A. Roll Call by City Clerk
An Informal Informational Meeting ("Shirtsleeve" Session) of the Lodi City Council was held
Tuesday, March 14, 2017, commencing at 7:01 a.m.
Present: Council Member Chandler, Council Member Johnson, Mayor Pro Tempore Nakanishi,
and Mayor Kuehne
Absent: Council Member Mounce
Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Ferraiolo

B-1 Receive Information on Recycling Information and Outreach (PW)
Alex Oseguera, of Central Valley Waste Management, provided a PowerPoint presentation
regarding recycling education and outreach. Specific topics of discussion included AB 341 -
mandatory commercial recycling for commercial businesses, companies impacted, methods of
complying, working together to meet mandate requirements, Recycle Right - program to reduce
contamination in residential recycling and green waste carts, why the program is needed, Lodi
Recycling Week (February 27 to March 3, 2017), how Recycle Right will work, education
outreach and direct mail to all residential customers, loss of service to customers who do not
comply, and additional ways Lodi can recycle and dispose of trash.
In response to Mayor Pro Tempore Nakanishi, Mr. Oseguera stated the State has no sanctions at
this time for noncompliance with AB 341; however, the City Council could enact local sanctions to
penalize those who refuse to accept a recycling container or to participate in the program to meet
this mandate for commercial recycling.
In response to Council Member Johnson, Public Works Director Charlie Swimley stated Cal -
Recycle is concerned that Lodi has not increased its participation rate over the last few years and
is becoming more aggressive in encouraging compliance with the legislation by adding Lodi to its
"watch list". He stated the hope is to establish cooperation with the business community, but the
State will continue to monitor the City's compliance with and participation rates for AB 341
through required reportings. Mr. Oseguera stated that initially the State's primary push was to
have an outreach plan in place, but it now wants increased participation in the mandated
program. The proposed plan will ensure Lodi is moving forward in that direction and is ultimately
removed from the watch list. He added that Lodi is not alone on this watch list; the State is
becoming aggressive with many communities.
Council Member Johnson requested clarification on the contamination issue, stating he believed
recyclables went through a purification system before being shipped elsewhere or reprocessed
for another use. Mr. Oseguera explained that contamination of recyclables from trash dumped in
the wrong cart occurs when seepage or waste from other products dampens cardboard and
newspapers. Once recyclables become contaminated, they are unacceptable to market for
recycling; and they mix with all of the recycling material on the belt system, not only the material
from the contaminated container. In addition, larger items are often thrown in with recyclables,
such as old bicycles, which can cause the entire belt system to cease and can damage the
sorting system. Mr. Oseguera stated that recyclables should be clean and dry. In further
response, Mr. Oseguera stated the current sorting line has been upgraded and includes
electronics, but there continues to be individuals on the line sorting through items on the belt, and
it is hazardous if needles or waste products are thrown in with recyclables.

Mr. Schwabauer asked if the purpose of having separate carts is to simplify the sorting process,
which makes it less expensive for Waste Management as well as for ratepayers, to which
Mr. Oseguera concurred. The more sorting that Waste Management must perform, the higher
impact it will have on the rates, and the State's push to monitor what is going into containers
makes it critical to reduce the 46 percent trash level in recycling.
In response to Council Member Johnson, Mr. Oseguera confirmed that the City receives an
administrative payment and a recycling payment, which is in the contract, but a recycling rebate is
not in the franchise agreement because of the risk factor associated with market fluctuations. The
City opted for more stability in the rates. Mr. Schwabauer stated that, if the City negotiated back a
share of the recyclables, it would effect rates, to which Mr. Oseguera agreed, adding that the
rates would increase. In response to Mr. Schwabauer, Mr. Oseguera stated that cities with
rebates typically do not return the money back to ratepayers and instead use the funds for
environmental departments and programs.
In response to Mayor Kuehne, Mr. Oseguera stated that plastic bags should not be placed in
recycling bins; instead, residents should dump their recyclables directly into the can because
plastic bags are difficult to recycle and get tied up in the system, which increases downtime for
facilities. Further, he stated that green waste should also be dumped directly into green waste
cans without a plastic bag because the material is converted into compost. He stated that plastic
bags should be placed in trash receptacles. With regard to a trickle of liquid from cans or bottles
onto recycled paper or cardboard, Mr. Oseguera stated that the minimal amount is incidental and
does not cause a problem. Mayor Kuehne stated he feels the penalty of taking away one's
recycling can for one year for putting trash into recycling or green waste cans is contradictory to
the goal of encouraging recycling. Mr. Oseguera stated that the industry standard is to take away
a recycling can for one year because three to six months does not get the point across to
offenders. He stated that Manteca, Modesto, and Sacramento have one-year penalties and that,
in Modesto, violators are also required to attend a class before getting their containers returned.
He stated he would research a lesser period of time, but he believed a longer timeframe sends a
clear message. He added that the goal is to educate residents first and that the pilot project and
auditing will spread the word and train people to recycle properly.
Mr. Schwabauer asked if other cities have programs with a graduated fine system as opposed to
taking away a can, to which Mr. Oseguera responded that he has not seen that type of fining, but
some cities have a much higher penalty before taking away one's container. He explained that
Waste Management recommends the $13.89 penalty because the rate is already approved by
Council and is in the contract. He stated that he will consider the comments about a progressive
fine and not taking away carts.
In response to Mayor Pro Tempore Nakanishi, Mr. Oseguera stated that residents will receive
written literature about the program, as well as a phone call, and there will be advertisements in
the local newspaper. California Waste considered a billboard, but the concern is there is too
much small print that passers-by will be unable to read the information. Mayor Pro Tempore
Nakanishi suggested a plastic sign on carts listing what can and cannot be recycled and a listing
of the fines if caught putting trash into the recycling or green waste carts. Mr. Oseguera stated
that Waste Management is working to install all of its vehicles with on -board computers and
cameras and he hopes those changes will be in place by end of this year or beginning of next
year.
Mayor Kuehne agreed that a sticker on cans would be a visual reminder of what can go into
recycling containers. Mr. Oseguera stated he would look into delivering stickers for customers to
place on their cans.
In response to Mayor Pro Tempore Nakanishi, Mr. Oseguera confirmed that Waste Management
can deliver a can of full color, i.e. matching lid and body, to customers if so desired. He explained
there is a supply on hand of can bodies, all of the same color, that can be matched with lids and
used as any type of can.

In response to Myrna Wetzel, Mr. Oseguera stated that customers are not charged when
rainwater seeps into a recycling can and confirmed there will be auditors sifting through garbage
cans to see if there is any trash in recycling containers. Ms. Wetzel expressed concern that there
are individuals who sort through and dump garbage into other people's cans and she questioned
how Waste Management will deal with that because she does not want the blame for items
dumped by others. Mr. Oseguera stated that the State is considering a bill that would penalize
individuals who do this, but it will be difficult to control situations where neighbors dump items in
cans because there is extra room. In response to Ms. Wetzel, Mr. Oseguera suggested that
bottles of cleaning product be washed before dumping because excess chemicals could be
harmful to sorters working the line. He also suggested dumping those types of items at the annual
household hazardous waste event.
City Attorney Magdich stated that, under the Lodi Municipal Code, theft of recyclables is a
violation and, if found, violators can be cited and prosecuted.

RECOMMENDED ACTION: Receive information on recycling education and outreach.
BACKGROUND INFORMATION: Staff from Central Valley Waste Services (CVWS) will be presenting
information on education and outreach efforts related to recycling.
There have been several State mandates over the last few years,
such as AB341, that require recycling programs for multi -family and commercial customers. AB341
requires yearly reporting to California's Department of Resources and Recovery (CalRecycle), on the
number of commercial and multi -family customers utilizing the recycling program. Recently, CalRecycle
has expressed to the City that they feel we have had little success demonstrating increased participation
from year to year. CVWS staff will present planned efforts to increase participation.
Information on current contamination levels in the City's residential recycling and green waste carts will
also be discussed. CVWS staff will present their Recycle Right program targeted to reduce the current
46 percent contamination in residential recycling and green waste carts.
