrito de un
miembro del Consejo Municipal, debera generarse inmediatamente una vacante para
ese distrito Concejal a menos que un domicilio reemplazante se establezca dentro de
treinta (30) dias posterior a la terminacion de residencia.
D. Sin prejuicio a cualquier otra clausula en este Capitulo, y de acuerdo con los
requisitos del Articulo 36512 del Codigo Electoral de California, los miembros del
Consejo Municipal en funciones en el momento que entre en vigor la Ordenanza
codificada en este Capitulo deben continuar en el ejercicio de sus funciones hasta el
vencimiento de su mandato para el cual el o ella fue elegido(a) y, hasta que su sucesor
sea cualificado. A la conclusion del plazo de cada miembro del Consejo Municipal, ese
miembro sucesor del Consejo Municipal se elegira de acuerdo a cada distrito, dentro de
los distritos establecidos en este Capitulo y a lo provisto en el Articulo 1.12.060 de este
Capitulo.
1.12.060 Programacion para las Elecciones.
Salvo, que a menos lo exija el Articulo 36512 del Codigo Gubernamental de California,
para las Elecciones Generales Municipales iniciando en Noviembre 2018, los miembros
del Consejo Municipal se elegiran de los Distritos Concejales D1, D2 y D3 y cada cuatro
arms a partir de alli, como tal los Distritos Concejales pueden ser enmendados de vez
en cuando segun la Ordenanza del Consejo Municipal. Los miembros del Consejo
Municipal se elegiran de los Distritos Concejales D4 y D5 iniciando las Elecciones
Generales Municipales en Noviembre 2020 y cada cuatro anos a partir de alli, como tal,
los Distritos Concejales pueden ser enmendados ocasionalmente segun la Ordenanza
del Consejo Municipal
1.12.070 Mapa de los Distritos Concejales.
La actuaria Municipal mantendra un mapa de la ciudad que muestre las demarcaciones
actuales y los numeros de cada distrito concejal del municipio sea como fuere
establecido y enmendado ocasionalmente segun la ordenanza del Consejo Municipal

Epigrafe 4. Si fuese necesario para facilitar la implementacion de esta Ordenanza, el
Secretario Municipal esta autorizado a hacer ajustes tecnicos a las demarcaciones de los
distritos los cuales no afectaran substancialmente la populacion de los distritos, la elegibilidad
de los candidatos o Ia residencia de los funcionarios ya elegidos dentro de cualquier distrito. El
Secretario Municipal consultara con el Administrador del Municipio y el Fiscal Municipal
pertinente a cualquier ajuste tecnico que se considere necesario y asesorara al Consejo
Municipal de cualquier ajuste que se requiera para la implementacion de los distritos.
Epigrafe 5. Separabilidad. Si en cualquier seccion, subseccion, subdivision, parrafo,
oracion, clausula o frase de esta Ordenanza o cualquier otra parte de la misma, por cualquier
motivo se cree que es anticonstitucional o invalida o ineficaz ante cualquier tribunal de
jurisdiccion competente, tal decision no afectara la validez o eficacia de las partes restantes de
esta Ordenanza o cualquier parte de la misma. El Consejo Municipal de la Ciudad de Lodi por
el presente manifiesta que habria aprobado cada seccion, subseccion, subdivision, parrafo,
oracion, clausula o frase de la misma, independientemente del hecho de que cualquier, ya sea
una o mas secciones, subsecciones, subdivisiones, parrafos, oraciones, clausulas o frases
sean declaradas inconstitucionales, invalidas o ineficaces.
Epigrafe 6. No hay Deber de Proteger Obligatorio. Esta ordenanza no pretende ni debe de
interpretarse o darsele efecto de manera que se imponga sobre Ia Ciudad o cualquier
funcionario o empleado de la misma, un deber obligatorio de cuidado hacia las personas o
propiedades dentro del Municipio o fuera de la Ciudad con el fin de proporcionar un fundamento
de responsabilidad civil para danos, salvo a lo que establece la ley.
Epigrafe 7. CEQA. Esta Ordenanza esta exenta de los requisitos de la Ley de Calidad
Medioambiental de California (CEQA siglas en ingles) conforme al Articulo 15060(c)(2) del
Codigo Gubernamental (Ia actividad no resultara en cambios fisicos al medioambiente
razonablemente previsibles ya sea directamente o indirectamente), el Articulo 15060(c)(3) (la
actividad no es un proyecto segun se define en el Articulo 15378), y el Articulo 15061(b)(3) de
Pautas de la Ley de Calidad Medioambiental de California (CEQA), Titulo 14, Capitulo 3 del
Codigo de Regulaciones de California, porque no tiene el potencial de ocasionar un efecto
significativo sobre el medio ambiente.
Epigrafe 8. Conflicto. Todas las ordenanzas y partes de las ordenanzas en conflicto
adheridas son derogadas si acaso existe tal conflicto
Epigrafe 9. Fecha Vigente. Esta Ordenanza se publicara una vez en el diario de circulacion
general, imprimida y publicada en Ia Ciudad de Lodi "Lodi News Sentinel," y entrara en vigor y
tomara efecto el 7 de Abril de 2018.

CITY COUNCIL ELECTIONS BY DISTRICTS

WHEREAS, the City of Lodi supports the full participation of all citizens in electing
members of the City Council; and
WHEREAS, the City of Lodi currently elects its five (5) members of the City Council
using an at -large election system, where candidates may reside in any part of the City and each
member of the City Council is elected by the voters of the entire City; and
WHEREAS, California Government Code Section 34886u permits the City Council to
change the City's method of election by ordinance to a "by -district" system in which each
member of the City Council is elected only by the voters in the district in which the candidate
resides, in accordance with the California Government Code section 34871(c); and
WHEREAS, under the provisions of California Elections Code Section 10010, a city that
changes from an at -large city council method of election to a by -district city council method of
election requires a total of five public hearings, which includes at least two public hearings
regarding potential voting district boundaries prior to the release and consideration of any draft
voting district maps, and two public hearings following the release of draft voting district map(s);
and
WHEREAS, at a regular meeting of the City Council held on December 12, 2017, the
City Council adopted Resolution No. 2017-223 that initiated the process of establishing a
by -district election system and adopted the timeline for implementation; and
WHEREAS, thereafter, at regular meetings of the City Council held on
December 20, 2017 and January 17, 2018, pursuant to California Elections Code
Section 10010(a)(1), the City Council held public hearings where the public was invited to
provide input regarding the composition of the City's voting districts before any draft maps were
drawn, and the City Council considered and discussed the same; and
WHEREAS, at a regular meeting of the City Council held on December 20, 2017, the
City Council adopted Resolution No. 2017-232 setting forth the mandatory and permissive
criteria to be considered when drawing voting district maps; and
WHEREAS, thereafter at special and regular meetings of the City Council held on
January 31, 2018 and February 7, 2018, respectively, pursuant to California Elections Code
Section 10010(a)(2), the City Council held public hearings where the public was invited to
provide input regarding the content of the draft maps that had been released at least seven (7)
days before each meeting, as well as the proposed sequence of elections, and the City Council
considered and discussed the same; and
WHEREAS, at the special meeting of the City Council of the City of Lodi held on
February 13, 2018, the City Council directed staff to draft an ordinance adopting the voting
district map known as Map 119d and a sequence of elections whereby Council Districts D1, D2,
and D3 seats will be placed on the 2018 ballot, and Council Districts D4 and D5 seats on the
2020 ballot; and

WHEREAS, at a regular meeting of the City Council held on February 21, 2018, the
City Council held a final public hearing on the proposal to establish district boundaries, reviewed
additional public input, formally selected the voting district map and the election sequence
attached to, incorporated in, and set forth in this Ordinance, which was introduced for the first
reading at the same regular meeting of the City Council; and
WHEREAS, at the regular meeting of the City Council held on March 7, 2018, the City
Council conducted a second reading to adopt this Ordinance; and
WHEREAS, the purpose of this Ordinance is to enact, pursuant to California
Government Code Section 34886, an ordinance providing for the election of members of the
City Council of the City of Lodi by -district in five single -member districts, as reflected in Exhibit A
to this Ordinance, in furtherance of the purposes of the California Voting Rights Act of 2001
(Chapter 1.5 (commencing with Section 14025) of Division 14 of the Elections Code) and to
implement the guarantees of Section 7 of Article 1 and of Section of Article II of the California
Constitution.
NOW, THEREFORE BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS:
Section 1. The foregoing recitals are true and correct.
Section 2. The City of Lodi is hereby divided into five (5) Council districts and the
boundaries of the districts are more particularly depicted in Exhibit A, which is attached hereto
and incorporated by this reference.
Section 3. Chapter 1.12 of the Lodi Municipal Code is hereby amended by adding new
Sections 1.12.040, 1.12.050, 1.12.060, and 1.12.070 to read as follows:
1.12.040 By -District Electoral System.
Pursuant to California Government Code Section 34886 and the schedule established in
Section 1.12.060 of this Chapter, beginning in November 2018, members of the City
Council shall be elected on a by -district basis from five (5) single -member Council
Districts. The City's by -district electoral system shall be conducted in accordance with
California Government Code Section 34871(c).
1.12.050 Establishment of City Council Electoral Districts.
A. Pursuant to Section 1.12.040 of this Chapter, members of the City Council shall
be elected on a by -district basis, as that term is defined in California Government Code
Section 34871(c), from the five Council Districts as established and amended from time
to time by ordinance, and numerically designated as District 1, District 2, District 3,
District 4, and District 5.
B. Members of the City Council shall be elected in the electoral districts established
by this Section and subsequently reapportioned pursuant to applicable State and federal
law.
C. Except as provided in subdivision D herein and notwithstanding any other
provision of this Chapter, once this Ordinance is fully phased in, the member of the
City Council elected or (in the event of a vacancy filled by the City Council) appointed to
represent a district must reside in that district and be a registered voter in that district,
and any candidate for City Council must live in, and be a registered voter in, the district
in which he or she seeks election at the time nomination papers are issued, pursuant to
California Government Code Section 34882 and Elections Code Section 10227.

Termination of residency in a district by a member of the City Council shall create an
immediate vacancy for that Council district unless a substitute residence within the
district is established within thirty (30) days after the termination of residency.
D. Notwithstanding any other provisions of this Section, and consistent with the
requirements of California Government Code Section 36512, the members of the
City Council in office at the time of the Ordinance codified in this Chapter takes effect
shall continue in office until the expiration of the full term to which he or she was elected
and until his or her successor is qualified. At the end of the term of each member of the
City Council, that member of the City Council's successor shall be elected on a
by -district basis in the districts established in this Section and as provided in
Section 1.12.060 of this Chapter.
1.12.060 Election Schedule.
Except as otherwise required by California Government Code Section 36512, the
members of the City Council shall be elected from Council Districts D1, D2, and D3
beginning at the General Municipal Election in November 2018, and every four years
thereafter, as such Council Districts may be amended from time to time by ordinance of
the City Council. Members of the City Council shall be elected from Council Districts D4
and D5 beginning at the General Municipal Election in November 2020, and every four
years thereafter, as such Council Districts may be amended from time to time by
ordinance of the City Council.
1.12.070 Map of Council Districts.
The City Clerk shall maintain a map of the city showing the current boundaries and
numbers of each city council district as may be established and amended from time to
time by ordinance of the City Council.
Section 4. If necessary to facilitate the implementation of this Ordinance, the City Clerk is
authorized to make technical adjustments to the district boundaries that do not substantively
affect the population in the districts, the eligibility of candidates, or the residence of elected
officials within any district. The City Clerk shall consult with the City Manager and City Attorney
concerning any technical adjustments deemed necessary and shall advise the City Council of
any such adjustments required in the implementation of the districts.
Section 5. Severability. If any section, subsection, subdivision, paragraph, sentence, clause
or phrases of this Ordinance or any part thereof is for any reason held to be unconstitutional or
invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the
validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The
City Council of the City of Lodi hereby declares that it would have passed each section,
subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact
that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or
phrases be declared unconstitutional or invalid or ineffective.
Section 6, No Mandatory Duty of Care. This ordinance is not intended to and shall not be
construed or given effect in a manner which imposes upon the City, or any officer or employee
thereof, a mandatory duty of care towards persons or property within the City or outside of the
City so as to provide a basis of civil liability for damages, except as otherwise imposed by law.
Section 7. CEQA. This Ordinance is exempt from the requirements of the California
Environmental Quality Act (CEQA) pursuant to Government Code Section 15060(c)(2) (activity
will not result in a direct or reasonable foreseeable indirect physical change in the environment),

Section 15060(c)(3) (the activity is not a project as defined in Section 15378), and
Section 15061(b)(3) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because it has no potential for causing a significant effect on the environment.
Section 8. Conflict. All ordinances and parts of ordinances in conflict herewith are repealed
insofar as such conflict may exist.
Section 9. Effective Date. This Ordinance shall be published one time in the "Lodi News
Sentinel," a daily newspaper of general circulation printed and published in the City of Lodi, and
shall be in force and take effect on April 7, 2018.

The text of Ordinance No. 1949, which is for the purpose of adopting by -district elections for City
Council Members and adopting voting district boundaries and an election sequence, is hereby
published in its entirety below as adopted by the Lodi City Council on March 7, 2018.
ORDINANCE NO. 1949
AN ORDINANCE OF THE LODI CITY COUNCIL ESTABLISHING AND IMPLEMENTING BY -
DISTRICT ELECTIONS AND AMENDING CHAPTER 1.12 OF THE LODI MUNICIPAL CODE
TO PROVIDE FOR CITY COUNCIL ELECTIONS BY DISTRICTS
WHEREAS, the City of Lodi supports the full participation of all citizens in electing members
of the City Council; and
WHEREAS, the City of Lodi currently elects its five (5) members of the City Council using an
at -large election system, where candidates may reside in any part of the City and each member
of the City Council is elected by the voters of the entire City; and
WHEREAS, California Government Code Section 34886u permits the City Council to
change the City's method of election by ordinance to a "by -district" system in which each
member of the City Council is elected only by the voters in the district in which the candidate
resides, in accordance with the California Government Code section 34871(c); and
WHEREAS, under the provisions of California Elections Code Section 10010, a city that
changes from an at -large city council method of election to a by -district city council method of
election requires a total of five public hearings, which includes at least two public hearings
regarding potential voting district boundaries prior to the release and consideration of any draft
voting district maps, and two public hearings following the release of draft voting district map(s);
and
WHEREAS, at a regular meeting of the City Council held on December 12, 2017, the City
Council adopted Resolution No. 2017-223 that initiated the process of establishing a by -district
election system and adopted the timeline for implementation; and
WHEREAS, thereafter, at regular meetings of the City Council held on December 20, 2017
and January 17, 2018, pursuant to California Elections Code Section 10010(a)(1), the City
Council held public hearings where the public was invited to provide input regarding the
composition of the City's voting districts before any draft maps were drawn, and the City Council
considered and discussed the same; and
WHEREAS, at a regular meeting of the City Council held on December 20, 2017, the City
Council adopted Resolution No. 2017-232 setting forth the mandatory and permissive criteria to
be considered when drawing voting district maps; and
WHEREAS, thereafter at special and regular meetings of the City Council held on January
31, 2018 and February 7, 2018, respectively, pursuant to California Elections Code Section
10010(a)(2), the City Council held public hearings where the public was invited to provide input
regarding the content of the draft maps that had been released at least seven (7) days before
each meeting, as well as the proposed sequence of elections, and the City Council considered
and discussed the same; and
WHEREAS, at the special meeting of the City Council of the City of Lodi held on February
13, 2018, the City Council directed staff to draft an ordinance adopting the voting district map
known as Map 119d and a sequence of elections whereby Council Districts D1, D2, and D3
seats will be placed on the 2018 ballot, and Council Districts D4 and D5 seats on the 2020
ballot; and
WHEREAS, at a regular meeting of the City Council held on February 21, 2018, the
City Council held a final public hearing on the proposal to establish district boundaries, reviewed
additional public input, formally selected the voting district map and the election sequence
attached to, incorporated in, and set forth in this Ordinance, which was introduced for the first
reading at the same regular meeting of the City Council; and
WHEREAS, at the regular meeting of the City Council held on March 7, 2018, the City
Council conducted a second reading to adopt this Ordinance; and
WHEREAS, the purpose of this Ordinance is to enact, pursuant to California Government
Code Section 34886, an ordinance providing for the election of members of the City Council of
the City of Lodi by -district in five single -member districts, as reflected in Exhibit A to this
Ordinance, in furtherance of the purposes of the California Voting Rights Act of 2001 (Chapter
1.5 (commencing with Section 14025) of Division 14 of the Elections Code) and to implement
the guarantees of Section 7 of Article 1 and of Section of Article II of the California Constitution,
NOW, THEREFORE BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS:
Section 1. The foregoing recitals are true and correct.
Section 2. The City of Lodi is hereby divided into five (5) Council districts and the
boundaries of the districts are more particularly depicted in Exhibit A, which is attached hereto
and incorporated by this reference.

authorized to make technical adjustments to the district boundaries that do not substantively
affect the population in the districts, the eligibility of candidates, or the residence of elected
officials within any district. The City Clerk shall consult with the City Manager and City Attorney
concerning any technical adjustments deemed necessary and shall advise the City Council of
any such adjustments required in the implementation of the districts.
Section 5. Severability. If any section, subsection, subdivision, paragraph, sentence, clause
or phrases of this Ordinance or any part thereof is for any reason held to be unconstitutional or
invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the
validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The
City Council of the City of Lodi hereby declares that it would have passed each section,
subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact
that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or
phrases be declared unconstitutional or invalid or ineffective.
Section 6. No Mandatory Duty of Care. This ordinance is not intended to and shall not be
construed or given effect in a manner which imposes upon the City, or any officer or employee
thereof, a mandatory duty of care towards persons or property within the City or outside of the
City so as to provide a basis of civil liability for damages, except as otherwise imposed by law.

Section 7. CEQA. This Ordinance is exempt from the requirements of the California
Environmental Quality Act (CEQA) pursuant to Government Code Section 15060(c)(2) (activity
will not result in a direct or reasonable foreseeable indirect physical change in the environment),
Section 15060(c)(3) (the activity is not a project as defined in Section 15378), and
Section 15061(b)(3) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because it has no potential for causing a significant effect on the environment.
Section 8. Conflict. All ordinances and parts of ordinances in conflict herewith are repealed
insofar as such conflict may exist.
Section 9. Effective Date. This Ordinance shall be published one time in the "Lodi News
Sentinel," a daily newspaper of general circulation printed and published in the City of Lodi, and
shall be in force and take effect on April 7, 2018.

CIUDAD DE LODI, INSTITUYENDO E IMPLEMENTANDO
LAS ELECCIONES POR-DISTRITO Y MODIFICANDO LA
SECCI6N 1.12 DEL C6DIGO MUNICIPAL DE
ELECCIONES PARA ESTIPULAR A LA VOTACI6N DEL
CONSEJO MUNICIPAL POR DISTRITOS
CONSIDERANDO QUE, Ia Ciudad de Lodi apoya la participacion completa de todos sus
ciudadanos en la eleccion de los miembros del Consejo Municipal; y
CONSIDERANDO QUE, la Ciudad de Lodi actualmente elige a sus cinco (5) miembros
del Consejo Municipal utilizando un sistema de eleccion general, en lo cual los candidatos
pueden ser residentes de cualquier parte de la Ciudad y cada miembro del Consejo Municipal
es elegido por los votantes de todo el Municipio; y
CONSIDERANDO QUE, el Articulo 34886 del Codigo Gubernamental de California le
permite a Ia Ciudad cambiar su metodo de elecciones por ordenanza a un sistema por-distrito,
en el cual cada miembro del Consejo Municipal es elegido unicamente por los votantes del
distrito en que cada candidato vive, conforme al Articulo 34871(c) del Codigo Gubernamental
de California; y
CONSIDERANDO QUE, de acuerdo a las disposiciones del Articulo 10010 del C6digo
Electoral de California, una Ciudad que se cambia del metodo de elecciones generales para la
votacion del Consejo Municipal a un sistema de elecciones en base a distritos para el Consejo
Municipal, requiere un total de cinco audiencias publicas, cuales incluyen al menos dos
audiencias publicas pertinente a las demarcaciones de los distritos electorales antes de la
publicaci6n y consideraci6n de cualquier boceto de mapas de los distritos electorales, y dos
audiencias publicas subsecuente a la publicaci6n del boceto del/los mapa(s) de los distritos
electorales
CONSIDERANDO QUE, en Ia junta regular del Consejo Municipal que se efectuo el 12
de Diciembre de 2017, el Consejo Municipal adopto la Resolucion No. 2017-223 la cual inicio
el proceso para establecer un sistema de elecciones por-distrito, y adopto la cronologia para la
implementaci6n; y
CONSIDERANDO QUE, a partir de entonces, en las juntas regulares que efectuo el
Consejo Municipal el 20 de Diciembre de 2017 y el 17 de Enero de 2018, de acuerdo al Articulo
10010(a)(1) del C6digo Electoral de California, el Consejo Municipal celebro audiencias
publicas donde el publico fue invitado a aportar opiniones referente a la composici6n de los
Distritos Electorales de la Ciudad antes de, que cualquier mapa fuese disenado, y el Consejo
Municipal dialogo y considero lo mismo; y
CONSIDERANDO QUE, en la junta regular del Consejo Municipal que se efectuo el 20
de Diciembre de 2017, el Consejo Municipal adopto la Resolucion No. 2017-232 exponiendo el
parametro obligatorio y permisivo que se debe considerar cuando se disenen los mapas de los
distritos electorales; y
CONSIDERANDO QUE, a partir de entonces, en las juntas regulares y especiales del
31 de Enero de 2018 y el 7 de Febrero de 2018, que celebro el Consejo Municipal,
respectivamente, conforme al Articulo 10010(a)(2) del Codigo Electoral de California, el
Consejo Municipal neva a cabo audiencias publicas, a las cuales el publico fue invitado a

proporcionar opiniones referente al contenido de los bocetos de los mapas que fueron emitidos
por lo menos siete (7) Bias antes de cada junta, al igual que la secuencia sugerida de las
elecciones, y el Consejo Municipal dialogo y considero lo mismo; y
CONSIDERANDO QUE, en la junta especial del Consejo Municipal de la Ciudad de Lodi
que se efectu6 el 13 de Febrero de 2018, el Consejo Municipal instruyo al personal que
redactara una ordenanza adoptando el mapa del distrito electoral conocido como Mapa 119d y
una sucesi6n de las elecciones, a traves de los cuales, los puestos de los Distritos Concejales
D1, D2, y D3 seran colocados en la boleta electoral del 2018 y los puestos de los Distritos
Concejales D4, D5 en la boleta electoral del 2020; y
CONSIDERANDO QUE, en la junta regular que efectu6 el Consejo Municipal el 21 de
Febrero de 2018, el Consejo Municipal celebr6 su ultima audiencia publica sobre la iniciativa
para establecer las demarcaciones de los distritos, analizo opiniones adicionales del publico,
formalmente seleccion6 el mapa del distrito electoral y la sucesi6n de la elecci6n adherida a,
incorporada en, y expuesta en esta Ordenanza, la cual fue presentada para la primer lectura
durante la junta regular del Consejo Municipal; y
CONSIDERANDO QUE, en la junta regular del Consejo Municipal que se Ilevara a cabo
el 7 de Marzo de 2018, el Consejo Municipal realizara una segunda lectura para adoptar esta
Ordenanza; y
CONSIDERANDO QUE, el propOsito de esta Ordenanza es para decretar, conforme al
Articulo 34886 del C6digo Gubernamental de California, una ordenanza que prevea la elecci6n
de los miembros del Consejo Municipal de la Ciudad de Lodi, por distrito en los cinco distritos
uninominales, tal como se refleja en el Documento de Prueba A de esta Ordenanza, en
cumplimiento con los prop6sitos de la Ley de Derecho al Voto de California de 2001(Capitulo
1.5 (iniciando con la Secci6n 14025) de la Division 14 del C6digo Electoral) y para implementar
las garantias de la Secci6n 7 del Articulo 1 y la Secci6n del Articulo II de la Constituci6n de
California
AHORA, POR LO TANTO EL CONSEJO MUNICIPAL DE LA CIUDAD DE LODI
DECRETA LO SIGUIENTE:
Eoigrafe 1. Las afirmaciones antecedentes son correctas y veridicas.
Epigrafe 2. Por el presente la Ciudad de Lodi es dividida en cinco (5) Distritos Electorales y
las demarcaciones de los distritos se representan mas particularmente en el Documento de
Prueba A, el cual esta anexo al presente e integrado mediante esta referencia.
Ebigrafe 3. Capitulo 1.12 del C6digo Municipal de Lodi por el presente se enmienda,
mediante la incorporacion de las nuevas Secciones 1.12.040, 1.12.050, 1.12.060, y 1.12.070
con la siguiente redaccion:
1.12.040 Sistema Electoral Por-Distritos.
De acuerdo al Articulo 34886 del C6digo Electoral de California y la clausula establecida
en la Secci6n 1.12.060 de este Capitulo, iniciando en Noviembre de 2018, los miembros
del Consejo Municipal seran elegidos en cada Distrito, de los cinco (5) Distritos
Concejales uninominales. El sistema electoral por-distrito de la Ciudad se realizara de
acuerdo al Articulo 34871(c) del C6digo Gubernamental de California.

1.12.050 Institucion de los Distritos Electorales de la Ciudad.
A. Conforme a la Seccion 1.12.040 de este Capitulo, los miembros del Consejo
Municipal deberan ser elegidos de acuerdo a cada Distrito, en virtud de la definicion de
ese termino en el Articulo 34871(c) del Codigo Gubernamental de California, de los
cinco Distritos Concejales como se establecera y modificara ocasionalmente por la
ordenanza y han sido numericamente nombrados como Distrito 1, Distrito 2, Distrito 3,
Distrito 4 y Distrito 5.
B. Los miembros del Consejo Municipal deberan ser elegidos en los distritos
electorales instituidos por este Articulo y posteriormente redistribuidos conforme a ley
federal y estatal correspondiente.
C. Salvo a lo provisto en la subdivision D aqui dentro y sin perjuicio a cualquier otra
clausula de este Capitulo, una vez que esta Ordenanza sea introducida plenamente, el
miembro del Consejo Municipal electo o (en caso de que el Consejo Municipal cubra
una vacante) denominado para representar a un distrito debe residir en ese distrito y
debe ser un votante empadronado en ese distrito, y cualquier candidato para el Consejo
Municipal debe vivir en, y ser un votante empadronado en el distrito en el cual el o ella
aspira a ser elegido(a) en el momento en que se expidan los documentos de
nominacion, conforme al Articulo 34882 del Codigo Gubernamental de California y al
Articulo 10227 del Codigo Electoral. A la cesacion de residencia en un distrito de un
miembro del Consejo Municipal, debera generarse inmediatamente una vacante para
ese distrito Concejal a menos que un domicilio reemplazante se establezca dentro de
treinta (30) dias posterior a la terminacion de residencia.
D. Sin prejuicio a cualquier otra clausula en este Capitulo, y de acuerdo con los
requisitos del Articulo 36512 del Codigo Electoral de California, los miembros del
Consejo Municipal en funciones en el momento que entre en vigor la Ordenanza
codificada en este Capitulo deben continuar en el ejercicio de sus funciones hasta el
vencimiento de su mandato para el cual el o ella fue elegido(a) y, hasta que su sucesor
sea cualificado. A la conclusion del plazo de cada miembro del Consejo Municipal, ese
miembro sucesor del Consejo Municipal se elegira de acuerdo a cada distrito, dentro de
los distritos establecidos en este Capitulo y a lo provisto en el Articulo 1.12.060 de este
Capitulo.
1.12.060 Programacion para las Elecciones.
Salvo, que a menos lo exija el Articulo 36512 del Codigo Gubernamental de California,
para las Elecciones Generales Municipales iniciando en Noviembre 2018, los miembros
del Consejo Municipal se elegiran de los Distritos Concejales D1, D2 y D3 y cada cuatro
anos a partir de alli, como tal los Distritos Concejales pueden ser enmendados de vez
en cuando segun la Ordenanza del Consejo Municipal. Los miembros del Consejo
Municipal se elegiran de los Distritos Concejales D4 y D5 iniciando las Elecciones
Generales Municipales en Noviembre 2020 y cada cuatro afios a partir de alli, como tal,
los Distritos Concejales pueden ser enmendados ocasionalmente segun la Ordenanza
del Consejo Municipal
1.12.070 Mapa de los Distritos Conceiales.
La actuaria Municipal mantendra un mapa de la ciudad que muestre las demarcaciones
actuales y los numeros de cada distrito concejal del municipio sea como fuere
establecido y enmendado ocasionalmente segun la ordenanza del Consejo Municipal

Epigrafe 4. Si fuese necesario para facilitar la implementacion de esta Ordenanza, el
Secretario Municipal esta autorizado a hacer ajustes tecnicos a las demarcaciones de los
distritos los cuales no afectaran substancialmente la populacion de los distritos, la elegibilidad
de los candidatos o la residencia de los funcionarios ya elegidos dentro de cualquier distrito, El
Secretario Municipal consultara con el Administrador del Municipio y el Fiscal Municipal
pertinente a cualquier ajuste tecnico que se considere necesario y asesorara al Consejo
Municipal de cualquier ajuste que se requiera para la implementacion de los distritos.
Epigrafe 5. Separabilidad. Si en cualquier seccion, subseccion, subdivision, parrafo,
oracion, clausula o frase de esta Ordenanza o cualquier otra parte de la misma, por cualquier
motivo se cree que es anticonstitucional o invalida o ineficaz ante cualquier tribunal de
jurisdiccion competente, tal decision no afectara la validez o eficacia de las partes restantes de
esta Ordenanza o cualquier parte de Ia misma. El Consejo Municipal de la Ciudad de Lodi por
el presente manifiesta que habria aprobado cada seccion, subseccion, subdivision, parrafo,
oracion, clausula o frase de la misma, independientemente del hecho de que cualquier, ya sea
una o mas secciones, subsecciones, subdivisiones, parrafos, oraciones, clausulas o frases
sean declaradas inconstitucionales, invalidas o ineficaces.
Epigrafe 6. No hay Deber de Proteger Obligatorio. Esta ordenanza no pretende ni debe de
interpretarse o darsele efecto de manera que se imponga sobre Ia Ciudad o cualquier
funcionario o empleado de la misma, un deber obligatorio de cuidado hacia las personas o
propiedades dentro del Municipio o fuera de Ia Ciudad con el fin de proporcionar un fundamento
de responsabilidad civil para danos, salvo a lo que establece la ley.
Epigrafe 7. CEQA. Esta Ordenanza esta exenta de los requisitos de la Ley de Calidad
Medioambiental de California (CEQA siglas en ingles) conforme al Articulo 15060(c)(2) del
Codigo Gubernamental (la actividad no resultara en cambios fisicos al medioambiente
razonablemente previsibles ya sea directamente o indirectamente), el Articulo 15060(c)(3) (la
actividad no es un proyecto segun se define en el Articulo 15378), y el Articulo 15061(b)(3) de
Pautas de la Ley de Calidad Medioambiental de California (CEQA), Titulo 14, Capitulo 3 del
Codigo de Regulaciones de California, porque no tiene el potencial de ocasionar un efecto
significativo sobre el medio ambiente.
Epigrafe 8. Conflicto. Todas las ordenanzas y partes de las ordenanzas en conflicto
adheridas son derogadas si acaso existe tal conflicto
Epigrafe 9. Fecha Vigente. Esta Ordenanza se publicara una vez en el diario de circulacion
general, imprimida y publicada en la Ciudad de Lodi "Lodi News Sentinel," y entrara en vigor y
tomara efecto el 7 de Abril de 2018.

ELECTIONS AND AMENDING CHAPTER 1.12 OF THE
LODI MUNICIPAL CODE TO PROVIDE FOR
CITY COUNCIL ELECTIONS BY DISTRICTS
WHEREAS, the City of Lodi supports the full participation of all citizens in electing
members of the City Council; and
WHEREAS, the City of Lodi currently elects its five (5) members of the City Council
using an at -large election system, where candidates may reside in any part of the City and each
member of the City Council is elected by the voters of the entire City; and
WHEREAS, California Government Code Section 34886, permits the City Council to
change the City's method of election by ordinance to a "by -district" system in which each
member of the City Council is elected only by the voters in the district in which the candidate
resides, in accordance with the California Government Code section 34871(c); and
WHEREAS, under the provisions of California Elections Code Section 10010, a city that
changes from an at -large city council method of election to a by -district city council method of
election requires a total of five public hearings, which includes at least two public hearings
regarding potential voting district boundaries prior to the release and consideration of any draft
voting district maps, and two public hearings following the release of draft voting district map(s);
and
WHEREAS, at a regular meeting of the City Council held on December 12, 2017, the
City Council adopted Resolution No. 2017-223 that initiated the process of establishing a
by -district election system and adopted the timeline for implementation; and
WHEREAS, thereafter, at regular meetings of the City Council held on
December 20, 2017 and January 17, 2018, pursuant to California Elections Code
Section 10010(a)(1), the City Council held public hearings where the public was invited to
provide input regarding the composition of the City's voting districts before any draft maps were
drawn, and the City Council considered and discussed the same; and
WHEREAS, at a regular meeting of the City Council held on December 20, 2017, the
City Council adopted Resolution No. 2017-232 setting forth the mandatory and permissive
criteria to be considered when drawing voting district maps; and
WHEREAS, thereafter at special and regular meetings of the City Council held on
January 31, 2018 and February 7, 2018, respectively, pursuant to California Elections Code
Section 10010(a)(2), the City Council held public hearings where the public was invited to
provide input regarding the content of the draft maps that had been released at least seven (7)
days before each meeting, as well as the proposed sequence of elections, and the City Council
considered and discussed the same; and
WHEREAS, at the special meeting of the City Council of the City of Lodi held on
February 13, 2018, the City Council directed staff to draft an ordinance adopting the voting
district map known as Map 119d and a sequence of elections whereby Council Districts D1, D2,
and D3 seats will be placed on the 2018 ballot, and Council Districts D4 and D5 seats on the
2020 ballot; and

WHEREAS, at a regular meeting of the City Council held on February 21, 2018, the
City Council held a final public hearing on the proposal to establish district boundaries, reviewed
additional public input, formally selected the voting district map and the election sequence
attached to, incorporated in, and set forth in this Ordinance, which was introduced for the first
reading at the same regular meeting of the City Council; and
WHEREAS, at the regular meeting of the City Council to be held on March 7, 2018, the
City Council will conduct a second reading to adopt this Ordinance; and
WHEREAS, the purpose of this Ordinance is to enact, pursuant to California
Government Code Section 34886, an ordinance providing for the election of members of the
City Council of the City of Lodi by -district in five single -member districts, as reflected in Exhibit A
to this Ordinance, in furtherance of the purposes of the California Voting Rights Act of 2001
(Chapter 1.5 (commencing with Section 14025) of Division 14 of the Elections Code) and to
implement the guarantees of Section 7 of Article 1 and of Section of Article II of the California
Constitution.
NOW, THEREFORE BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS:
Section 1 The foregoing recitals are true and correct.
Section 2. The City of Lodi is hereby divided into five (5) Council districts and the
boundaries of the districts are more particularly depicted in Exhibit A, which is attached hereto
and incorporated by this reference.
Section 3. Chapter 1.12 of the Lodi Municipal Code is hereby amended by adding new
Sections 1.12.040, 1.12.050, 1.12.060, and 1.12.070 to read as follows:
1.12.040 By -District Electoral System.
Pursuant to California Government Code Section 34886 and the schedule established in
Section 1.12.060 of this Chapter, beginning in November 2018, members of the City
Council shall be elected on a by -district basis from five (5) single -member Council
Districts. The City's by -district electoral system shall be conducted in accordance with
California Government Code Section 34871(c).
1.12.050 Establishment of City Council Electoral Districts.
A. Pursuant to Section 1.12.040 of this Chapter, members of the City Council shall
be elected on a by -district basis, as that term is defined in California Government Code
Section 34871(c), from the five Council Districts as established and amended from time
to time by ordinance, and numerically designated as District 1, District 2, District 3,
District 4, and District 5.
B. Members of the City Council shall be elected in the electoral districts established
by this Section and subsequently reapportioned pursuant to applicable State and federal
law.
C. Except as provided in subdivision D herein and notwithstanding any other
provision of this Chapter, once this Ordinance is fully phased in, the member of the
City Council elected or (in the event of a vacancy filled by the City Council) appointed to
represent a district must reside in that district and be a registered voter in that district,
and any candidate for City Council must live in, and be a registered voter in, the district
in which he or she seeks election at the time nomination papers are issued, pursuant to
California Government Code Section 34882 and Elections Code Section 10227.

Termination of residency in a district by a member of the City Council shall create an
immediate vacancy for that Council district unless a substitute residence within the
district is established within thirty (30) days after the termination of residency.
D. Notwithstanding any other provisions of this Section, and consistent with the
requirements of California Government Code Section 36512, the members of the
City Council in office at the time of the Ordinance codified in this Chapter takes effect
shall continue in office until the expiration of the full term to which he or she was elected
and until his or her successor is qualified. At the end of the term of each member of the
City Council, that member of the City Council's successor shall be elected on a
by -district basis in the districts established in this Section and as provided in
Section 1.12.060 of this Chapter.
1.12.060 Election Schedule.
Except as otherwise required by California Government Code Section 36512, the
members of the City Council shall be elected from Council Districts D1, D2, and D3
beginning at the General Municipal Election in November 2018, and every four years
thereafter, as such Council Districts may be amended from time to time by ordinance of
the City Council. Members of the City Council shall be elected from Council Districts D4
and D5 beginning at the General Municipal Election in November 2020, and every four
years thereafter, as such Council Districts may be amended from time to time by
ordinance of the City Council.
1.12.070 Map of Council Districts.
The City Clerk shall maintain a map of the city showing the current boundaries and
numbers of each city council district as may be established and amended from time to
time by ordinance of the City Council.
Section 4. If necessary to facilitate the implementation of this Ordinance, the City Clerk is
authorized to make technical adjustments to the district boundaries that do not substantively
affect the population in the districts, the eligibility of candidates, or the residence of elected
officials within any district. The City Clerk shall consult with the City Manager and City Attorney
concerning any technical adjustments deemed necessary and shall advise the City Council of
any such adjustments required in the implementation of the districts.
Section 5. Severability. If any section, subsection, subdivision, paragraph, sentence, clause
or phrases of this Ordinance or any part thereof is for any reason held to be unconstitutional or
invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the
validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The
City Council of the City of Lodi hereby declares that it would have passed each section,
subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact
that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or
phrases be declared unconstitutional or invalid or ineffective.
Section 6. No Mandatory Duty of Care. This ordinance is not intended to and shall not be
construed or given effect in a manner which imposes upon the City, or any officer or employee
thereof, a mandatory duty of care towards persons or property within the City or outside of the
City so as to provide a basis of civil liability for damages, except as otherwise imposed by law.
Section 7. CEQA. This Ordinance is exempt from the requirements of the California
Environmental Quality Act (CEQA) pursuant to Government Code Section 15060(c)(2) (activity
will not result in a direct or reasonable foreseeable indirect physical change in the environment),

Section 15060(c)(3) (the activity is not a project as defined in Section 15378), and
Section 15061(b)(3) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because it has no potential for causing a significant effect on the environment.
Section 8. Conflict. All ordinances and parts of ordinances in conflict herewith are repealed
insofar as such conflict may exist.
Section 9. Effective Date. This Ordinance shall be published one time in the "Lodi News
Sentinel," a daily newspaper of general circulation printed and published in the City of Lodi, and
shall be in force and take effect on April 7, 2018.

SECCI6N 1.12 DEL C6DIGO MUNICIPAL DE
ELECCIONES PARA ESTIPULAR A LA VOTACI6N DEL
CONSEJO MUNICIPAL POR DISTRITOS
CONSIDERANDO QUE, la Ciudad de Lodi apoya Ia participacion completa de todos sus
ciudadanos en la eleccion de los miembros del Consejo Municipal; y
CONSIDERANDO QUE, la Ciudad de Lodi actualmente elige a sus cinco (5) miembros
del Consejo Municipal utilizando un sistema de eleccion general, en lo cual los candidatos
pueden ser residentes de cualquier parte de la Ciudad y cada miembro del Consejo Municipal
es elegido por los votantes de todo el Municipio; y
CONSIDERANDO QUE, el Articulo 34886 del Codigo Gubernamental de California le
permite a la Ciudad cambiar su metodo de elecciones por ordenanza a un sistema por-distrito,
en el cual cada miembro del Consejo Municipal es elegido unicamente por los votantes del
distrito en que cada candidato vive, conforme al Articulo 34871(c) del Codigo Gubernamental
de California; y
CONSIDERANDO QUE, de acuerdo a las disposiciones del Articulo 10010 del Codigo
Electoral de California, una Ciudad que se cambia del metodo de elecciones generales para la
votacion del Consejo Municipal a un sistema de elecciones en base a distritos para el Consejo
Municipal, requiere un total de cinco audiencias publicas, cuales incluyen al menos dos
audiencias publicas pertinente a las demarcaciones de los distritos electorales antes de la
publicacion y consideracion de cualquier boceto de mapas de los distritos electorales, y dos
audiencias publicas subsecuente a la publicacion del boceto del/los mapa(s) de los distritos
electorales
CONSIDERANDO QUE, en la junta regular del Consejo Municipal que se efectuo el 12
de Diciembre de 2017, el Consejo Municipal adopto la Resolucion No. 2017-223 la cual inicio
el proceso para establecer un sistema de elecciones por-distrito, y adopto la cronologia para la
implementacion; y
CONSIDERANDO QUE, a partir de entonces, en las juntas regulares que efectuo el
Consejo Municipal el 20 de Diciembre de 2017 y el 17 de Enero de 2018, de acuerdo al Articulo
10010(a)(1) del Codigo Electoral de California, el Consejo Municipal celebro audiencias
publicas donde el publico fue invitado a aportar opiniones referente a la composicion de los
Distritos Electorales de Ia Ciudad antes de, que cualquier mapa fuese disenado, y el Consejo
Municipal dialogo y considero lo mismo; y
CONSIDERANDO QUE, en la junta regular del Consejo Municipal que se efectuo el 20
de Diciembre de 2017, el Consejo Municipal adopto la Resolucion No. 2017-232 exponiendo el
parametro obligatorio y permisivo que se debe considerar cuando se diselien los mapas de los
distritos electorales; y
CONSIDERANDO QUE, a partir de entonces, en las juntas regulares y especiales del
31 de Enero de 2018 y el 7 de Febrero de 2018, que celebro el Consejo Municipal,
respectivamente, conforme al Articulo 10010(a)(2) del Codigo Electoral de California, el
Consejo Municipal Ilevo a cabo audiencias publicas, a las cuales el publico fue invitado a

proporcionar opiniones referente al contenido de los bocetos de los mapas que fueron emitidos
por lo menos siete (7) Bias antes de cada junta, al igual que la secuencia sugerida de las
elecciones, y el Consejo Municipal dialogo y considero lo mismo; y
CONSIDERANDO QUE, en Ia junta especial del Consejo Municipal de la Ciudad de Lodi
que se efectuo el 13 de Febrero de 2018, el Consejo Municipal instruyo al personal que
redactara una ordenanza adoptando el mapa del distrito electoral conocido como Mapa 119d y
una sucesion de las elecciones, a traves de los cuales, los puestos de los Distritos Concejales
01, D2, y D3 seran colocados en la boleta electoral del 2018 y los puestos de los Distritos
Concejales D4, D5 en la boleta electoral del 2020; y
CONSIDERANDO QUE, en Ia junta regular que efectuo el Consejo Municipal el 21 de
Febrero de 2018, el Consejo Municipal celebro su Ultima audiencia publica sobre la iniciativa
para establecer las demarcaciones de los distritos, analizo opiniones adicionales del publico,
formalmente selecciono el mapa del distrito electoral y la sucesion de la eleccion adherida a,
incorporada en, y expuesta en esta Ordenanza, Ia cual fue presentada para la primer lectura
durante la junta regular del Consejo Municipal; y
CONSIDERANDO QUE, en la junta regular del Consejo Municipal que se Ilevara a cabo
el 7 de Marzo de 2018, el Consejo Municipal realizara una segunda lectura para adoptar esta
Ordenanza; y
CONSIDERANDO QUE, el proposito de esta Ordenanza es para decretar, conforme al
Articulo 34886 del Codigo Gubernamental de California, una ordenanza que prevea la eleccion
de los miembros del Consejo Municipal de la Ciudad de Lodi, por distrito en los cinco distritos
uninominales, tal como se refleja en el Documento de Prueba A de esta Ordenanza, en
cumplimiento con los propositos de la Ley de Derecho al Voto de California de 2001(Capitulo
1.5 (iniciando con la Seccion 14025) de la Division 14 del Codigo Electoral) y para implementar
las garantias de la Seccion 7 del Articulo 1 y la Seccion del Articulo II de Ia Constitucion de
California
AHORA, POR LO TANTO EL CONSEJO MUNICIPAL DE LA CIUDAD DE LODI
DECRETA LO SIGUIENTE:
Epiqrafe 1. Las afirmaciones antecedentes son correctas y veridicas.
Epiqrafe 2. Por el presente la Ciudad de Lodi es dividida en cinco (5) Distritos Electorales y
las demarcaciones de los distritos se representan mas particularmente en el Documento de
Prueba A, el cual esta anexo al presente e integrado mediante esta referencia.
Epiqrafe 3. Capitulo 1.12 del Codigo Municipal de Lodi por el presente se enmienda,
mediante la incorporacion de las nuevas Secciones 1.12.040, 1.12.050, 1.12.060, y 1.12.070
con la siguiente redaccion:
1.12.040 Sistema Electoral Por-Distritos.
De acuerdo al Articulo 34886 del Codigo Electoral de California y la clausula establecida
en la Seccion 1.12.060 de este Capitulo, iniciando en Noviembre de 2018, los miembros
del Consejo Municipal seran elegidos en cada Distrito, de los cinco (5) Distritos
Concejales uninominales. El sistema electoral por-distrito de Ia Ciudad se realizara de
acuerdo al Articulo 34871(c) del Codigo Gubernamental de California.

1.12.050 Institucinn de los Distritos Electorales de la Ciudad.
A. Conforme a la Seccien 1.12.040 de este Capitulo, los miembros del Consejo
Municipal deberan ser elegidos de acuerdo a cada Distrito, en virtud de la definici6n de
ese termino en el Articulo 34871(c) del Cbdigo Gubernamental de California, de los
cinco Distritos Concejales como se establecera y modificara ocasionalmente por la
ordenanza y han sido numericamente nombrados como Distrito 1, Distrito 2, Distrito 3,
Distrito 4 y Distrito 5.
B. Los miembros del Consejo Municipal deberan ser elegidos en los distritos
electorales instituidos por este Articulo y posteriormente redistribuidos conforme a ley
federal y estate! correspondiente.
C. Salvo a lo provisto en la subdivision D aqui dentro y sin perjuicio a cualquier otra
clausula de este Capitulo, una vez que esta Ordenanza sea introducida plenamente, el
miembro del Consejo Municipal electo o (en caso de que el Consejo Municipal cubra
una vacante) denominado para representar a un distrito debe residir en ese distrito y
debe ser un votante empadronado en ese distrito, y cualquier candidato para el Consejo
Municipal debe vivir en, y ser un votante empadronado en el distrito en el cual el o ella
aspira a ser elegido(a) en el momento en que se expidan los documentos de
nominacien, conforme al Articulo 34882 del Cbdigo Gubernamental de California y al
Articulo 10227 dei Cbdigo Electoral. A la cesaci6n de residencia en un distrito de un
miembro del Consejo Municipal, debera generarse inmediatamente una vacante para
ese distrito Concejal a menos que un domicilio reemplazante se establezca dentro de
treinta (30) dias posterior a la terminaci6n de residencia.
D. Sin prejuicio a cualquier otra clausula en este Capitulo, y de acuerdo con los
requisitos del Articulo 36512 del Cbdigo Electoral de California, los miembros del
Consejo Municipal en funciones en el momento que entre en vigor la Ordenanza
codificada en este Capitulo deben continuar en el ejercicio de sus funciones hasta el
vencimiento de su mandato para el cual el o ella fue elegido(a) y, hasta que su sucesor
sea cualificado. A la conclusion del plazo de cada miembro del Consejo Municipal, ese
miembro sucesor del Consejo Municipal se elegira de acuerdo a cada distrito, dentro de
los distritos establecidos en este Capitulo y a lo provisto en el Articulo 1.12.060 de este
Capitulo.
1.12.060 Programaci6n para las Elecciones.
Salvo, que a menos to exija el Articulo 36512 del Cbdigo Gubernamental de California,
para las Elecciones Generales Municipales iniciando en Noviembre 2018, los miembros
del Consejo Municipal se elegiran de los Distritos Concejales 01, D2 y D3 y cada cuatro
anos a partir de alli, como tal los Distritos Concejales pueden ser enmendados de vez
en cuando segun la Ordenanza del Consejo Municipal. Los miembros del Consejo
Municipal se elegiran de los Distritos Concejales D4 y D5 iniciando las Elecciones
Generales Municipales en Noviembre 2020 y cada cuatro anos a partir de alli, como tal,
los Distritos Concejales pueden ser enmendados ocasionalmente segun la Ordenanza
del Consejo Municipal
1.12.070 Mapa de los Distritos Concejales.
La actuaria Municipal mantendra un mapa de la ciudad que muestre las demarcaciones
actuales y los numeros de cada distrito concejal del municipio sea como fuere
establecido y enmendado ocasionalmente segun la ordenanza del Consejo Municipal

Epigrafe 4. Si fuese necesario para facilitar la implementacion de esta Ordenanza, el
Secretario Municipal esta autorizado a hacer ajustes tecnicos a las demarcaciones de los
distritos los cuales no afectaran substancialmente la populacion de los distritos, la elegibilidad
de los candidatos o la residencia de los funcionarios ya elegidos dentro de cualquier distrito. El
Secretario Municipal consultara con el Administrador del Municipio y el Fiscal Municipal
pertinente a cualquier ajuste tecnico que se considere necesario y asesorara al Consejo
Municipal de cualquier ajuste que se requiera para Ia implementacion de los distritos.
Epigrafe 5. Separabilidad. Si en cualquier seccion, subseccion, subdivision, parrafo,
oracion, clausula o frase de esta Ordenanza o cualquier otra parte de la misma, por cualquier
motivo se cree que es anticonstitucional o invalida o ineficaz ante cualquier tribunal de
jurisdiccion competente, tal decision no afectara Ia validez o eficacia de las partes restantes de
esta Ordenanza o cualquier parte de Ia misma. El Consejo Municipal de la Ciudad de Lodi por
el presente manifiesta que habria aprobado cada seccion, subseccion, subdivision, parrafo,
oracion, clausula o frase de la misma, independientemente del hecho de que cualquier, ya sea
una o mas secciones, subsecciones, subdivisiones, parrafos, oraciones, clausulas o frases
sean declaradas inconstitucionales, invalidas o ineficaces.
Epigrafe 6. No hav Deber de Proteqer Obligatorio. Esta ordenanza no pretende ni debe de
interpretarse o darsele efecto de manera que se imponga sobre la Ciudad o cualquier
funcionario o empleado de la misma, un deber obligatorio de cuidado hacia las personas o
propiedades dentro del Municipio o fuera de la Ciudad con el fin de proporcionar un fundamento
de responsabilidad civil para danos, salvo a lo que establece la ley.
Epigrafe 7. CEQA. Esta Ordenanza esta exenta de los requisitos de la Ley de Calidad
Medioambiental de California (CEQA siglas en ingles) conforme al Articulo 15060(c)(2) del
Codigo Gubernamental (la actividad no resultara en cambios fisicos al medioambiente
razonablemente previsibles ya sea directamente o indirectamente), el Articulo 15060(c)(3) (la
actividad no es un proyecto segun se define en el Articulo 15378), y el Articulo 15061(b)(3) de
Pautas de la Ley de Calidad Medioambiental de California (CEQA), Titulo 14, Capitulo 3 del
Codigo de Regulaciones de California, porque no tiene el potencial de ocasionar un efecto
significativo sobre el medio ambiente.
Epigrafe 8, Conflicto. Todas las ordenanzas y partes de las ordenanzas en conflicto
adheridas son derogadas si acaso existe tal conflicto
Epigrafe 9. Fecha Vigente_ Esta Ordenanza se publicara una vez en el diario de circulacion
general, imprimida y publicada en la Ciudad de Lodi "Lodi News Sentinel," y entrara en vigor y
tomara efecto el 7 de Abril de 2018.
