HomeMy WebLinkAboutResolutions - No. 2017-213RESOLUTION NO. 2017-213 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CITY MANAGER TO WAIVE THE BID PROCESS AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH KJELDSEN, SINNOCK & NEUDECK, INC., OF STOCKTON, FOR 200 -YEAR FLOODPLAIN EVALUATION AND DELINEATION; AND FURTHER APPROPRIATING FUNDS WHEREAS, California enacted Senate Bill (SB) 5 in 2007 titled "Central Valley Flood Protection Act of 2008"; and WHEREAS, SB 5 defines "urban level of flood protection" as the "level of protection that is necessary to withstand flooding that has a one -in -200 chance of occurring in any given year, using criteria consistent with, or developed by, the California Department of Water Resources"; and WHEREAS, the bill is intended to strengthen flood management within the Sacramento - San Joaquin Valley region; and WHEREAS, this act and subsequent amendments required the affected communities to amend their General Plans no later than July 2, 2015 and Zoning Ordinances within 12 months of the completion of the General Plan Amendment; and WHEREAS, current staff recently revisited past analysis and concluded that the City must still amend the General Plan and Zoning Code with a defined 200 -year floodplain map in order to comply with the SB 5 requirements; and WHEREAS, Kjeldsen, Sinnock & Neudeck, Inc., is a well-established civil engineering firm that specializes in flood protection and is considered an expert regarding SB 5 requirements; and WHEREAS, staff recommends authorizing the City Manager to waive the bid process and execute a Professional Services Agreement with Kjeldsen, Sinnock & Neudeck, Inc., of Stockton, for 200 -Year Floodplain Evaluation and Delineation, in the amount of $228,800; and WHEREAS, staff also recommends that the City Council appropriate funds in the amount of $228,800, from Community Development Special Revenue fund balance (27080000.72450) for Fiscal Year 2017/18. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to waive the bid process and execute a Professional Services Agreement with Kjeldsen, Sinnock & Neudeck, Inc., of Stockton, California, for 200 -Year Floodplain Evaluation and Delineation, in the amount of $228,800; and BE IT FURTHER RESOLVED that funds be appropriated in the amount of $228,800, as set forth above.
