HomeMy WebLinkAboutAgenda Report - March 21, 2017 B-01 SMTM CITY OF LODI COUNCIL COMMUNICATION AGENDA ITEM B -I AGENDA TITLE: Consider Authorizing the City Manager to Pursue the Purchase of a Used Portland Loo from the City of San Diego Through a Public Auction and Establish a Maximum Expenditure Amount for the Purchase MEETING DATE: March 21, 2017 PREPARED BY: Community Development Director RECOMMENDED ACTION: Consider Authorizing the City Manager to pursue the purchase of a used Portland Loo from the City of San Diego through a public auction and establish a maximum expenditure amount for the purchase. BACKGROUND INFORMATION: The Portland Loo is a specially designed vandalism -resistant public restroom kiosk created for high traffic urban areas. There are open slats at the top and near the ground, so a passersby and law enforcement can see whether there is illegal activity going on inside without compromising the privacy of users. The Loos have been noted for being less vulnerable to crime, drug use and graffiti than other public restrooms. The metal design is graffiti -resistant, easier to clean and resistant to vandalism. In 2015, the City of San Diego purchased and installed two Portland Loos, both within close proximity to Petco Park, the Downtown baseball stadium. However, within the first year, one of those locations became problematic with an increase in crime and illicit activities. In January 2016, the City removed the Loo from that problem location and have had it in storage ever since. The other Loo remains in place. When the Portland Loo issue came up again for discussion through the Short -Term Homeless Solutions Sub -Committee, an inquiry was made with the Mayor's Office in San Diego and we found that they were interested in selling the Loo, but they would need to see what process they would need to follow to do that. They determined that their Municipal Code required that this be handled as the sale of surplus city equipment and that it would be placed on a public auction site. The auction site listed this Portland Loo on February 27, 2017, with a minimum bid amount of $40,000, with a Buyer's Premium of 10 -percent. The sale is as -is with no warranty and they encourage bidders to inspect and determine the condition of the unit prior to bidding. The successful bidder will be responsible for loading and removal and any and all property awarded to them from the place where the property is located, so there would be additional costs for City staff to drive down to San Diego, load and transport the unit back to Lodi. APPROVED: Step chwa:auer, Ci y Manager Purchase Portland Loo March 21, 2017 Page 2 of 2 The initial bid period expired on March 8th without any bids received, so the bid deadline was reset to March 23rd. There is a chance that this pending bid deadline could pass without any bids placed. Staff recommends caution in the decision to purchase the Loo at this time. There are a number of unknowns regarding the overall project. Site installation costs could vary widely depending on the ultimate location chosen. Public acceptance of the project or location has not been vetted through the public notice and meeting process. More importantly although we have a verbal commitment from June Acker to pay to maintain the loo, we have no binding commitment. Annual maintenance costs in other cities have been reported as high as $50,000 per year per loo. Theoretically, at the end of the day we would have a loo we could resell. However, given the extension of the bidding period by San Diego, even that value is currently in question. Staff understands the value of a good deal. However, we are cautious in chasing a deal before we are able to fully vet the project. FISCAL IMPACT: Very preliminary estimates indicate the purchase and installation cost for the used Portland Loo could range between $90,000 and $180,000. The range in cost is based on potential locations, the final of which has yet to be determined. Annual maintenance costs could vary between zero (if the service is donated) to $50,000 per year if performed under contract. FUNDING AVAILABLE A funding source for the purchase, installation and necessary daily maintenance has not been identified.
