services related to Sustainable Groundwater Management Act, in the
amount of $40,000.
On August 28, 2014, the California Legislature passed comprehensive
groundwater legislation enacting the "Sustainable Groundwater
management Act" (SGMA). Governor Brown signed the legislation on
effective on January 1, 2015.
SGMA requires the formation of groundwater sustainability agencies (GSA's) and the development and
implementation of one or more groundwater sustainability plans (GSP's) for each groundwater basin
categorized by the California Department of Water Resources as high- or medium -priority. The City Council
has elected to form an independent GSA that would allow it to develop strategies to manage their own
groundwater, including gathering groundwater data, monitoring water usage, regulating wells, and imposing
water usage fines, among other duties.
The City is part of the public entity known as Eastern San Joaquin Groundwater Basin Authority (GBA). The
members of the GBA established the Eastern San Joaquin Sustainable Groundwater Act Work Group
(Workgroup), which is a collaboration of agencies, including Lodi, within the County, working to develop an
overall strategy for complying with the SGMA legislation. One of those strategies is to mutually develop and
ultimately adopt a GSP for the entire groundwater basin. Preparing the GSP for the entire groundwater basin
requires technical work performed by an outside consultant commissioned by the GBA.
Task Order No. 45 will include Lodi -specific, SGMA-related, on-call engineering services to review
documentation requested by the GBA for purposes of generating the GSP, review and comment on technical
documents prepared by the GBA consultant, and attend monthly Ad Hoc Technical Advisory Committee
meetings as the City's representative.
Staff recommends authorizing City Manager to execute Task Order No. 45 with West Yost Associates, Inc.,
of Walnut Creek, for ongoing engineering services related to the SGMA, in the amount of $40,000.
FISCAL IMPACT:
Compliance with SGMA legislation will require funding from GBA members.
Since Lodi is sustainable with respect to groundwater usage, this task order is
intended to utilize the technical expertise of West Yost Associates, Inc. to
assist the City in evaluating any fiscal impacts of the basin wide GSP as it
relates to Lodi. There is no impact to the General Fund.

In accordance with the Task Order Agreement between City of Lodi (Client) and West Yost
Associates, Inc. (Consultant), dated January 13, 1999, Consultant is authorized to complete the
work scope defined in this Task Order No. 45 according to the schedule and budget defined herein.
WORK SCOPE
West Yost shall provide consulting services to the Client to address issues pertaining to the
implementation of the Sustainable Groundwater Management Act (SGMA). The Client has
formed a groundwater sustainability agency (GSA) that would allow it to develop strategies to
manage their own groundwater, including gathering groundwater data, monitoring water usage,
regulating wells, and imposing water usage fines, among other duties. The Client GSA is part of
the public entity known as Eastern San Joaquin Groundwater Authority (Authority) that shall
coordinate the various GSAs' management of the San Joaquin Valley Groundwater Basin,
Eastern San Joaquin Subbasin, California Department of Water Resources Basin No. 5-22.01, as
part of SGMA. West Yost shall provide input to the Client regarding review of SGMA related
requests from the Authority, review and comment on SGMA documents, and attendance at the
Ad Hoc Technical Advisory Committee (TAC) meetings as the Client's representative, and this
Task Order will provide a mechanism for us to continue this support.
BUDGET
The costs for Consultant's services as defined herein shall not exceed $40,000.
COMPENSATION
Compensation shall be in accordance with the provisions of the Task Order Agreement between
Client and Consultant and the billing rate schedule as shown in Attachment A.
The compensation limit for services performed under this task order shall not exceed $40,000. If
additional funds are required to complete the services defined herein beyond this limit, Consultant
shall notify Client in writing prior to reaching the authorized limit, and will not proceed with work
in excess of the limit without the prior written approval of Client.

Technology and Communication charges induding general and CAD computer, software, telephone,
routine in-house copies/prints, postage, miscellaneous supplies, and other incidental project expenses
will be billed at 6% of West Yost labor.
Outside Services such as vendor reproductions, prints, shipping, and major West Yost reproduction
efforts, as well as Engineering Supplies, etc. will be billed at actual cost plus 15%.
Mileage will be billed at the current Federal Rate and Travel will be billed at cost.
Subconsultants will be billed at actual cost plus 10%.
Expert witness, research, technical review, analysis, preparation and meetings billed at 150% of
standard hourly rates. Expert witness testimony and depositions billed at 200% of standard hourly
rates.
A Finance Charge of 1.5% per month (an Annual Rate of 18%) on the unpaid balance will be added to
invoice amounts if not paid within 45 days from the date of the invoice.

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING
THE CITY MANAGER TO EXECUTE TASK ORDER NO. 45
WITH WEST YOST ASSOCIATES, INC., OF WALNUT CREEK,
FOR ONGOING ENGINEERING SERVICES RELATED TO
SUSTAINABLE GROUNDWATER MANAGEMENT ACT
WHEREAS, in accordance with the Task Order Agreement between City of Lodi and
West Yost Associates, Inc., dated January 13, 1999, West Yost Associates, Inc., is authorized
to complete the scope of work as defined in Task Order No. 45; and
WHEREAS, on August 28, 2014, the California Legislature passed comprehensive
groundwater legislation enacting the "Sustainable Groundwater Management Act" (SGMA).
Governor Brown signed the legislation on September 16, 2014, and it became effective on
January 1, 2015; and
WHEREAS, West Yost Associates, Inc., has been asked to provide input to the City
regarding review of SGMA-related requests from the Eastern San Joaquin Groundwater Basin
Authority, review and comment on SGMA documents, and attend Ad Hoc Technical Advisory
Committee meetings as the City's representative; and
WHEREAS, staff recommends authorizing the City Manager to execute Task Order
No. 45 with West Yost Associates, Inc., of Walnut Creek, for ongoing engineering services
related to the Sustainable Groundwater Management Act, in the amount of $40,000.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to execute Task Order No. 45 with West Yost Associates, Inc., of
Walnut Creek, California, for ongoing engineering services related to the Sustainable
Groundwater Management Act, in the amount of $40,000.
