CITY OF LODI COUNCIL COMMUNICATION AGENDA ITEM G-3 TM AGENDA TITLE: Public Hearing to Consider Introducing an Ordinance Reducing the Low - Density Residential Growth Management Allocations Currently Available in the Growth Management Program MEETING DATE: April 5, 2017 PREPARED BY: Community Development Director RECOMMENDED ACTION: Public hearing to consider introducing an ordinance reducing the Low -Density Residential Growth Management Allocations currently available in the growth management program. BACKGROUND INFORMATION: The City's Growth Management Program was instituted by Ordinance 1521 in 1991. The allocation system gives priority through point assignments to projects that reduce impacts on services, infrastructure, and resources. The ordinance sets an annual growth limit of two percent of the City's population, compounded annually. Once the amount of allocation units is figured, the City requires that the allocation of units be distributed among housing types as follows: 44 percent low density, 28 percent medium density and 28 percent high density. The Growth Management Ordinance includes a priority location area and a point system to assist the City with prioritizing issuance of growth management allocations. The priority location area designates lands available for development and provides development categories and priority area based on availability of city services (e.g., water, wastewater, storm drains, streets, police, fire and parks). The system was established to rate projects based on various project merits in order to determine if one project should be approved before another, particularly if there are more allocation requests than there are available allocations. Because the City has issued growth management allocations at a rate less than what the ordinance allows, surplus allocations have accumulated. The City Council is being asked to review the number of unused allocations. As of 2017, that number is 5,141 units across the three density categories. Arguably, it would be nearly impossible for all of these units to be used in any given year, or number of years for that matter. The concern that may be more realistic is the perception of the potential pace of growth. The City Council should consider an action to expire a certain number of unused allocations in the Low Density Residential designation. The current allocation program has been suspended since 2012 and staff processed growth management requests at any time during the year as long as there are unused allocations in reserve. This may change in the future. The population has been as follows: 2012 — 62,575 2013 — 63,233 2014 — 63,651 2015 — 63,791 (62,772) 2016 — 63,219 Staff believes the drop in population is based upon how the state now counts temporary population and transient individuals. The Department of Finance has not indicated our January 1, 2017 population yet. Growth Allocations for 2013 and 2014 were higher because the persons per household was lower. New Department of Finance numbers show Lodi at 2.85 persons per household in 2015 compared with 2.7 in the past. Growth allocations for 2016 are also lower because of a reduction in the City population. The following calculation explains the current City population of 63,219 as of January 1, 2016 and 443 units available for 2016: 1. Calculate two percent of the City's current population: 63,219 x 2% = 1,264.38 2. Divide 1,264 by the average number of persons per household 1,264 / 2.85 = 443.50 3. Divide the 443.50 (443 du) units into the 3 housing types: 44% low density = 195 units 28% medium density = 124 units 28% high density = 124 units. In 2012, the City Council expired allocations accumulated since 2008. In the five-year period since 2008, 2,235 allocations were added to the reserve. The Council eliminated 800 Low Density and 1,435 High Density allocations. This Council action created a new balance of 4,674 as detailed below in Table A. These allocations help the City meet its affordability requirements as part of the 2016 — 2023 Housing Element. Based upon what allocations have been issued since 2012 and the amount of land currently available in Lodi, the 3,256 Low Density growth allocations are more than what the Council could issue in the upcoming years. The following table identifies remaining large properties within the City Limits and identifies staffs best guess at holding capacities. This number helps the City meet our development needs and allows growth consistent with the Growth Allocation Ordinance. This would be an elimination of 1,056 growth allocations. AN UNCODIFIED ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODI REVISING THE GROWTH MANAGEMENT ORDINANCE BY EXPIRING 1,056 UNUSED LOW DENSITY RESIDENTIAL GROWTH ALLOCATIONS WHEREAS, the Lodi City Council adopted Ordinance No. 1521 in 1991 establishing a Growth Management Plan for residential development within the City of Lodi; and WHEREAS, the Ordinance sets an annual growth limit of two percent (2%) of the City's population, compounded annually, and once the number of allocable units is figured, the City requires that the allocation units be distributed among housing types as follows: 44 percent low density, 28 percent medium density, and 28 percent high density (General Plan GM -P4); and WHEREAS, there are currently 3,256 Low Density Allocations, 736 Medium Density Allocations and 1,149 High Density Allocations; and WHEREAS, based upon the amount of land currently available in Lodi, the 3,256 Low Density growth allocations are more than what the Council could issue in the upcoming years; and WHEREAS, staff recommends that 1,056 Low Density Allocations be eliminated from the Growth Management Program, leaving a balance of 2,200 Low Density Allocations. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS: SECTION 1. That 1,056 Low Density Growth Allocations be expired and eliminated and the remaining balance of allocations for 2017 be as follows: a) 2,200 Low -Density Allocations b) 736 Medium -Density Allocations c) 1,149 High -Density Allocations TOTAL 4,085 Allocations SECTION 2. No Mandatory Duty of Care. This Ordinance is not intended to and shall not be construed or given effect in a manner that imposes upon the City or any officer or employee thereof a mandatory duty of care towards persons and property within or without the City, so as to provide a basis of civil liability for damages, except as otherwise imposed by law. SECTION 3. Severability. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. This City Council hereby declares that it would have adopted this ordinance irrespective of the invalidity of any particular portion thereof and intends that the invalid portions should be severed and the balance of the ordinance be enforced. 1 SECTION 4. Effective Date and Publication. This uncodified Ordinance shall take effect thirty (30) days after its adoption. In lieu of publication of the full text of the ordinance within fifteen (15) days after its passage, a summary of the ordinance may be published at least five (5) days prior to and fifteen (15) days after adoption by the City Council, and a certified copy shall be posted in the office of the City Clerk pursuant to Government Code section 36933(c)(1).
