HomeMy WebLinkAboutAgenda Report - February 1, 2017 C-06CITY OF NODI COUNCIL COMMUNICATION AGENDA ITEM TM AGENDA TITLE: Adopt Resolution Accepting Improvements Under Contract for Americans with Disabilities Act Improvement Project Phase 3 — Church Street Parking Lots, and Appropriating Funds ($44,857) MEETING DATE: February 1, 2017 PREPARED BY: Public Works Director RECOMMENDED ACTION: Adopt resolution accepting improvements under contract for Americans with Disabilities Act Improvement Project Phase 3 — Church Street Parking Lots, and appropriating funds in the amount of $44,857. BACKGROUND INFORMATION: The project consisted of reconstructing two City parking lots located at 10 and 30 South Church Street (32,000 square feet) with asphalt concrete pavement, installation of Americans with Disabilities Act (ADA) compliant parking stalls, replacing 19 trees, new LED lights, and other incidental and related work, all as shown on the plans and specifications for the project, as shown in Exhibit A. Photos taken before and after the work was completed are shown in Exhibit B. The contract was awarded to MCI Engineering, Inc., of Stockton, in the amount of $278,926.32, on May 7, 2014. The contract has been completed in substantial conformance with the plans and specifications approved by City Council on March 5, 2014. The final contract price is $323,782.45. The difference between the contract amount and the final contract price is due to two change orders. Change Order No. 1 included additional electrical work and storm drainage work due to unforeseen underground utilities on-site ($33,996.13). Change Order No. 2 included additional curb and gutter work and parking lot striping changes ($10,860.00). The project was substantially completed in September of 2014. The City did not accept the project at that time because of a dispute with the contractor over damage to an existing monitoring well located at the project site. State Water Resource Control Board ultimately determined that the monitoring well was no longer needed; as a consequence the City sustained no damage. The City is prepared to accept the project. Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors that the project is complete and begins their 30 -day period to file a stop notice requiring the City to withhold payments from the prime contractor in the event of a payment dispute. This project was budgeted in Fiscal Year 2013/14 and remaining funds that were originally appropriated did not carry over to the current fiscal year budget to pay the remaining contract. Staff is recommending an appropriation of $44,857 to cover the remaining costs. RESOLUTION NO. 2017-05 A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING THE IMPROVEMENTS UNDER THE CONTRACT FOR AMERICANS WITH DISABILITIES ACT IMPROVEMENT PROJECT PHASE 3 — CHURCH STREET PARKING LOTS, AND FURTHER APPROPRIATING FUNDS WHEREAS, the contract for Americans with Disabilities Act Improvement Project Phase 3 — Church Street Parking Lots was awarded to MCI Engineering, Inc., of Stockton, in the amount of $278,926.32, on May 7, 2014; and WHEREAS, the contract has been completed in substantial conformance with the plans and specifications approved by City Council on March 5, 2014; and WHEREAS, the difference between the original contract amount and the final contract amount was due to two necessary change orders; and WHEREAS, the appropriation is to cover the remainder of the original grant -funded appropriation that was not rolled into the Fiscal Year 2016/17 budget; and WHEREAS, staff recommends that the City Council accept improvements under the contract for Americans with Disabilities Act Improvement Project Phase 3 — Church Street Parking Lots; and WHEREAS, staff further recommends that the City Council appropriate funds in the amount of $44,857 from the General Fund. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby accept the improvements under the contract for Americans with Disabilities Act Improvement Project Phase 3 — Church Street Parking Lots; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby appropriate funds in the amount of $44,857 from the General Fund for this project.
