HomeMy WebLinkAboutAgenda Report - April 19, 2017 B-01 SMTM CITY OF LODI COUNCIL COMMUNICATION AGENDA ITEM B -I AGENDA TITLE: Adopt Resolution Declaring an Emergency Condition Requiring the Immediate Repair of Mokelumne River Levee at Lodi Lake Nature Area, Authorizing the City Manager to Order Required Actions and Execute the Necessary Documents to Perform Repairs, and Appropriating Funds ($250,000) MEETING DATE: April 19, 2017 PREPARED BY: Public Works Director RECOMMENDED ACTION: Adopt resolution declaring an emergency condition requiring the immediate repair of Mokelumne River levee at Lodi Lake Nature Area, authorizing the City Manager to order required actions and execute the necessary documents to perform repairs, and appropriating funds in the amount of $250,000. BACKGROUND INFORMATION: On April 11, 2017, Park's staff noticed that a portion of the Mokelumne River levee at the Lodi Lake Nature Area trail has eroded into the river, as shown on Exhibit A. There are additional fresh cracks appearing along the bank, as shown on Exhibit B, indicating the levee structure is becoming unstable and could fail at anytime. This portion of the levee was temporary repaired in 2012 by Woodbridge Irrigation District. The existing vegetation was removed at that time as part of the repair work and has not yet been reestablished. Due to unprecedented rainfall experienced this winter, the river water is running faster and higher than usual. The combination of lack of vegetation in this part of the levee and sustained high river flows has caused a substantial portion of the heavily saturated slope to fall. into the river. If the levee fails it will cause flooding in the nature area, potentially killing trees and native plants, and displacing wildlife. Kjeldsen, Sinnock & Neudeck, Inc., a local engineering firm that specializes in levee maintenance and repair has been retained to assist staff with formulating a plan to repair the damaged levee section as soon as possible. The proposed work will involve filling the river bank with soil and rocks. Staff has also contacted California Department of Fish and Wildlife to request authorization to repair the levee under emergency conditions. Staff recommends City Council declare an emergency condition and authorize the City Manager to execute the necessary documents to perform emergency repairs before the further erosion of the levee; and appropriate funds. The estimated cost of the consulting service and construction contract is $250,000. FISCAL IMPACT: The repair will temporarily reduce the potential flooding impact to the Lodi Lake Nature Area. Permanent repairs will be planned as funding becomes available. RESOLUTION NO. 2017-75 A RESOLUTION OF THE LODI CITY COUNCIL DECLARING THAT AN EMERGENCY CONDITION EXISTS REQUIRING THE IMMEDIATE REPAIR OF MOKELUMNE RIVER LEVEE AT LODI LAKE NATURE AREA, AUTHORIZING THE CITY MANAGER TO ORDER REQUIRED ACTIONS AND EXECUTE ALL NECESSARY DOCUMENTS TO PERFORM REPAIRS, AND FURTHER APPROPRIATING FUNDS WHEREAS, on April 11, 2017, Parks staff noticed that a portion of the Mokelumne River levee at the Lodi Lake Nature Area trail has eroded into the river; and WHEREAS, there are additional fresh cracks appearing along the bank indicating the levee structure is becoming unstable and could fail at any time; and WHEREAS, the combination of lack of vegetation in this part of the levee and sustained high river flows has caused a substantial portion of the heavily -saturated slope to fall into the river; and WHEREAS, if the levee fails, it will cause flooding in the nature area, potentially killing trees and native plants, and displacing wildlife; and WHEREAS, the estimated cost of the consulting service and construction contract is $250,000; and WHEREAS, staff recommends that the City Council declare an emergency condition and authorize the City Manager to execute the necessary documents to perform emergency repairs before further erosion of the levee occurs; and WHEREAS, staff further recommends that the City Council appropriate funds in the amount of $250,000 for this repair. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby declare that an emergency condition exists as required by the Public Contract Code to dispense with the City bidding requirement for this project due to the risk of further damage to the Mokelumne River levee at Lodi Lake Nature Area that would result from a delay in commencement of repairs; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the City Manager to order required actions and execute all necessary documents to perform the repairs; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby appropriate funds in the amount of $250,000 for this project.
